Mavor Jarstad read Exhibit "A" which is a s~ of what C~or~e Pleseher has written into the contract. Then the mayor read "General Description of the Final Project". Ray Soule was then called upon to speak. He spoke of the background leading to the point of a comprehensive planning program; that the Central Business District representatives were conscious of needs of the City beyond the C.B.D.; that he om~nended C~orge Plescher for putting this doctment together and if all eleven points are done it will be a cc~nplete product; also, that each part of the plan should be able to stand on its own feet and yet be_ a part Of the total; further, that the business cu,u~Lunity supports the plan. Cb.missioner Stewart reeonmended that on rake 5 concerning conducting Dublic meetings that sub- paragraph "e" be added so that the Central Business District is treated the same as "neighbor- hoods". Mr. Plescher stated ne problem in adding this and that the neighborhood plan is for the total cc~rmunity and everybody is to be brought into the total picture to reach the total goal[ Co.missioner Stewart reoo~ended that a developer be brought in to get an over-view since when it comes to putting this progr~n together it will be the developer who will be responsible to sell all leases, etc. He stated a developer had ccme up fr~mn California who had claimed he hadn't seen a successful development without a developer being grought in; that the developer wouldn't be paid unless the plan was instituted. Mavor Japstad spoke concerning the contraet and stated the work should Ket ~oing and if something else is put in that a different type of contract will have to be developed. Mayor Jarstad noted that the planning grant money is a small amount considering what others have received; but it is a recognition of the impact of Trident; that Lar~ Smith is being asked to do a lot of things and he says he can do these things. Further discussion of the contract ensued. In answer to a question by Cc~missioner Schone/nan eonceminK the type~ of report that will be obtained, George Plescher stated rather than have vol~nes of transcripts that will lather dust, there will be audio-visual packages as the main presentation. He will be working with the University of W~shington who will be using a vide~ tape cemepa, takinK pictures throughout the eclmmunity. He stated further that the na-r~ative report ~n 't ~m the main body that the city will be adopting; that the main criteria as to success of the proKr~m will be how much is accepted during, the prograph; that the implamentation starts immediatelv. This is the beKinninK of the implementation; that more studies a~e not needed. Motion by Mavor Jarstad and Cu,,,,~ssioner Stewart to accept this in its present fora and authorize t-~ty to sign on behalf of its contracting ability and fo~ard to La~z,y Smith. Received a request from Kitsap County Council on Aging to be able to r~n free bus advertising and that he would oppose this request unless it was on space available basis. Mayor Jarstad stated that if the request is dealing with alerting people to programs of a goverrcnental nature that he didn't have objection; that the city is supporting this agency and in getting information out to the public he didn't see anything wrong with the request. Ccmmlssioner Stewart stated since no one is opposed he will go ahead with the request. 3. The Navy Exchange has requested use of the Craven Center Parking Lot for the Navy Enlisted Club on December 31, 1975 from 6:00 p.m. to 3:00 a.m., January 1, 1976, for $25.00 fee end they will provide proper signing at the lot end decals for their cars. Stated he had checked with research bureau and read the R.C.W. end this could be done on a short tern basis as long as the general public was not prohibited from parking there, also. Stated the Navy exchange has asked for seven-day Der week parkinK dur_in~ night hours but this would have to be looked further and may have to get superior oourt order to do so. Recu~,~,ended allow for New Year's Eve only, at this time. Motion by Co~missioner Schoneman and Cu,,,Jssioner Stewart to allow parking for New Year's Eve as requested. Under discussion: Mayor Jarstad suggested working closely with the Navy Exchange on the parking because, if the city had not made a oor~nilm~nt to pamking, the Navy would have retained a parking area for themselves. Motion carried unanimously. Co~nissloner Schoneman' s reports" 1. Met yesterday with representative of Kr~mer, Chin g Mayo concerning the proposed Jackson Park Reservoir. They presented a pre-design report end a graphic illustration showing rec(~',u,mndation of