Commissioner Clark stated that he had previously reviewed the site, and did not have the benefit of Commissioner Schoneman's findings. Co~missioner Schoneman reported that he had reviewed the site in relation to the original plat; observed the homos in the surrounding area; and expressed the opinion that there would be no interference with anybody's view by the proposed structure as compared to a two-story structure which would be permitted under the present zoning; that there would be a savings to the owner in the proposed structure through the savings in walls required. MOTION by Commissioners Clark and Schoneman that rezone be approved and the City Attorney e~structed to draft the necessary ordinance, containing the restriction that the reclas- sification is for a t~-story, six-unit townhouse, according to the site plan. Co~issioner Clark stated that although he has previously objected to protective covenants in zonings (that when an area is clearly Commercial they were not necessary), he had always realized that there might be extenuating circt~stances in some instances where he wauld be in favor of restrictions. (Minutes - Council Meeting ,September 15, 1971, Cont.) [[earing (cont.) Mayor .larstad commented on the recognition by Council of the questions raised by interested parties; on the continuing need for more:.bomes in a growing area; the improve- ments that would be forthcoming; and of his concern for the utilization of the land. Mr. J. DeFina raised questions about the requirements as to lot size; objected to the appearance df the proposed building, its affect on the people's right to privacy and their investment in the area, and the manner in which tile Planning Commission hearing was conducted. He stated the reione should be denied and the ~roperty remain in the single- dwellin~ classification. Members of the Council, and City Clerk, spoke to the facts that: three-level duplexes could be built under the present zoiing and that the proposed use would be in the better interest of the adjoining property owners; off-street parking facilities would be adequate, and the building would have to comply with requirements of the building permit (both as to structure and open space). That it is Council's purpose to determine what is in the interests of all the oeople, any similar petition by any person would receive the same consideration; the matter went through the regular process of the Planning Commission (an eight-man Commission on which there are two involved directly in real estate), and every- body had a chance to speak. ANDERSON CREEK PROPERTY Commissioner Schon~an expressed recognition of the fact that County had granted City's petition for rezoninR--to COv~.RCIAL--of City-o~ned property at Anderson Creek.
