IIFARINGS
LT~fa~--gffnounced that it was the time and place set for hearings: Seventh Day Adventist;
Briston Corp., Shore Drive; Arden Farms; Chateau Roller Rink; Skirving Rezone, ~erner Road;
and stated that hearings would probably go quickest if taken in reverse order.
Motion by 5laybr Jarstad and Commissioner Schoneman that hearings be held in reverse order,
carried unanimously.
Skirving rezone, Werner Road:-
Clerk stated that hearings had been held before and rezone' approved, but that when
ordinance was ready for printing, it was discovered there was a deficiency in the legal des-
cription--and rezone application required reprocessing.
~yor Jarstad asked whether there was anyone present wha would like to hear and pursue
information presented at previous hearing on this proposed rezone, or who was in opposition
to rezone. There were none.
Motion by ~layor Jarstad and Commissioner Schoneman that findings of previous hearing be
accepted and ordinance granting rezone be prepared with proper legal description, carried
unanimously.
Arden Farms, Inc., 1199 Marine Drive:-
Chateau Roller Rink, 1305 ~rine Dr.:-
Clerk stated that the two applications for rezoning from Residential-One to Business-
Three could be considered as one as far as the situation was concerned; that Findings of Fact
of the Planning Commission were on file, and a site plan does not accompany the application
becanse the buildings are already there and the use of the land will not change; however,
conditions are that prior to construction of any new buildings, a site plan, in detail, shall
be approved by the Planning Cu,m~ission, and the purposeof the rezone is to make ordinance
conform to present use.
City Planner reviewed locations on site and area maps and Comprehensive Plan. On invi-
tation of Mayor Jarstad, two gentlemen in the audience commented on the applications. Comm.
Scboneman commented that these properties had been outside the City and the annexation
ordinance had inadvertently omitted continuation of the zoning as it had previously been.
Motion by Conmissioner Schoneman and Mayor Jarstad to approve rezone application of Arden
~ Inc., from R-1 to B-3, carried unanimously.
(January 21, 1971 - cont.)
,~layor Jarstad complimented tile operators of the Chateau Roller Rink for their opera-
tion. Planner stated that the same conditions applied as regards Arden Farms.
b~ayor Jarstad invited comments from the audience, and Mr. Ron Ross said he objected to
placing restrictions on rezones.
~otion hv Commissioner Schoneman and ~yor Jarstad to approve rezone application of Chateau
~ R~nk from R-1 to B-3, carried unanimously.
Briston Corp., Shore lyf. at E. 10th:-
Clerk presented application of Briston Corp. of Tacoma for rezone for 51-unit apart-
ment building with parking for 77 cars, and read Planning Commission's staff review, recom-
mending that the change in zoning be allowed. Planner reviewed the area on area map,
land-use map and Comprehensive Plan.
In answer to question by ~ayor Jarstad as to what had been resolved on the street end-
ing at l-~ast 10th, Planner advised that Briston had presented document saying street had been
vacated--which was accepted by the Planning Commission.
Hayor raised question regarding insurance rating in that area, and was assured by
City Planner that it w~uld not be affected.
Planner also stated that with regard to traffic problems at the bridge, Capt. Ingr~
had withdrawn objections.
Hayor invited anyone in the audience to speak to the proposed rezone. No one spoke.
Co~issioner Schoneman commented that it was hoped to have a sewer on the beach prior
to construction.
b~otion by b~yor Jarstad and Commissioner Schoneman to grant rezone from Commercial to R-II,
to-~ston Corp., carried unanimously.
Seventh Day Adventist, Sheridan Rd. and Schley Blvd. :-
Clerk read excerpts from Planning Commission Minutes of December 16, 1970, dealing with
proposed use of property previously zoned R-2 for rest home; new use requested for 140-
apartment complex. Also read Comm~ssion's Staff Review, with recommendation of the
Planning Director that zone remain in R-2 classification but that the number of dwellings be
substantially reduced.
Mr. Don Rasmussen spoke for the rezone as one of the developers, stating he has an
option to buy the property provided it is approved by the Planning Commission for the com-
plex; also stated it would not be possible to build a reduced n~ber of units with all the
facilities as proposed and make it financially feasible.
A number of persons ]md been present and presented their main points in opposition.
Clerk also read Planning Commission Resolution No. 204, requesting Council to re-
affirm action taken in Ordinance No. 2893, changing the property from an R-1 to an R-2 zone
classification, for an apartment complex, with conditions that the development shall be
essentially the same as the site plan; height of buildings not to exceed 45 feet.
