Clerk read letter dated May 25, 1973, from City Clerk to Robert I. Deutscher, advising that it was not Oossible to advance the bearing date because the Mayor would not be available for the bearing. Assistant Chief of Police R. Wes Henry exolained that Chief Schlie is on vacation and that subject matter has been discussed at length with the Chief and Captain of Detectives Jack Kvistad, and that they concurred that the issuance of the license for these machines would create a serious Droblem in Bremerton as it has in Seattle and would not be in the interest of public peace, health, and CITY COUNCIL M~L'I'iNG MINUTES - JUNE, 13, 1973, continued safety. City Attonney Walgren asked Mr. Henry to outline soma of the anticipated problems. Assistant Chief Henry cited problems with homosexuality, proble~m with undema~e and yotmger people resultin~ in arrests, require additional police man-power and the Police Department has more important things to do. Assistant Chief Henry stated that changing the location would not alleviate the anticipated problems. Assistant Chief Henry stated that this type of business (pornography) is undesirable in the City of Bremsrton. City Attorney Walgren asked if the Police Department has any complaints registered in connection with the subject business. Assistant Chief Henry stated they had received complaints, and the main objection was to the type of movies being shown in these machines. Captain Kvistad explained that the rooms in which the movies are shown are dark and would cause problems with homosexuals in the dark areas which is one of Seattle's problems at present. Captain Kvistad stated that the Callow Avenue businessmen object to this pornography shop which has no value to the City of Bremerton. Captain Kvistad stated he recently received a oonlDlaint from Kitsap Radio throu?h the City Clerk's Office.. Captain Kvistad stated that an a~.~=st has alreadv been made at subject location for operating these machines without a proper license. At this time, the Captain provided the Council with magazines which had been purchased at the West Bremerton Smoke Shop. Captain Kvlstad stated that the machines also show pornographic sexual activity between men and woman and so forth. Pobert I. Deutscher, representing F~r and Doreen Hovermale, stated he could see no way that the operation of an ~sement machine could affect the public peace, health, and safety of the Citv. Mr. Deutscher stated that the City Council Mst recognize the right for an adult to read and view what he wishes; however, this is not.the issue before the Couneii. Mm. Deutscher explained that City of Bremerton has no laws governing puz.~ography and could not use their objection to pornography as a basis for denial of an amusemant machine license; that if the City wishes to govern pornography they would have to adopt the necessary laws by ordinance and could not outlaw "pornography" through the licensin~ ordinance. Mr. Deutscher stated that his clients would comply with any proper porn- ography ordinance adopted by the City. Mr. Deutscher stated that if the operation of a movie machine is damaging to the peace, health, and safety of the co~unity, there would be no movie thea- tmes in Bremerton. Mr. Deutscher stated that after a citation was issued to West Bremerton Smoke Shop for operating machines without a license, the operation was discontinued. Commissioner Clark asked Mr. Deutscher if he could prove that the licensing of the ~a/sic machines would be in the best interest of the City. Mr. Deutscher stated that they don't have an affirmative duty to prove that it is in the best interest of the public peace, health and safety; however, he did not believe the operation of a movie machine was detrimental to the public peace, health, and safety. Comaissioner Clark asked if the movies show the san~ type of thing as the magazines present. ed; Mr. Deutscher stated they were of similar nature. City Clerk pointed out that this type of material (pornography) does have an effect on a person's mental health. Mayor Jarstad stated that the Council is concerned with mmmal values and that the selling of Dom- ' ographic magazines and the operation of pornographic movie machines certainlV has no moral vaiue to the City of Breme~ton, and would affect the public peace, health, and safety of the City. Mr. Deutscher stated that it was the Council's responsibility under the licensing ordinance to evaluate this mattem under that ordinance on the basis that the ~peration of the machine (not what type of movies are being shcx~n) is not in the best interest of the ~ peace, health, and safety of the City. Con~uissioner Schonem~n stated he is very disturbed by the material he has viewed todaV (magazines) and that just one pictur~ is very convincing that this is damaging to the City of Bremel-ton. Stated that on the same basis a Library Board would not allow this material in a library, as an elected official he would not allow it in the City of Bremarton. Elmer }{overmale, Owner of West Bmemerton Smoke Shop, stated he did not feel his shop affected the public peace, health, and safety of the City of Bremel~ton; that he has two similar type stores in Tacoma and one in Pasco and has been in this business over four years and has never had a customer who has caused a problem or been ~.z=sted at his stores. Mr. Hovermale stated that he was in this business for a profit which is the same reason most persons are in business. Cliff Schultz, Owner of The Bootery (next door to subject shop), stated that he is opposed to this type of business in the ~allow Avenue Business District; that he is losing customers and this bus- iness has upset the Avenue. Beverly Musser, interested citizen, voiced her objection to this ~ of establishment in Bremerton d. req.ueste.d th~.t t. he City Council draw up a proper ordinance to protect the continuity from oper~ .ion .or sucn a business;_ also~ stated she would llke to see Mr. Hovermale in a pi~ofitable bus~ness,/i u~ no~ at the expense of others. Mrs. Mussem also co~nented that this literature is already available to anyone who wants it in "skidrow" in Seattle. Co,~missione~ Clark stated that the Polioe Depaz'.b~ent disapproved subject application as it was not in the best interest of public peace, health, and safety; therefore, unless it could be proven it was in the interest of public peace, health, or safety, he would not be a party to upsetting the decision of the Police Chief. Motion by Cu~,,~ssloner Clark and Co~ssioner Schoneman to concur with the findings of the Police ~5~paz.t,,ent with reference to subject application. Edwamd Stone, 332 North Callow, (businessman) voiced his objections to the subject "shop'; that it CITY COUNCIL MEETING MINUTES - JUNE 13, 1973, continued is hul~tinK the Callow Avenue Business District.
