(2) 7~e four-unit building shown on the northwest corner of the original site plan will be de- leted. Yl~e letter stated further that all other portions of the original Land Use Restrictions Contract will remain as is. Clerk then read Staff Review dated January 19, 1972, which stated the purpose for the variation is to retain one building now on the property and remodel it. The original plan showed the building as demolished and replaced with a new four-unit building. The Review stated further that a dlscpepancy had been found in that the strip of land 28.~1 feet on the west side of this build- ink does ~ot appear as part of the .properTy on the original site plan; that it lies within the city r[Kht-o[-way for an unnamed street; that although this portion is included in the legal des- cription of the property, it has not been vacated by the City and shows as a street by all City maps. 'I]~e review stated furTher that curbs, sidewalks, and sanitary and storm sewers will be reviewed at the time that final plans are developed. The Staff Review recon~nended approval of the variasce, pointing out that the land Use Restrictions would still be in effect; and that these were ~ood restrictions for this particular site, protecting the owner, the neighboring property owners, and the City. Helen 'I~acy, using a land use map, showed the area under discussion; also Mrs. Tracy pointed ~t the unnamed street right-of-way. Mrs. T~acy then showed the new plan with the existing building and discussed the unnamed street right-of-way reiterating the conm~nts that were made in the Staff Review concerning this rig~t-of-way. Discussion of these comments were held and those participating were both Acting Mayor Clark and Con,missioner Schoneman, Mr. and Mrs. Morgan, Fk~s. ~,~itney, I4p. Costello, and k~. Shank. It was the consensus of the residents that they had no objection to the variation from the original site plan as it pertains to the remodeling of the existing structure; ]~wever, they were unanimous in their feelin~ that parking should be scruti- nized very carefully as proposed because of their understanding part of the au~ea would involve the u~mamed street right-of-way, which appears on the City maps. Mrs. Moran read all of the provisionf from the original Land Use Restrictions Contract and she was assured that with the exception of the variance being applied for, there would be no other exceptions perm/tted and that the Land Use Restrictions Contract would apply. When the discussions terminated, it was apparent there were no objections to the remodeling of the present structure. Acting Mayor Clark pointed out that parking would be a part of the building permit, and this 28.~1 feet of unnamed right-of-way would have to be clarified before any parking was permitted in that location. ~r. Sexton stated for the record that he and Mr. Walgren had sold their interest in that proper- ty about two months ago, which transaction is still in process. Motion by Acting ~iayor Clark and Commissioner Sehoneman that the variance be granted as requested w~--i~e Covenants remaining as is to remodel the existing building as approved by the Planning Co~ssion. Motion cs/tied unanJ3nously. Sergeant Gingrey checked with the residents involved, and parking will be chang~ ed to allow one vehicle to park in the alley on the north end of the no-p~rking yellow strip, which will be blacked out to allow this; also, the yellow strip will be blacked out south o~ the drivew,~y to 1008 War,ren Avenue to allow parking in that area. Commissioner Schoneman pointed out that there would be five psmking spaces allowed in the alley. He stated further that Frank Ki(k~ic~, Jr. was in l~is office yesterday and he had informed Mr. Kidrick of this action. BIL[~ ~o~n by ~ting Mayor Clark and Co~missioner Schoneman to pay all bills that are approved by a majority of the Commission, carried unanimously. REPORTS (continued) ~ !~ayor Clark reporTed briefly on so~ of the bills that have been passed by the special leKislative session and pointed out thet the rush of business at the last moment makes it im- pessib]e at this point to know just exactly what was passed by the legislature. One of the bills mentioned by Acting ~'~yor Clark as waiting for the governer's signature is House Bill H5438, which has to do with the improvement of the retirement benefits to public employees. He mention- ed that the tax revision pad,age had failed to pass and it was probably a good thing because of the n~ny amen~nents that had been added. Acting Mayor Clark recessed the meeting for 12 minutes until 11:00 A.M., at which tine bid openings are scheduled. Meeting came to order at 11:00 A.M. Motion by Acting Mayor Clark and Conmissioner Schoneman to open bids for the street-sweeper and the loader, in that order, carried unanimously. STRFJ~' SWEEPER Archie ~bttinger made a report that the demonstrator sweeper which has 42 hours running time, if purchased, would be a savings of $2,205.00 and recommended that the award be made for the demonstr~qtor model, which has the same warranty as the new sweeper. Commissioner Schoneman comme, nted that the City has a Mobil .Sweeper which is used for about 98 percent of the work and tl~t it has been a good machine and the City is familiar with this particular equipment. ~-(otion by C~,,~&ssioner Schon~man and Acting Mayor Clark that the City Council accept the bid on the d~nonstrator sweeper with 42 hours work which is t~e alternate bid, carpied unanimously.
