Attorney Sexton made some suggestions to Mr. North regarding the proposed petition. SPAITI~I REZONE APPEAL * Clerk announced it was the time and place set for hearing on appeal by Spaeth Transfer Co. of Planning Commission's denial of application for rezone from R-1 to B-5 of property at approximately 1229 Ibllis. Clerk stated that notice of hearing had been published and posted as required by the ordinance. Hearing opened on original motion. Clerk read letter dated Feb. 23, 1971, from Secretary of the Planning Commission to Mayor and Council, advising that the Commission had denied applicant's request for rezone from an "R-i" Single Family and Duplex Dwelling District to a "B-3" district for the purpose of constructing additional warehouse space and additional parking; letter also quoted excerpts from minutes of the meeting Feb. 17, 1971, in which the petition was denied, also from Staff Review listing the findings of fact. Papers and documents constituting the record upon which the ruling appealed fromwas made, were forwarded with letter. Staff Review recommended that the Commercial zone be extended for a distance of SO feet rather than 80 feet; and that a policy be established that commercial zoning shall not be approved closer than 200 feet of Maple Street, except in those instances where the developer proposes a planned integrated commercial/residential development. Also read were: Letter dated March 1, 1971, from Mrs. F. G. Bergsma, 1328 Bradley, to City Clerk (copies to members of Council), expressing concern as to what might happen to the area, listing seven items of concern and recomnending retaining green buffer zones and developing some "miniparks." ~me from Engineer Parker to Planning Dept., stating that the Engineering Dept. will re- quire certain street improvements at the time the owner of the "rezoned" area desires to make improvements. Memo from Capt. Ted Ingram to Mayor Jarstad and Commissioners recommending that rezone be granted for the purpose of allowing the trucks to be parked off the street right-of-way for uncontested traffic movement. Memo from Building Dept. to Planning Dept. advising it did not concur with the requested zoning. [~larch 18, 1971 - cont.) Letter dated Feb. 3, 1971, from David E. Crawford, Lieut. Inspector of the Fire Prevention Bureau, to the Planning Commission, advising that the requested rezone meets the approval of that Department with the recommendation that another Fire t~drant be installed at Intersection of t[ollis and ~aple. Planning Director reviewed the area on the Comprehensive Map and site plan, and clarified the Staff Review. Mr. Arthur L. Pilion, 5922 ~aple Ave., spoke on behalf of those opposed to the rezone; also Winifred J. Rauleau of 1355 Bradley; Mrs. Dwight L. Mickels, 1218 E. Hope; Florence Boody of 1406 Bradley; LaDeane Tate, 1316 E. Ilope; Patricia Miller, 1336 Bradley. They expressed the fear that a trend would be started; also further encroachment toward Maple St. from the Conmercial line they felt had been established and was going to be main- tained. They feared also that a Con~nercial area, or even an R-2, would hit into their neighbor- hood. They reiterated that they were not just opposed to the requested rezone, but to the general trend. Messrs. I,oidhammer (Senior and Junior) both spoke in favor of the requested rezone, statin~ they had bought the property some time before those protesting had moved in; that business is growing in the area and their type of operation would not harm anypne--and that it might be worse if the rezone were not granted. Commissioner Clark stated his opinion that a good answer had not been given as to why 170 feet wasn't a good buffer zone (rather than 200 feet or 250). Motion by Commissioner Clark to approve the rezone (not seconded). A petition, signed by about 85 people, was presented to Council, stating: property values would be reduced by such developments proposed by Spaeth; asked that only R-1 zoning be per- mitted in the area (detailed in petition); recommending that any contract to a property owner in the area contain land-use restrictions(detailed in petition), in precise and legal terminology. Commissioner Schoneman stated the information presented was very enlightening but he would like to weigh the matter mere before making a decision. Motion by Commissioner Schoneman and Clark that the appeal be considered in Executive session ~----d-~at a decision be announced at next Council meeting (3-24-71). blr. Victor Reames, 1307 East llope, stated he was not within the 150 feet, and claimed (Ron) Ross (who was present) was interested in something mere than this; expressed appreciation for efforts of Council to be objective, and again expressed opinion that the main problem is what was going to happen to the area. Mr. Ron Ross stated he supported the application for the rezone as it is not detrimental to the public or the City as a whole. ~ayor Jarstad explained the difficulty of setting an arbitrary depth for a "buffer zone," and stated that the "strip-zoning" of ;qheaton ~qay was initiated because of what had been done originally under the County--and not according to Comprehensive Plan; and that the City is trying to do this in as fair a way as possible and to salvage as much as possible from business congest ion. ~Iotion carried unanimously. b~yor Jarstad invited anyone to speak further, either for or against the rezone.