an outdoor theater with 300 seating capacity on the top of the reservoir. Stated othem uses had been considered, including tennis courts, end the No. 1 alternative is for a forest theater facility. Mr. Schoneman stated the presentation was made so the City Council may accept ~his pre- design report so they can get into plans and specifications and to give us an opportunity to negotiate with the Navy for rheim needs in the storage of water; also, funding assistance from Depardment of Social end Health Services end B.O.R. Motion by (t~rccissioner Schoneman end Conmtissioner Stewart to accept the pre-design report and reo~'u,,endation. Under discussion: Cu,,,{ssioner Schoneman showed an illustration indicating. seatinE, parking end entrance fr~m Lakebarst D~ive for a small ~nount of parking. Seating arrange- ment would be. on all sides. Motion carmied unanimously. Under further discussion: Conmissioner Stewart asked who would use the facility end what would be the cost of maintenance vs tennis courts, etc. Mayor Jarstad explained the major concern of the plan is to have something that B.O~R. will accept; the land was given to the city for open space primarily and not for a great deal of activity. 2. Stated negotiations with North Perry Water District ape continuing and hopeful to complete in a few weeks. Attorney McCluskey for the city~ and Bill Garlend~ for the district, are working together toward solution. New figures are involved because of new services Nor%h Perry has acquired. ~nen completed, the arrangement will be better for both parCcies. 3. Met with Entranco Engineering firm regarding the intersection at Sylvan end Wheaton Way; have now az~ived at a proposal and they will prepare plans end specifications; also, lend must be acquired for widenings. Mr. Schoneman showed illustration of the plan showing the full turn novements on all affected streets, which will allow five lanes end perhaps a sixth could be placed. He stated he will eventually promote a fifth lane to Riddell Road end would like to go down to the bridge. 4. Relative to the water superintendent's position, no one else has applied besides the man now employed on temporary and exsmination will be given to him this ccming Friday. 5. Relating to the budget, did not pass a budget last week as reeu~,nended by the Mayor because there were additional considerations to be taken prior to this; still have another Council meeting this year. Concerning the 11% salary and wage increase, in last year's budget the City Council saw fit to pass a resolution putting a maximum at $20,000.00 per year; with the fire and police to rote]ye 11% increase it would be appear that the resolution should be ~nended to $22,000.00. This could be considered by the City Council and could be a part of the adoption of the 1976 kudget. }L~ve no conclusions concerning the non-uniform personnel as to what their increase will be, but certainly feel that they should be consistent with any incmeases gl~anted to the uniform personnel of the city. One other area of concern has been the city attorney's budget; he compared to the legislative body's budget; stated in discussing with others outside the City Hall an appropriate ~nount would be at ~60,000.00 plus the D.W.I. fund of $9,5~0.00 and this was Mr. Schoneman's recc, mendation. 6. Wished everyone Me~zy Christmas and Happy Holiday tc,~rmow; stated carillon bells w~ll ring out today, this evening~ and tomorrow. City Clerk: Reported Bad letter from United Way thanking everyone for support in the drive; end stating the goal of Public E~ployees Division went over $13,200.00 and the city employees had a slight increase in giving over the previous year. ' COUNCIL MINUTES - DECDMBER 24, 1975 - CONTINUED Mayor Jarstad Repqrt: 1. Read letter eoncemnin~ neKotlations which have bean going on with the Navy concernin~ the city pm0vidinK fire services in goveL.~ant housin~ units. Stated that an analysis of needs has been made based on units and population. Possibility of relocating two stations, the west and east side. ~4ould use some federal money and maybe could complete the program late 1976. 