10: 00 - ~3BLIC RECOGNITION
.Steve Talkington, 9008 Valley Oak Drive, questioned the validity of the City's form on their Out-
side Utility ALl, cement; that he felt this A~-eement~was unconstitutional because signing the Agree-
~nt would require a person to sign any annexation petitions in the future; also, noted that this
would also be a requirement of any future owners of the property. Discussion followed and Mayor
Jarstad explained that there were problems in the past where persons already obtaining City service
would not annex to the City in order to allow service to be made to those persons who needed it;
that anyone receiving the city services should be willing to annex to the City if this would bene-
fit the majority of people in the area. Co~missioner Sehor~man stated that this should be an
obligation if City Services are being provided. Commissioner Stewart stated he agreed with
~. Talkington; that the AL~reement is poor City policy and he doubted if a Court would consider it
legal. Mr. Walgren stated that the criticisms of the Agreement may be legitimate, and it should he
reviewed.

the document is legal. ~btion seconded by Commissioner Sehoneman. Mayor Jarstad stated he would
not vote for this motion because it ~efers to determination of legality which could only be deter-
~mined through court ease. Commissioner Schoneman withdrew his second to the motion, and made the
followinK motion.
~btion by Commissioner Schoneman and ~yom Jarstad that consideration be given to Mr. Talkington's
request; that an explanation should be included in the Agr~eement explaining the requirement related
to annexation which would be a suppl~J~ent to the existing ,a~eement; also, to provide that some
responsibility be put on the developer or owner to require him to advise anyone intemested in
buying his property of the Outside Utility Agreement which would still be binding. Motion carried

stated he felt the application is proper; however, didn't concur with Planning Commission reco~en-
dation relating to the City receiving compensation for the alley; that this alley was dedicated to
the City, and the proposed use will help control traffic problem on Sixth Street and Pacific Avenue.
Commissioner Schoneman stated this alley should be reverted back to the plat at no charge.

that this will be an improvement.
Mr. Gerber, [~nager of National Bank of Co~%eroe, stated the City should return the alley back to
the plat with no fee; that alleys have not bean paid for in the past, and they would be paying for
something given to the City.

Walgren, to the State Board of Health questioning the need of covering City of B~emerton reservoirs
and giving, reasons therefore. The (b~missioners stated they appreciate efforts of the State
Representatives and Senator Walgren on this matter.
2. Read letter from A1 Herrmann, ~astewater Supervisor, outlining existing problem with septic
tank material being dumped in the sewage t~eatment plants. Commissionem Sehoneman stated that the
amDunt of septic tank raaterial being dumped is too excessive, and it is neeessar~y to discontinue
any dumpage unless it comes from within the City lJ3nits of Bremerton. Mr. Schoneman stated that
anyone dumping septic m~terial which comes from City limits will have to present some type of
affidavit saying that the material is f~om within the City; that per, tits will be gmanted by the

CITY COUNCIL MINUTES, OONTIN/IED, April 10, 1974
REPORTS - CO~ISSIONER SCHONEMAN C0~I~[gED
3. Dangerous building structure at 1116 Park Avenue has been condemned, and owner has not appealed.
Will be setting date for removal which will be done by bid call.
Motion by Commissioner Schoneman and Mayor Jarstad to direct City Attorney to give proper notice
to the property owner, earmied unanimously.
4. Reported on Sewer Facilities Complex meeting the Con~issioners attended, and read his state-
ment to the Council explaining that the Depa~.t~nt of Ecology is requesting the City of Bremerton
to join with the south end of the County in what would be a two-year study to determir~ where
wastewater treatment facilities should be located; however, if it is found that this location should
be in the ~imnchester area, this could impose a heavier tax burden on Bmemerton sewer users. Stated
he also questioned what would happen to the indebtedness the City has already assumed in up-dating
its present facilities if the Bremerton plants are to be discontinued. Stated he felt the South
end of the County, including Port Orchard, should join in a sewers facility study which v~uld
include, if necessary, the area lying between Port Orchard and Bucklin Hill Road. Stated that the
threat of no future sewer grants if the City does not join in the study is very unfair.
~mmissioner Stewart concurTed with Conm%issioner Sohoneman, and eon~nented that if the City went
along with this proposal, the City could end up subsidizing sewer districts all the way out to honK
Lake area; also, stated the City hasjust completed a $70,000 study, and he doesn't agree we need to
join in another ~00,000 study. Stated as far as Bremer~on residentes are concerned, the City
would be better off without this study. Stated that it was brought out that Bremerton would have
the same. voting rights as Manchester, which is not fair to the City of Br~merton on a population
basis.
~kyor Jarstad stated regional planning is necessary so there is no duplication of services; that ,
this is a requirement of the Federal Government who is putting up 90 percent funding. Mayor
stated he could see this reasoning which would save the Taxpayers dollars; however, the problem is
that B~emerton already has done its '~omework", and has given pollution control measures to 90
percent of City residents. .Stated the City read a computer-proposal that the City take charge of
all planning for sewering from the Head of the Bay and North to Silverda~ e and then another pro-
posal was presented at the meeting which would provide[i that a governing Boamd be established to
oversee the Administration Grant Application; that this would be a weighted vote that would be
determined by population of the planning amea. This proposal was not accepted by the County
Commissioners.
5. Conmissioner Sehoneman read letter he received from Washington State Department Fisheries
regar~ling.~ their salmon-rearing program at Cmrst Creek statinK their spring program cannot be con-
tinued due to Department of H~alth regulations; that they do not wish to bumden Domsea nor place
the State in a position that would appear to give that company preferential treatment; also,
stated they would like to consider use of the main channel as a rearing area for holding yearling
coho beyond their normal migration time; that this would increase the local sDo~t catch of coho,
and would be below the City water supply facility and should not be contrary to health rules and
regulations. Stated that some conments in F~lling Simonson's Coltmm (Bremerton Sun) were not
correct relatinK to the fish-rearing activities. Discussion followed and Commissioner Schoneman
stated that it would be up to Domsea Farms and the State Depa~.b~ent of Fisheries if they wanted to
arrange for the state to use Domsea Facilities. ~yor Jarstad stated that he hated to see the
State Fish-rearing program eliminated, and felt a meeting should be held with all the parties
involved.
,~btion by ~ayor Jarstad and C~,,~ssioner Stewart that the City set up a meeting within a week,
· n~ing the Washington Dep~.t,~mnt of Fisheries, Domsea Farms, and the Commissioners, in order to
discuss the State fish-rearing program; carried unanimously.

2. Pmesented Police Report for the month of Mareh,.~B74:, ~hich is onTfile in City Clerk~, Office.
3. Stated a letter should be sent to the legislative Leaders in Olympia so they ape aware that
any surplus money they project coming to the State in the fiscal year be utilized to fulfill their
obligation to the State Pension System, of which the City employees are members. Stated the State
Ires had talk about tax rebates with surplus funds; however, they are required to put money into
the pension funds and this should be done with any so called "surplus" funds. Stated the term
"surplus" funds is very misleading to the people; that the State is in debt to the Pension Systems,
and any fund should be included in the Pension Systems for proper investment. Con~nissioner
Stewart stated he did not agree with management of the State, and there could be surplus funds
with proper management and elimination of unnecessary programs.
~. Stewart stated that if the State claims there are surplus funds, they should be included in
the Pension Systems; however, he did not agree with State Management.
b~)tion by ~yor Jarstad and Commissioner Schoneman that a letter be phrased and reviewed by the
~,~ssioners to the effect that any talk of surplus funds in the State of Washington is not
correct, and these funds should be included in the Pension System and invested accomdingly.
