FEBRUARY 2, 1972 Recessed meeting of the City Council of the City of Bremerton, Washington, was held in the Council Q~mnbers at City Hall, B~emerton, at 7:00 P.M., PST, with ~yor Jarstad, presiding. Also present were~ Commissioner Clark, Commissioner Schoneman, City Clerk Yeadon, City Engin- eer Parker, Assistant City Engineer James Root and Howard C~0dat, Consulting Engineer. I,%ayor Jarstad stated this was time. and place set .for hearing the proposed formation of three local improvement districts for sanitary sewers: Kitsap Lake Business District and County Road 250; F~st and West side of Port Washington 1L~r~ows. Motion by Co~missioner Clark and Commissioner Schone~n that the hearing be opened on the Kitsap ]~ke Business District and County Road 250~ carried unanimously. Clerk reported that he had given notice as required by law. Clerk read letter dated Feb. 1, 1972 fro~ the Trust Deparb~nt, NBC, Seattle, for Robert Lursen Trust, objecting to the LID on the grounds that due to the shape of the prcpeI~ty they did not feel that the assessment is equitable or that the ~alue of the property would be increased in the an~unt of the assessment. Clerk stated that Jer~ Thornbumgh, Office Engineer, had studied the objection, had determined that the sewer line could be re-routed and serve the property on a shorter line with corresponding lower assessment, that he had so advised the NBC who were satisfied and withdrew their objection verbally. Clerk read from a copy of letter dated Nov. 10, 1971, from City Engineer to the City Council which gabe the valid signatures in favor of the improvement by percentages: by total area 52.33% by total front footage 58.22%. Clerk read leeter dated Jan. 14, 1972 to the City Council from Howard Godat, Consulting Engineer which su]~nltted the preliminary assessment map and roll, gave a sunm~mr~ of project costs, land a~ improvement values and back taxes and stated that the improvement can be legally formed since the amount of the roll plus back taxes is less than the value of the land and improvements. City F~gineer Parker gave a description of the area to be improved; used an aerial map to show location of sewer lines; stated the County Road 250 was a very small portion~ about 350 lineal feet of pipe% stated all were gravity flow sewer lines. (MI}~3TES - CITY C0bT'ICIL MELTING - FEBRUARY 2, 1972, Cont. ) Property owners Roy 0sterhout, 2420 Hilltop Dr., with property owned at 2119 Lakehurst Drive; and C~rl Anderson, 1331 East Lake Drive, were present. Mr. and Mrs. 0sterhout asked a numbem of questions and Mrs. 0sterhout stated the proper~y was not worth the amount of the assessment. Mr. Anderson stated he was the one who had requested the sewer improvement on County Road 250 and thanked Mr. Parker and Mr. Thornburgh for their assistance in helping to set up the LID. ~.~. C~dat answered most of the questions that were asked concerning location of main line, depth and design. Questions about permit fees and assessment charges were answered by Mr. Parker. Procedures which would be followed from this point to completion of the project and notice of assessment were answered by Mr. Parker. Mayor Jarstad explained that this LID came under the old rates and gave the reasons for this procedure. Hotion by Co~nissioner Clark and Comnissioner Schoneman that the ordinance be read forming the local improvement district, carried unanimously. OIq)INA~'~CE NO. 3004 Clerk read Opdinance No. 3004, An Ordinance providing for the improvement of: The Kitsap Lmke Business District and an ama on County Road No. 2S0 south of East Lake Drive all in accordance with the plans, maps, and specifications on file in the office of the City Engineer; adopting said plans, maps and specifications; establishing an improvement district; providing for the levying of assessments fop the payment of such improvement and making such improvement payable by bonds. Hotion by Co~missioner Clark and Mayor Jarstad to pass Ordinance No. 3004. Under discussion: ~--~sioner Schoneman pointed out the great need for the Kitsap Lake Business District Improve- ment. Hotion Hotion carried as follows: Mayor Jarstad, Yes; Commissioner Clark, yes; Conm~issioner Schoneman, Yes. LID - West Side, Port Washinston Naz~ows Hotion by Co~ssioner Cla~k and Mayor Jarstad to hold the hearing on the proposed formation of an LID on the West Side, Port Washington Narrows, for sanitary sewers and lift stations, carried unanimously. Clerk stated he had given notificiation of this hearing as required by law. Clerk read letter dated Jan. 27, 1972, from City Engineer to the City Council which gave a sum- mary of project costs, land and i~provement values and back taxes and stated that since the cost of the project is less than the value of land and improvements, the LID can he legally formed. Also, Clerk read letter dated Dec. 16, 1971, to the Council from City Engineer which gave percentages of valid signatures on the petition: by total area 64.34%; by front footage 61.