Dear Don:
I hope by now that we have completed the amended building permit applications to
remove the steel decks and all new illumination on our Bremerton displays. Rodney
Vietz was to reapply for the amended permits to reinstall wood decks/catwalks where
these are necessary for our billposters/contractors to perform their work.
You have assured me that approval of these amended permit applications will be
expedited so that we can get all of our displays back into service as quickly as
possible.
Further, we agreed that any other building permits will be required only if we intend
to change the structural sub-strata materials used for the display faces, and that you
are not attempting to control copy, content or the manner or materials on which our
commercial/non-commercial advertising message is delivered. We also agreed to
revisit the illumination issue on a case by case basis, prospectively allowing the use of
the halothane lamps where there was illumination on a display previously, we may be
able to go to this more environmentally efficient system. \
I said I would investigate the displays sited on the R-zoned properties and I have done
this. The two displays at 2319 Sixth Street are clearly in a commercially-used stretch
of Sixth Street.
The property on both sides are large retail/grocery outlets on the downhill side and
Bruce's auto lot/auto rental on the other. The lot is too narrow for residential use and
the highest and best use is probably our outdoor advertising display.
The same is true for the displays at the end of Sixth. This is an island property
which never could be used for residential purposes. The photos show the narrow
configuration of the lots, and the road up the hill behind our displays separate this site
from the homes on top of the hill, which are also screened by trees and vegetation.

Dear Don:
This will acknowledge receipt of your memorandum of May 19, and set forth our
understanding relative to the approval and issuance of our building permits for all
displays sited in commercially zoned areas of the city (GB and BC zones), providing
we remove the five (5) displays we own on property zoned SF-3/Single-family
residential and MF/Multi-family residential.
Per our conversation yesterday, 3M Media will agree to the removal of these five
displays as quickly as we can dispatch our crew and contractor to perform the take-
down work. The city will issue the applied-for permits and lift the stop work orders
(red tags) so that these same workers can remove the steel decks and illumination
while still in Bremerton, thus getting these displays back into billing in the shortest
possible time.
As I informed you, these five displays we are removing have long term leases
extending 20 years (end), and a Fair Market Value in excess of $180,000. We
believe it is only fair and reasonable for the city to work with us to replace/relocate
these displays. You have indicated a willingness to support our efforts to seek an
ordinance text amendment which would provide 3M the opportunity to seek relocation
sites in GB, heavy commercial, manufacturing or industrial zones. We would not be
increasing the number of displays in the city. The Relocation Act is designed to
provide a means to remove non-conforming uses to other conforming, non-sensitive
areas of the city.
Thanks again for your willingness to find a reasonable resolution to this matter.

Subject: Your letter 5/16/94 -- Nonconforming billboards
The zoning code does not give me the authority to consider signs on a unit by unit basis. I
would consider the citywide management of 3M's legal nonconforming signs on the basis of the
land-use zone inwhich they are located.
I believe the City can legally deny building permits to allow you to reconstruct signs which
were substantially demolished in 14 locations. However, if 3M removes all nonconforming signs
on residentially zoned ("Single-family Residential [SF-3]" and "Multiple-family [MF]")sites: 615
N. Cambrian (three signs), 2811 Kitsap Way (one sign), and 1800 Wheaton Way (one sign
remaining), I will forgo taking action to terminate 3M's remaining signs on the grounds of their
status as legal nonconforming structures. Signs in commercially zoned areas ("General Business
[GB]" and "Business Core [BC]") eQuId be repaired and maintained per your applications (no new
lights systems, wood catwalks and guardrails, and structural wind-load reinforcing). The initial
action of removal of signs in residential zones ~ould have to occur prior to issuance of building
. permits. The two displays referred to in your letter located at 2319 6th Street are commercially
zoned and could remain.
The Building Department has not received application materials sufficient for review in

regards to the wood catwalk replacements.

Building Pennit Applicatians by 3M far 14 billbaard "retrofits" thraughaut
the City.
After an inventary inspectian af the billbaard structures, the Building Official and I faund that the
prapased retrofit changes shawn an the actual plans do. nat match the descriptians an the pennit
applicatians. Only two. (2) afthe faurteen (14) applicatians, thase lacated at 2702 Farragut and
411 S. Cambrian, were nat upgraded with new materials 'priar to. building pennit applicatian.
The 14 pennits, as currently propased, cannat be approved. Each applicatian propases additians
that do. nat camply with the fallawing sectians af the Zaning Ordinance:
"Structural alterations that would prolong the life of a nonconforming sign are
prohibited" [see BMC 21.02.230 (P-3)]

"Repair and Maintenance: Repair and maintenance work on a nonconforming structure
may be carried out for the improvement and restoration of safe and sanitary conditions,
but shall not:
''Extend the normal life expectancy of the [nonconforming} structure through the

The applicatians prapase lighting, which is nat shawn an the plans and
wauld be inspected by the State Department afLabar & Industries. Our
inspectian faund that anly the billbaard at 2702 Farragut had any existing
lighting remaining, which was anly a small nean tube light. All athers
which have had lighting installed withaut pennits emplay same type af
large halagen bulbs. This type af lighting was definitely nat available at the
time these structures became nancanfarming, and shauld nat be allawed
