Shaub Ellison did and that Shaub Ellis%on was low bidder for the Fi~e Depa~.h~ent Times. Clerk
explained that after careful comparison of the bids, it was decided that Shaub Ellison was the
lowest and best bid.
Bill Ckmmins, Owner of Kitsap Ti~e Service, stated that the bid they subnitted did meet City
specifications; that they bid on radial ti~es which is superior to the description specified.
City Clerk explained that the Kitsap Tire Service Bid did not bid on scme ti~es which the City
will have to purchase without a contract at a higher cost. M~. Cummins stated that the City
s~ecifications are actually impossible to meet on the Fi~e Depa~.b.ent truck ti~e and that he
did not believe Shaub Ellison Ccmpany could furnish this time as specified, theme being no such
tire available. City Clerk stated that specifications were made according to the Federal Qualified
Products List and the 1973 Tread Disign Gui~e.

uote in the ~v~,,e~ton SUN relating to the Memomial Swimming Pool; that he did not agree with Mm.
Stewart that the Swimming Pool was a mistake and that the Statement concerning the Lions Club wish~n~
to make this a covered pool is not a fact; also, stated the pool was built through Lions Club
efforts and donations and the City has only provided maintenance costs. Mm. Stewar~ stated that
he felt it would be wiser to build an adequate size pool which could be used throughout the year
bV schools and other agencies and actually bring me. venue into the City. Eddie Adams stated that this
~ol was better than no pool at all and bas been enjoyed by m~y ~ngs~er~. Mayor Jarstad

this claim in the amount of $4~8 is requesting City reimbursement for M~. Robinson's expenses of
clearlnE a sewer lateral at 1527 Sixth Stmeet in effoi~ts to clear a blocked sewer line which later
was fotmd to be in the City street. Cu~,missioner Schoneman explained that when sewer back,up
occurs, it has been City procedure to ask~ the property owner to check his line first to avoid
i digging up the street unnecessarily and if the problem is eventually found to be within the City
;portion, the proDertv owner is then reimbursed for his expenses.
City Clerk read letter from the Assistant City Attorney (Sexton) dated November 28, 1973,
stating that he has discussed this matter with Dr. Campbell and is of the opinion that the claim
as presented must be rejected; however, the City could reasonably consider payment for the
I estimated cost for di~glng a line down to the lateral at the street's edge which would
i represent a lower cost than that claimed for excavation and line replacement frc~ the houme to
the sidewalk.
Cu,:,iss[oner Schoneman stated that he did not agree with this opinion; also, spoke of the many
complications involved with blocked sewer lines. Water Superintendent Weller spoke of sc~e of
the problems involved and stated that the De~.~u~tent has to go by chance because there is no way
of knowing where the line is blocked; also, explained that he asked Mm. Robinson to check his
p~opertv line first as chances leaned toward the problem being on his property; however, it was
fotmd to be within the City street.
M~. robinson stated that he felt his Claim is justified as the problem was found to be in the City
street and he should not be responsible for digging up his line as requested by the Water Depamb.ent.l;
Mayor Jarstad stated that he is not doubting justification of the claim; however, he is concerned
with the question regarding l&gality of this type of payment, Co~,~tissioner Clark concurmed and
stated a meeting should be held with ;%ssistant City Attorney Sexton to study all the facts and
!to determine leKalltV of the payment.