~2%. Clerk read letter from Hal Liasett, 608 Washln~ton Ave., objecting to the proposed impmovement from standpoint of timing; suggested that it would be more economical to combine with marine de- velopment of the area, as the sewer line would be in a more accessible maintenance position, as well as prevent further cost to the individual involved taxpayer; also, questioned why waterfront line costs three times both sides of line construction. Clerk read a second letter, fz~m Terence Hanley for R. E. Lindstmom, Eo H. Derrig, T. J. P~oteau, James 0. Arthur, James D. Shank and himself, owners of property at 400 Washington Avenue, ob- jecting to the preliminary estimate assessment for the reason~hat the proposed assessment is in excess of the special benefits which will be conferred by the i~provement and the proposed assessment is contrary to law. Max Huestis, 902 Washington Avenue, stated he was mislead when asked to sign for the improvement; that he thought he was going to hook on to sewer on Washington Avenue; that he believed his father had paid assessment and given easement for the high pressume line laid on the beach many years ago, and believed he should be able to hook up to that line. Mr. Hanley stated he objected to the mode of assessment and Mr. Clark informed him this hea~ing was for the purpose of hearing on the formation of the improvement district and there would be a hearing on the assessment at a later date. Howard Godat reviewed the improvement using an aerial map. An extensive question and answer period followed regarding many details of how the improvement would work with relation to existing sewem lines, with regard to assessments and payment plan, to the location of the iow pressure line in relation to bulkheads. Some of those joining in the discussions were identified as: Mr. Liasett, Mr. Hanley, Mr. Denault, Mr. Heustis, Michael Powell, [~. Ross, ~k~. Bjomk, Mr. Dawkins, Bill Bmoaden, Mr. Vockrodt. Other questions were asked concerning hook-up of two houses presently using one sewer line now to the beach. It was stated by the City Council that this question would have to be looked up further in view of the present ordinance. On ~.tr. Liasett's objection, Mr. Schoneman stated the proposed waterfront improvement is sev- eral years away, at least, and the improvement for sewers is required now because of pollution problem and insistence of state health and environmental people who insist the project get ~mderway because raw sewage is being dumped into the hay. Also, that the line being made of cast i~on it would not be bothered by a fill on top of it but that the moving of the high press~me Nine would have to he paid for by others; also, that property can't be assessed twice. I~r. Parker and ~. Schoneman replied to Mr. Huestis that no one had been assessed for the high pressure line and it was not meant for hooking on to but was for transferring sewage from one (MIMfFES - CITY COUNCIL ~'~f±'iNG - FEBRUARY 2, 1972, Cont. ) point to another. I~. Schoneman explained to Mr. Huestis that the Washington Avenue line was not deep enought to serve his property, that it never had been before the present line was installed either'. Discussion was held on the point brought up by Mr. Ross as to whether two pieces of property could be treated as one for asseesment purposes. Mr. Bjork made the point that 6th Street runs between two pieces of his property. Mayor Jarstad spoke to the gravity of the situation on Washington Avenue which requires a sani- tary sewer and outlined problems which the property owners would face if the improvement was not accomplished which would come from health people and other environmental officials. Commissioner Clark gave points relating to former method of figuring assessments which under present costs would