Clerk advised that he will prepare transcript and that a copy of the Notice has been forwarded to City Attorney's office. (Minutes - June 50, 1971 - cont.) CITY REZONE APPLICATION Clerk read letter dated June 22,1971, from Kitsap County Auditor and Clerk of the Board of County Conmissioners to City of Bremerton, advising that the Board of County Com- missioners, at its regular meeting June 21, 1971, upheld the action of the County Plan- ning Commission denying City's application for a rezone to '~7~nufacturing" for property located in the vicinity of Sinclair Inlet. Both Commissioner Schoneman and Mayor Jarstad expressed disappointment at the de- cision, stating: the area had been created as a garbage dump; an adjacent property is zoned for '~anufacturing" and this would probably be the last portion of land in the area that could be used for that purpose; that at least two businesses had expressed a real interest in utilizing the site, which would create a considerable number of jobs while meeting all ecological requirements; the County has a great need for such indus- tries and would realize revenues from Sales taxes. PORT IVA~IINGTONNARRO~S SEWER SYST~N Clerk read letter of June 21, 1971, from consulting engineers to Mayor and Commission recommending award of bid on Schedule A to Roth Excavation Co., Everett, Washington (low bidder); and rejection of all bids on Schedule B (over Engineer's estimate). Also read memo from Engineer Parker to Council dated June 29, 1971, concurring in the recommendation of Howard Godat(consulting engineers). Discussion followed as to the need for getting Schedule A started as soon as possible to take advantage of tide conditions, and as to whether certain statutory requirements could be fulfilled in time. Attorney advised that a contract could not be awarded until a resolution was approved establishing an L.I.D., hearings held and adjoining property owners notified. The consensus was that legal requirements could not be met in time, and that other considerations made it desirable, in any event, to delay award of contract: such as including the east side of the Narrows in bid pro- posal; taking advantage of favorable tide conditions next summer, and possible addi- tional financing being made available by the Federal Government. Motion by Commissioner Schoneman and Mayor Jarstad that bids on Schedules A and B be re~-~j~fed, carried unanimously. Under discussion, Mayor Jarstad explained to those present that attendance of all the Commissioners is required, by Charter, for passage of an emergency ordinance on first reading; and the purpose of motion is to indicate intent of City to comply with State regulations in order to participate in revenues from excise taxes already being collected; that ordinance does not increase the excise tax, but allows City to be eligible for State funds and matching Federal funds. Motion carried unanimously. GENERAl. REPORTS Commissioner Schoneman:- This is "Lamplighting Day" for Kitsap~ay, completing City's first urban TRAFFIC OPERATIONS PROGRAM TO INCREASE CAPACITY AND SAFETY(TOPICS). This is one of the best lighted arterial highways in the State; financing based on 54% Federal money from the TOPICR program; 46% from 1/2t gas tax--nothing from the General Funds of the City. Another similar vroject planned for Wheatun Way from Manette Bridge to t~ls Corners. (Minutes - June $0, 1971 - cont.) General Reports(coat,) The two west lanes of Washington Avenue are now open and old cOncrete on east side has been removed; as there will be no traffic interference, east side two lanes should be completed within three weeks. Completion of Wheaton Way paving has reduced a lot of traffic problems--especially between Sylvan and Riddell. An innovation is a double-white-line south of Sylvan, which, with nroper si~ning, will allow turns without breaking the law-whereas a double yellow line will not. This has been checked with the Police Dept. and safety engineers from Olympia; and this arrangement serves in place of a fifth lane, Pavement breaking has begun at Pacific and First; shipyard and City Police, and all concerned, have been notified; in about 120 days a "Parade" ground to be proud of will be con~o]eted. Maintenance paving program now under way and will continue until funds that have been allocated for the budget year have run out, The same program will be continued next year. An association for the carillon bells has been activated, and includes a five-man cmH,dttee to solicit contributions. Mr. Eddie Adams is a member of the'Associatiun (Attorney Wal~ren offered the cocp. eration of his office). An account has been set up at the First Federal for direct contributions. Ail contributions gratefully accepted, and hope to have the bells by Thanksgiving. Announced a fine, new recreation facility in the area: a 3-3/4-mile "maze" of pedal-bike trails, created from old loggin~ roads, to be opened over the Holiday weekend, just about opposite JARSTM) PARK on the Old Belfair highway. These will also serve as fire trails, and for skiing when there is snow. Although in the area of the Police Pistol range, there will be no danger from the shdoting practice because of the coat our of the surrounding lands. Signs will be placed along the trails for guidance; there will be no firearms allowed and there will be ample parking facility. Attorney Walgren:- Re ~LER CONSTRU(TrION vs City of BR~IERTON, PSP~I. and PN~BELL, reported that the Court directed a judgment of apDroximately $8400 against the City, which he regarded as a major victory on behalf of the City as the City's ex-oosure was about $4S,000. Expect plaintiff to move for a new trial, but believes the City's position is a good one. This required Mr. Sexton's attendance for about ten days of trial plus the tim~ for depositions taken. Mayor Jarstad:- Expressed disappointment at the President's vetoing of the bill providin~ for increased public works projects, and explained that the City, with consultants and planners, has done a lot of preparatory work for mlch-needed projects, contemplating Federal money. The new ~opulation figure for the City as recognized by the State, is now 39,400 (an increase of 4,093 over last year's census). Will continue to work to have the Federal census method recognize the City's "floating" population before next census, to avoid suffering an $80,000 loss as in 1970 due to their "Home-porting" method as applied to the floating ~opolation, which does not allow the City credit for personnel coming in on shins to be repalred--many of whom' are here in excess of a year's duration. The"ground rules" had been changed between 1960 and 1970. The State substantiates City's position and will so credit--unless another Federal census is taken, which might be in 1975. KIT,e~P IAKE PROPERTY ACC~IISITIONS--FOR PARK Mayor Jarstad stated that there is a probl,em involved in the acquisitions in that, although the project has been cleared by the Bureau of Outdoor Recreation and the Federal Govern- ment has advised of its approval, the Federal funds are not available; also that, as soon as Federal funds are available, the project will be firnded to the extent of S0% of the purchase price, with the State Interagency Con~nittee conraitted for 25%, He then raised the question as to whether City wished to proceed with the acquisitions on the basis of grants already awarded, and the Federal Goverrment's assurance that it would not object to making negotiations before funding. (*) Motion by Mayor Jarstad that Council authorize conclusion of title transaction between .~eard, representing the City, and land owners; seconded by C~i~,dssioner Schoneman (to open the matter for discussion). Mayor Jarstad recessed the meeting briefly to discuss the matter in open Comittee; then reconvened the meeting, (*) Tile question not being called for, motion was not put to a vote. City has to make a determination regarding proposed rate increases for sewer and water, and hope a hearing can be set within the next couple of weeks. Cost factors are goine up every day. Hentioned the need for study and experimentation to get better circulation of traffic in the downtown area. ].IONS FIELD work progressing; sprinklers at work, and tennis courts progressing rapidly. East Park cleanup under way. (Minutes - June 50. 1971 - cont.) 12:05 P.~l. Mayor Jarstad advised that the Architect had sent an addendum to prospective bidders on the Golf course clubhouse advising that bids would be opened at 2:00 P.M., and the meetin~ was recessed until 2:00 P.M. for opening of bids. 2:05 P.M.
