Computer has been down since last Friday with mechanical problems. Long hours have been put in by repair people plus all night shift by Doug Fisher and just repor~ced to him by Mr. Bums that trouble has been located and par~ will be replaced. He stated fault was with his ar~a and probably didn't star~c soon enough on the water bills. No one will kava to pay delinquent char~es and the ~vstem will t~ better in the long~ mn. BSO statements went out on the computer and there will be a bis savJn~,s to the city in the use of the computer. Ccr~nissioner Schoneman expressed concern about lack of billing and fact the income will be behind and may upset some on fixed inccmes who will find it difficult to catch up. Also, questioned why the old machines were not used until the ccmm~ter was reedY. ~r. Schoneman stated he had asked ~. Bums if he could have done it that way and he agreed it could have been accemplished that way. Pu~ther discussion was held about the delay. O~,,,issioner Schoneman: 1. Water Distribution has low~red water main on Hollis east of ~aple due to reg~ade on the street. Construction of the street will be done by the cent~actor building new houses there. 2. Repo~ted on complaints made at last Council meeting relating to a~ea ~ontemplated for rezone ~ stating that ~r. Weller had contracted most of the residences in this area and made a repor~ to him. (DUNCIL MI~[II~S - JULY 2, 1975 - COWFINUED Mrs. herin had not ~epor~ed a probl~n in 15 yea~s. Will install a 2" main to serve six houses on Wycoff. Pressure tests on the closed circuit served by a pump, app~c~imately 55 being served, showed at least 60 lbs. P.S.I. and the p~essure can lower. 3. Street Dept. presently checking on intersections where high grow-th is obscuring vision. Pro- perry owners a~e being asked to trim back and the Street Dept. is cutting in scme cases. 4. Building permits: 36 in last few days for $22?,49?.00. 5. Su?gested in redevelopment si~]dies, thought should be given to C~aven Center site which is close to the navy yar~ and downtown and the navy yard has ex~essed need for such a facility for motel/hotel accc~ndations; that the other t~o proposed facilities have not materialized. Mayor Jarstad: 1. Will be attending a meeting ?:30 p.m. at Seattle Center for a briefing by the goven~'~ental conference on the new Federal Health Law, dealing with the State of Washington Health Planning. County CoJ,~.issioner Mahan will be attending along with a delegation flu,L the city-county health bear~. 2. Results of examination for fire chief: Max Meigs and Bill Meigs, have been appointed chief and assistant and is second brother combination in the State of Washington. First combination was in Bellinghan. Sure these t~ will be doing an excellant job; transition is going very s~oothlv. 3. Spoke with county cor~nissioners and they are goina to withdraw their application where they were the sponsoring body for surplus property out neap auto center. City has applied, also, for playground and Dark and beautification. C~unty did not know the. aDplicant they were going to sponsor had already -een before the city and had been denied because the higbest use would be for the general public in the Citv of Bpemerton. Very pleased the county ccrmnissioners took this attitude; that GSA had said they were going to withhold their decision until the matter was settled on the local level. 4. Was well pleased that the mccall movement against Mayor Uhlman failed. About 100% of the mayors at the AWC convention had sent letters in favor of the ideology of sustaining the mayor in making deeislons in local government. Pope the senator, C~rdon Walglmn, will assist in obtaining a law to that this doesn't happen again in such situations where the recall is based on unfounded circumstances. WESTPARK HOUSING RE(~UF~-'T Attorney Walgren briefed the proposed agreement presented earlier in this meeting by Bea Wegsteen and recu'm,~_nded deletion of papa~aph four re: removal of substandard housing, if this imposes obligations the city does not wish to undertake at this time. Motion by Cu,,,~issioner Schoneman and Mayor Jarstad to enter into the c~operative a~ement and el-~ate section 4 as reoa,,,ended by the city attorney and authorize ,~he mayor and city clerk to sign, carried unanimously. JENSEN REZONE - DECISION Mayor Jarstad asked for further testimony if anyone wished to speak, prior to ~ebde~ubg a decision. Gene S~merill, 2025 N. Wycoff, stated he was never contacted about water pressure; cemplained of very poor pressure; questioned why the fire department had a different report for the City Council than for the Planning Commission. No objection to duplexes but a~ainst 12 units in single f~nily area. Also, noted that alley is narrow and many residences on the alley use it for their garaaes. Goin~ to be a problem for people backing out who have lived there for years. Conmissioner Stewart noted that M~. Forrester had told him the pressure was adequate