Clerk stated that action of Council back in June granted the rezone classification to
R-2 for the purpose of building a nursing home, but that the reference to nursing homo had
been omitted in the ordinance. ~avor Jarstad cor~nented that he wanted it made clear in the
resolution that the proposed rezon~ classification from R-1 to R-2 was for the purpose of
allowing the building of an apartment.
Clerk then read statement prepared by Planning Commission giving the background of the
situation and recommendation for rehearing before the Commission and City Council.
Planning Director Plescher reviewed the area of the proposed rezone from the stand-
point of density, type of structures going into the area and traffic congestion; and Mr.
])on Rasmussen outlined his plans for the area as presented to the informal hearing of
Planning Commission.
Mayor Jarstad invited those in opposition to speak. Mrs. Norman Cooper, 1042 Walnut,
whose home adjoins the church property at a lower elevation said she feared a car might end
up in her bedroom; that the proposed height of the apartment complex seemed to be increasing;
more children would add a burden to the School; also, the traffic burden would be increased.
Charles S. Boroughs, 1059 Walnut, stated that the privacy of the neighborhood would be
jeopardized. Robert J. Forst, 1022 Walnut, said that the Planning Commission Chairman had
a conflict of interest in the matter because his real estate firm was involved in the
potential sale of the land. Clerk read letters in opposition: dated January 18, 1971, from
Arlie and t~sterre Seeley, 1732 Sheridan Road; and from Bernarr Sollie, 2805 Olympus Drive.
Mayor Jarstad stated his stm~nation of the situation: There was no doubt the original
resolution indicated the rezone was for the purpose of building a nursing home (for which
financing proved unavailable). [l~eever, there is no guarantee that things will not change
(referring to the growth of Bremerton over the years); that we have to follow some relation-
ship of proper change--which is the reason we have a Comprehensive Plan and ordinances as
a ~uide to follow.
Asst. Attorney Kamps questioned Mr. Ra~ssen regarding his knowledge of the original re-
zone classification, calling for a nursing home, before he entered into his transaction;
and he affirmed, in answer to final question posed by Mr. Kamps, that the situation was
that earnest money had been given on condition that the rezone problem be cleared up to
allow him to build. This was confirmed by a representative of Mr. Beard who was in the
audience.
~r. Beckett spoke for the Seventh Day Adventist Church.
(January 21, 1971 - cont.)
Mayor Jarstad closed the hearing by expressing appreciation for all the testimony and stating
he thought all the points have been doctmented; that he knew the Planning Department has
made their recommendation on the density-per-acre and he thought this would be taken into
consideration by the Council; also that other problems--like traffic, drainage, etc.--are of
genuine concern and can be taken care of.
Motion by blayor Jarstad and Commissioner Schoneman that testimony be closed and a decision
ren-~ed at Cotmcil meeting February 3rd, when Commissioner Clark would be back and have had
an opportunity to review the matter with Council, carried unanimously.

ITi~ct be convened, carried unanimously.
Clerk stated that notices had been sent out and advertisements placed in the paper, as
required. No written protests had been received, and the assessment roll was at hand.
Engineer Parker diagrmmned the proposed system, explaining this was the result of a
petition and we are trying to carry out the will of the people.
Mayor Jarstad and Commissioner Schoneman explained the financing arrangement and
answered various questions from the audience. About sixteen people were present, evidently
for clarification only, as all expressions were in favor of the proposed L.I.D. and eager
for the proposed service.
blotion by Mayor Jarstad and Commissioner Schoneman that hearings be closed and that Clerk
e~tructed to read Ordinance, carried unanimously.
Clerk read Ordinance No. 2936, AN ORDINANCE PROVIDING FOR '[~tE IMPROVEMFArF OF: South
Constitution from Arsenal }Vay to 100 ft. North of Preble, South Charleston from Rodgers St.
to 100 ft. North of Preble, Rodgers from So. Constitution to So. Charleston, Farragut from
So. Charleston to So. Constitution, and Porter from SO. Charleston to SO. Constitution;
and creating a local improvement district to be known as "Local Improvement District No.510."
Discussion followed regarding the method of making payments.
Motion by Commissioner Schoneman and Mayor Jarstad for passage of Ordinance No. 2936, car-
r~e-~s follows: .~kayor Jarstad - Yes; Commissioner Schoneman - Yes. Commissioner Schoneman
commented that there would probably be a hid call in the Spring and an interruption of traf-
fic flow this sunmer. Kany of those present expressed appreciation.

by a majority of the Council, carried unanimously.
