BUS CONTRACT: Sec. 13C and Resolution
Mayor Jarstad stated that Commissioner Clark advised that in his absence all documents that need
to be prepared to go with the City's application for the grant for buses should be submitted and
action should be taken at this meeting. Mayor Jarstad also stated the preparing of this resolu-
tion has been discussed with'the City Attorney.
Attorney Walgren explained that this agreement is entered into by the City and the Company and
whatever labor force is involved; also, that force is presently being represented by a national
union. Mr. Walgren further explained that the AEreement does two.things: (1) advise~ them that
the City will not in any way retract any of the benefits or provisions ~ the existing union con-
tract because of their relationship with the company, and (2) it provides for certain procedures
to be followed in the case of any dispute that might arise between the employees and the Bremerton
Transportation Authority.
Attorney Walgren stated the documents received from Doctor Campbell relate primarily to the City
of Vancouver and the City of Spokane, which have recently gone through this process; also,
stated this Sec. 13C Agreement as it is proposed is very similar to the documents signed by those
two c~ties. Mr. Walgren explained that Spokane entered into this agreement somewhat reluctantly,
but they did so recognizing they were going to get favorable approval of their transit grant.
Mr. Walgren stated there is some question as to the conflict between the federal requirements
and the existing state law and perhaps the charter provisions; however, it was the position
taken by the attorneys representing the City of Spokane and basically the attorneys around the
state that federal law will supersede; and on this basis, City Attorney Walgren recommended that
the 13C be entered into.
Motion by Mayor Jarstad and Commissioner Schoneman that the Mayor and Director of Transit
Operations be authorized to sign the documents to be attested by the City Clerk to fulfill and be
able to finalize the City's application to UMTA for subsidy for the purchase of new buses, carried