to the property line but fr~n there into his home there was a real problem. Mr. Su~mnerill responded that seine had put in new water service and it didn't help. He said that 35 lbs. at the hyd~ent is not very mmch vol~ne. Co~ssioner Schoneman read from Mr. Weller's letter and discussed the proposed 2" line to be ~nstaLled L~mediately for five or six units there; that in the other areas can't find any other problem, except that some homes are using galvanized pipe which corrodes. Mr. Su~merill objected to the R-2 zDne on the grounds it would set a precedent for the a~ea. Alvin Jense, 2003 N. Lafayette, asked if the cu,~,,issioners had looked at the area from the stand- peint of new or ~ecent construction. Cum~issioner Stewart stated he had and that his view was where there were empty lots and older homes there should he something done to upgrade; however, Jensen stated these lots have ~ust been m~de available for selling and the other properties have Rn]dua]lv been used. Against rezone from standpoint of congestion and parking problems. Mavor Jarstad co~nented on other rezones for apartments in residential areas; but stated this area had con~ested traffic corridor and had real concern on the unimproved alley running into the propert7 which is the entra~ce to most of the homes. This was an unresolved probl~n. Appreciated the fine construction that Mr. Jensen does; however, mayor stated he was inclined not to follow the Planning Co~nission's recu~,.endation and to deny the rezone. COUNCIL MINUTES - JULY 2, 1975 - CONTINUF~ fb~nlssioner Stewart stated he had looked at the a~ea and the alley is tight and the str~eets ape. not adequate. Co~nissioner Schoneman stated this particular location can be improved with what has been suggested for the site but he agreed with those who have testified that there ~ many ~easons this is not a [n~oper site for twelve units. The main eni-pance and exit will be an alley to take cape of twelve to fourteen ca~s plus the additional cars on the opposite side and could be well flooded. Those who have constructed apar.bnents in other locations have not had this problem. Mr. Schoneman spoke well of ~?r. Jensen's ability to build according to his plans. There a~en't other apartments in such a ",tort space and this would be an infrlnKement on the rights of those who have single homes and a ,noss~ ble duplex. Mayor Ja~stad stated he hoped evers;one present and the builder understand that everybody is l-~ying to ~3nprove the neighborhood up there and hope if this is denied that a good use of that propePi2; will be ~de. }{ope thene is no bitterness toward the builder who was trying to keep within the stature of the neighborhood; that there is no concenn about the type of constr~etion but after weighing the testimony and goin~ over the area would reave to deny the application for rezone. Hotion by Havop Japstad and Cx~n~nissioner Stewart that this proposed rezone be denied~ carried ~manlmouslv. P~ZONE ~,ARI~S 8 A~-fl~]~T TO ZONING ORDINANCE Charles Nicklin, Mel Marler, and Amendment to zoning ordinance.' Motion by Mayor Jarstad and Commissioner STewart to hold the hearings in that order, carried unanimously. ~L~RLES NICKLIN REZO~tE, R-1 to R-2, llth and Roosevelt: Clerk stated had affidavits in the file showing he had published, posted and mailed as required by law. Then read Resolution No. 300, recum,,endLng approval subject to developing one 4-unit ~esidential structure as shown on the site plan and vehicular access not be provided to llth Street. Clerk then read the Environmental Assessment ~ Staff Review dated May 1~, 1975, which stated it is determined that this proposal h~s been determined to have non-significant adverse effects on the environment and an EIS is not required under RC~4. Motion bv Mavor Japstad and Commissioner Schoneman that there is no need for an E.I.S. on this par~]-~lar pDopepty and declaring a negative effect on the environment, carried unanimously. Clerk read minutes of Planning Commission dated May 21, 1975 and stated the departmental r~3napks are contained in the file. Stated Mps. Hax~cv Sweet had called and stated she was in favor of the rezone; letter fron James J. Adrialm statir~ no objections; and note signed by Sherman Burroughs and Harland Selland opposing the pezone~ without any reasons being given. Ceorge Plescbep, Planner~ discussed the rezone area, s~owing site plan. Comprehensive Plan shows multi-family and a special study made in cooperation with ~esidents shows s~ne. P~eviously denied fop rezone when request was for an 8-unit structure which was overloading the site and did not have ~] fficient parking. ~o Proponents or Opponents present to speak. .Motion by Mayor Jarstad and Cu,,,issioner Schoneman to follow the reoo~,,,~endation of the Plannit~g Commission and approve this rezone, carried unanimously. BIgS: ~ea~e Anderson Cree~ PrepertV and Sewer Pipe, Sheridan Road Pro~eet. Motion by Mayor Jarstad and Commissioner Schoneman to