2. The Municipal Cbur~c has asked for a change in their budget c~neerning public defender fees because theV did not know at the time there was going to be an anticipated increase in the public defender fees. Police Department is busy; filed in first ten months of the year one thousand mome eases than previous year; goin~ to take more help; have an increase Ln the need for attorney's services in the police court. Running many times three ~nieip~l court days a week and using the Council Chambers as well as the court room. This requires t~o attorneys to be pDesent and there is no way can get out of cases in the public safety field. A man is entitled to publle defender and the court office has asked for a line item imposed mandatorialy by state law. Motion bv Mayor Jarstad and Co~missioner Schonaman that the change be incorporated into the pre- 1-~ary budget, as mandatory under state law, Account No. 512-10-31, Professional Services, frcm $6,600.00 to $13,600.00. Under discussion: Mayor Jarstad stated this was rec~,endation of C~Dod- pasture, Treasurer, also. Cu~,,~issioner Stewart stated it was his understanding that these public defenders can raise their fees at their will. Mr. Walgren stated he was not familiar with the public defenders office. Co~missioner Stewart stated it cost more sometimes to defend than the penalty. City Attorney Walgren stated that consideration should be given to the budget increase due to the increase of court filings and the possibility of loss of liberty, which require public defender, and criminal cases and appeal cases. Co~ssioner Stewart recc~nlended some consideration be. given to eliminating a jail term. Motion carried as follows: Mayor Jarstad, yes; (bmmissioner Stewart, no; Cc,missioner Schoneman, yes. BUDGET ~ bv Co,~nissioner Stewart and Commissioner Schoneman in concurrence with the suggestions made by Commissioner Schone3mmn and approve the final budget for the year and reduce City Attorney's Office to $60,000 plus the D.W.I. Grant. Under discussion: Conmissioner Stewart stated if there is overspending on the budget, the department will have to ccme hack to the City Council. Mayor Jarstad stated he will not vote for the budget and that he, as safety cu~,~issioner, was put i~ a difficult position; that when arrests are made there must be proper support and oonvictlons in our courts; that he had never been spoken to that the attorney b3s n~t given good representation in court; that the c~m',issioners are taking a mandatory fi~ure and don't know what amount is being spent; that the public defender was increased and the council wants strong enforcement in the city, so he would speak out strongly a~ainst cutting the budget in this manner and vote "no". Commissioner Schoneman stated he had called the mayor's office to discuss the budget and was infoz~ned that he would not be available at 2:00 P.M., but would possibily at 3:00; that he had stood by and then secretarv stated he would be available; however, there was no availability and no discussion. Mayor Jarstad stated his diary did not show any meetings and that he worked on the 701 ~rant proposal until ~ :00 P.M. C~,,~gssioners Schoneman and Stewart did not a~ree that the budget had been before, them for two months and the Mayor did not know what contribution the other C~,,,issioners had put into it. Mayor Jarstad stated they did not have to adopt this budget today; that he had told the other co~missioners he would get a monthly figure on the attorneys' hours; that Dr. Campbell stated the City had a good department; if the city is overcharged, this could be adjusted. Ccmmlssioner Schoneman stated that the budget includes increases for certain personnel and, although, they b~ve o~ne to an agreement in adopting the budget, it does not include salary and wages for non-uniform people and these will have to be consistent with the increase given to the uniform personnel. Mayor Jarstad stated the cu~,~ssioners can't settle what is being negotiated that the city has hired a labor consultant who must be given the frsedcm to negotiate and the city must follow the law. City Clerk ccmmenting on the fact that C~m,~ssioner Schoneman had mentioned the City Attorney's budget would be at the level of 1973, and other budgets had been adjusted to meet p~esent conditions, stated that budgets should be approved realistically otherwise theme would be difficulty later in the year and question whether can cut back and still maintain services. Ccmmissioner Schoneman stated the city can get attorneys with adequate service for $60,000.00. Mayor Jarstad asked Con~ssioner Schoneman if he bad bean contracting and he stated this had been discussed but no contractin~. Mayor Jarstad asked if the eu,~,~ssioners were willing to go to a high level panel to look at city attornev's services. ~btion by Comm/ssioner Stewart to get a ~rformanee audit. City Clerk stated there was a motion already on the floor. Cc~raissioner Stewart re~d fr~m the city charter concernir~ approving assistants to the city attorney and that he had not approved any since he was been here. City Attomnev stated these have been approved in the budget.
