PROPONENTS Mr. Pete Ross spoke in favor of the rezone; stated he is the P~esident of the Cascade Evergreen, Inc that the tmaffic generatc~ of use by 85' lot is ins~gniflcant; that he believed the a~ea was doomed to go cu,~mrcial on Wheaton Way; that on "spot" zoning he believed the one residential dwellJ3%g is CITY COUNCIL M~'I'IN~ MI~trfES - JULY 18~ 1973, continued more spot zoning than a cc~nercial zone would be. Regarding plans, M~. Ross stated he had submitted on e for a clinic and one for a retail establishment; that it was har~ to do anything there until it is rezone but he would meet all B-3 requirements. In ans~er tO C~,~,~ssioner Clark, Mr. Ross stated he heard it was USO feet and the preper*t¥ undep discussion is one residential lot 85' and the school pronerScv. OPPONENTS ~ Wareham, 1111 Dibb, stated he has been opposed all along; cl~timed it would be spot zoning and school prosed, t? completely surrounds this a~ea; also, would not want to see the senior citizens who live there have to move; that these people would still be there but B-3 zone would m~ke them an island in a small a~ea. Also, stated the residents would like to know what is going to be in that zone; and spoke of the accident factor at the intersection. ~rs. Lo, on Jones, 1107 Dibb, objected to not knowing what is going in if rezoned; enough c~,,~Lemial places already in the a~ea; spoke of the hazard at crosswalk which is mainly for the school children and the ]nc~ease of traffic which a fish and chips place would bring; objected to increase of danger to lives and that B-3 without a plan was too wide open. Mrs. Br~4nhill, 1109 Dibb, opposed the rezone on the g~ounds of l-paffio problems and accidents, esoeciallv with childpen; spoke of lack of Sth lane for turning; reconmended no more businesses be allowed on the east side of Wheaton Way. Mrs. Wareham, 1111 Dibb, spoke of heavv traffic on ~Fneaton Way and ntm~rous accidents; didn't like the idea of school property sur~ooundin~, this p~opertv completely nor of M~s. Robinson's R-1 property being surrounded. Also, she didn't appreciate it that MP. Ross didn't show up for the Planning hearing. Mr. Field Rvan, ropresentin~ Bl~emerton School Disl~ict, stated the people involved are on sumner vacatxon but he had passed the notice of the rezone hea~ing to the principals of nearby schools; that the co~nents fr~m Fast High School w~re the leap of having a high tr~nffic generator in the a~ea that the rezone would be ver~ bad for the school both in the lunch program, operation of vehicles and the litter that would occm" back onto school grounds; that the concer~ from the elementar~ schoo: is the traffic problem concepned with school children and the use of the crosswalk and other crossin further u~ the street. C~nissioner Cl~rk dis~ssed the use of plot plans in strictly oo~aercial areas which he stated he did not feel were necessary where cc~er~ial was the reasonable use of the proper~cy; however, in this area where the area is largely public land ~%~m~rounded bv residential, Mr. Clark stated he be- lieved a ~lot plan is necessary. Motion bv C~issioner Clark and Mayor J~rstad that the City Council concur with the recommendations o-~ Planning Department and the action of the Plarming Commission in denying the rezone. Under discussion: Mayor Jarstad stated he was ~ll aware of this property and that it is bounded complete] by school oriented activities and should be reserved in its present state and in the future utilized more fittingly in the interests of public nature rather than for private development. Stated fur- ther that this area has been considered for a swimming pool site which would be school supported; also, that in the comprehensive plan its use is more of a rmblic nature, and did not thJmk to ~ut in a commercial zone in the middle of a public area would be in the best interest of the city. He stated he concurs.ed that it be denied. C~i~issioner Schone~n~n stated in answer to a remark made by Mr. ~oss concerninE this was good example of s~ot zoning because of the R-1 now there, that the area was ori~.~nallv R-1 until the school construction, and has remained so for many years. All property is not to be used for commercial and Mr. Ross is requesting that there be a double spot zone for ~-1 plus commercial. Mr. Sehone~n stated his contention that where the grc~rth of cc~mez~ial property from Sylvan south has reached the point where it presently is and, also, fr~m Hals Coroner to the north, that this should be t~ limitations of any future ~rowth into commercial area and should re~ain "as i~." Mr. Kenneth ~Jce, 1~17 Gregory Way, Rremerton, recommended school district should acquire that piece of ~r~und and re~ove it fr~m open m~rket. ~r. Pete Ross, stated public use would be ideal for the property but questioned whether they should sit and wa~t for schools or city to b~V the property when there is a $50,000.00 investment there. ~4avor Jarstad discussed the value of the land if it is rezoned and that from the city and c~,',anity viewpoint it is good ~operty for development and to be used for the people of the area; that it would be difficult to ~et a favorable decision from Planning Commission or City Council and that nothing, was removed from the land's value or his investment as it is the same as when purchased; that if bought on speculation it was their gamble that they are going, to get it rezoned in order to ~et the c~,,ereial value. Mayor Jarstad also spoke of the need to reduce accidents on Wheaton Way and the use should remain as it is for that ~eason and should re~in as it is for public interest. DJscussion was held between the mayor and Mr. Ross of the value as a residence as opposed to ec~er- cial, !Mrs. Brownhill suggested Mr. Ross build houses on the prc~rtv which ~uld easily rent. Mr. Wareham asked about posslbilitv of getting a traffic light at Dibb and Wheaton. This was dis- . cussed relative to need for control, the need for 5th lane. C~missioner Schoneman talked in more i detail of the problems confmontLng traffic and the lack of property for widening the stmeet; also, the cost of ac~ulsltion of sufficient property to do so. Mr. Schone~nan agreed this must be looked at and taken care, that is the actlvatin~ of a traffic signal at that location. Motion carried unanimously. CITY COUNCIL Msn'I'ING MI~PES - JULY 18, 1973~ continued ANNEXATION - AMERICAN MARI~[E BANK Clerk stated he had posted as required bv law; in addition, he published a notice in the Bremerton Sun new~oaper~ then read memo. dated June 29, 1973, addressed to ~he City. Attorney and Ci%7 Clerk from George Plescher, City Planner, which rec~',,.ended that the property being considered for annex- ation be brought into the City with the Bremerton zoning classification most nearly comparable to that Kitsap County zoning it bore prior to classification.