mske it prohibitive for waterfront owners, especially, to pay for an im- provement% gave a n]ndown on the present method of charges and their beneficial action in getting improv~nents accomplished. Also, that present ecology demands are such that outside government officials could force the improvement without any care for costs or ability of owners to pay. Also, pointed out that future development of the waterfront area would not involve federal funds because the area would not qualify, so there would be no reason from this standpoint to wait further. Motion by Cx~,missioner Schoneman and Conmissioner Clark to approve the formation of the LID, carried unanimously. 0RDINI~'~CE No. 3005 Clerk read An Ordinance providing for the improvement of: An area known as Port Washington Narrows - West Side, all in accordance with the plans, ~aps, and specifications on file in the office oF the City Engineer; adopting said plans, ~ps and specifications; establishing an ~nprovement district; providing for the levying of assessments for the payment of such improvement and making such improvement payable by bonds. Motion hy Commissioners Clark and Schon~; an that the Ordinance, No. 3005, be passed with the addition of the legal description involving Park Dmive, carried as follows: Mr. Jarstad, Yes~ rk~. Clark, Yes% Mr. Schoneman, Yes. (NOTE: On l~]ursday morning the City Engineer;s Office reported that the Park Drive improve- ment was part of the project but not part of the district so there was no need for adding to the legal description.) [~ARING - Po~t Washington Narrows, East Side (Sanitary sewers, etc.) ~by ~yor Jarstad and Commissioner Clark to hold the hearing as advertised, carried un- an~mously. Clerk r~ad letter dated Jan. 27, 1972, to the City Cmaneil from the City Engineer, giving a s~nary of project costs~ land and improvement values and back taxes; and stated that since the cost of the project is less than the value of land and improvements the LID can legally ~m for~ed. Also~ read letter dated No. 30, 1971, giving percentages of valid signatures on the petition as follows: by total area 56.59%; by total front footage 58.18%. Clerk ~ead the only letter of objection, from Farrell E. Cook on behalf of Glenn L. Vockrodt, which stated he wanted his property removed from the LID inasmuch as the property would not benefit from the services of the LID; that he feels he has proper service for his property by septic tank and drain field syste~n and that if this is abandoned, he should be allowed to connect to the pressure line as other adjacent property has been allowed to do. [~yor Jamstad stated that he did not believe any property had ever been deleted from an im- prove~nent because of a septic tank ~ that they ~ temporary at best. Mr. Vockrodt stated it was his contention that he would not be receiving the benefit and Mr. Clark informed him that the City Attorney may have a different attitude to which Mr. Vockrodt admitted might be so. Clerk then read from a copy of letter dated No.. 24, 1971, from Engineer to Mr. Cook relating to the same information in the latest letter concerning Vockrodt objection. A~ong other things, the Engineer's letter stated he knew of no adjacent properties that connect directly into the existing pressure line; also, that Mr. Vockrodt would not be mequired to connect his house while his septic t~k system is operative but he would be required to make assessment and monthly charade payments; also, recomnended he not be deleted from the petition. Hr. C~dat reviewed the area from map~ s~wing the sanitary sewer line outlined on the map. Questions were asked and answered on various phases of the improvement. These were asked by Mr. [osee, Mr. Vockrodt, Mr. Wyndearo, Mr. Carson and Mr. Bjork. All questions were answered thoroughly by Mr. Godat or one of the Commissioners as well as the City Engineer. Motion by ~yor Jarstad and Mr. Clark to have the LID formation ordinance read, carmied un- ~'imeusly. 0RDIN~2~CE NO. 3006 C~ read An ~znance providing for the improvement of: An area along Shore Drive and Marlow D~ive ail in accomdance with the plans, maps, and specifications on file in the office of the City Engineer; adopting said plans, maps and specifications; establishing an improvement district% provldin~ for the levying of assessments for the payment of such improvement and making such improvement payable by bonds.
