OPEN b~ihq'ING
As zs customary, Mayor Jarstad invited anyone in the audience to speak on matters not on
the agenda. The following took the floor:
.Jim Kline, 3308 Phillips Ave.
William Giles, 3313 Phillips Ave.
Both spoke about the condition of the road surface on Sylvan Way and Pine. Mayor
Jarstad and Commissioner Schoneman commented on the unusually large sums of money re-
quired to install the storm sewer in that area--due to unexpected extra construction
costs because of rock encountered; and briefly mentioned plans for continuing improve-
ments as soon as funds are built up. Also mentioned that funds could be raised by means
of an L.I.D. based on front-footage assessment; and large amounts had been spent in that
area since annexed into the City.
Commissioner Clark added that the City is only supposed to do maintenance on the
streets; that the City of Bremerton is unique in the amount of street work done at no
direct cost to the property owners, and he was sure the residents of tile area would bo
proud of the ultimate improvement.

STREE~r VACATION - OMAITS/JENSEN
Motion by Mayor Jarstad and Commissioner Clark that hearing be opened, carried unanimously.
--llayor Jarstad asked for any testimony or correspondence on the proposed vacation.
City Clerk gave background as outlined by letter November 25, 1970, from Attorney
Merrill Wallace to City Council: Asking for vacation of the easterly 30 feet of Ranier
Avenue (also known as Ford Ave. ) abutting Lots 1 and 48 in Block 2 of Port Orchard First
Addition. Letter stated that street was never improved as a County Road and, pursuant
to laws of 1889-90, these portions were vacated; sbthat, the City, upon annexation of
this area, never became the owner of the street. Mr. Wallace added that the matter
could be cleared by action of the Commission, vacating the land, or by Court action
such as was instituted by Mr. and Mrs. William E. Bogard in Superior Court, resulting in
a judgment of vacation and clearing the cloud on title--July, 1969.
Clerk stated that proper postings had been made and notices sent to other property
owners in the area, as required by law; also that Attorney Sexton's final advise w~s
that the matter should be handled through Council [Mr. Sexton was not present, bei'ng at
session of Superior Court).
Commissioner Clark stated that, in a similar previous situation, it was found im-
possible to provide witnesses or evidence re~arding improvements so far back as 1889.
Messrs. Omaits, JensOn and Bogard spoke on behalf of the vacation. There were none
opposed.
Commissioner Clark added that he was in favor of granting the vacation, but, since
the matter was handled between the attorneys, who were not present, he felt it whould be
checked with the City Attorney.
Motion by Commissioner Clark and Mayor Jarstad to close the hearing and defer a decis-
lentil next Council meeting, after discussing with Attorney.
Mayor Jarstad co~nented, further, that this hearing has circumvented the normal
hearing procedures--through the Planning Co~l~ission--because of the legal precedent involved;
and because of the absence of City Attorney, a decision would be deferred until next
week. Motion carried unanimously.