open bids in that order, carried unanimously. Motion by Co~nissioner Schoneman and Co~missioner Stewart to refer to City Engineer's Office for tabulation and reDort late in meeting, carried unanimously. [~FZONE - MEL MARLER, Crawford Drive ~ Kitsap Way R-1 to B-1 Clerk stated he had affidavits in file indicatin~ he had published, posted and mailed as required by o~dinance. Clerk read Plannina Cu,~,~ssion Resolution No. 298 recu,,~endinK denial of the application%l then read the Envirormental Assessnent & Staff Review. Hotion by Commissioner Stewart and Mayor Jarstad to accept the negative assessment and declare that an EIS is not requin~d, carried unanimously. Clerk mead Planning O~nmission Minutes for May 21, 1975. Meeting recessed at 11:25 a.m. and reconvened at 11:30 a.m. with sane people being present. COUNCIL MI~TES - JULY 2, 1975 - CONTINUED Mr. P]escher, Planning Direct-or, showed area map and explained the zoning now in the area and stated the applicant wants to build a driveway to property fronting on Kitsap Way; that an opinion from the City Attorney's Office states that if this is used as access to ccmmer~ial proper~y it must be ne_zoned. If granted, it should only be for a driveway and the actual design of that d~ive- way must b~come an integral part of the over-all plan. Stated it is difficult to get out on Kitsap Way because of the topofvpaphy. Co~missioner Schoneman asked several questions at this point and discussed the fact that the driveway would be splitting the three houses frc~ the two houses. PRO PONENTS M~. Ken Crawfor~, speaking for M~. Marler who is ill, stated he developed the preper~y and originally the area was cu,,ner~ial and was ~equested to w~ite a letter at the time of annexation pequestin~ it c~ne into the city the same as it was in the county but the letter got lost and did not get into the record. Considerable discussion was held about the need for the d~iveway because of difficulty of access from Kitsap Way; and Mr. C~awfopd stated the corner lot is too small to build on an~ shou/d have been made part of the end of 'the cc~mepcial. Discussion was held on whether the apartment would bring in much traffic and Mr. C~awfor~ stated he could see no difficulty but it- miffht affect two houses. Also, that the principal objector does not own proper~y there; however, Mr. Sehonerm3n pointed out that he lives there. Mr. Fed Kohn, realtor, stated he was there to protect interest in the sale for Mr. Crawford and Marler. Stated t~mt he called Mr. 51~e~ep who had told him he was interested in selling, and Mr. Kahn said he had asked him what his objections were to the ingress and egress and the proper~y there, would eventually be co~mer~ial and that Mr. Bremer had asked him to appraise the two homes. Mr. Kahn stated the bio, est objector is Mr. Frohapdt. ~ene Burkhart, Associated with Fed Kahn, stated a concern of the people is that the B-1 zone might allow a restaurant; however, stated this was not the intent at all and the_ city could limit the use of the it~ress and egress. OPFON~TS ~-~at Clerk read opposition letters previously in the heal-ins fr~m Inez Rcmine, 1317 C~awfopd Drive; John G. Romine, 1317 C~awford Drive; and Virginia Frohapdt, 132~ Cpawfo~d Drive. ) Merlin Frohar~t, 1323 Crawfopd Drive, who did not agree with Mr. Kahn's statement about Mr. Bl~e~er but that he had told Mr. ?roha~dt he hoped the residents would maintain their position. Mr. Froha~dt sI~ke in opposition on behalf of the other residents; Rave background of rezones and the restrictions which were placed as a buffer to the prepepty. S~ated concern that almost anything, could ~,o in when rezoned; would K~eatl¥ increase traffic; suggested the owners of the lost might vacate to the city for street purposes, if the only thing they wanted was an access; however~ under questioninK he stated )~ would oppose the roadway and thought the other owners would feed the seine way. Suf~ested the owner should try to grade the proDerecy on Kitsap Way for access. Stated he had talked to police deoapbnent who had nothing to do with t~affic report as it related to impact pi Trident building; and said the. traffic hazards and voltmes of traffic had not been studied. Claimed i[r~eeparal)le dama~e wot~ld be done. Stated the people like the area and have improved their homes. ~'s. Wi] liam Jesse, 1309 Crawfo~d Drive, stated this road would come within six or eight ~:t. of their t~o~]se; that trees and Kround cover would be removed. She said she has been contacted about buyin~ her property for a restaurant and the b~er had also asked about the Shroy property next to her. Compalined about the extra traffic which would come from access road and she would have to put in a 12 ft. fence around their proper%7. She said they would not-approve of the r~zone even if the owners put in screening. Mrs. ~iJna Eastwood, 1727 Elizabeth, mother of Mrs. Shroy, complained of too much traffic there now, ca~'t get out half of the time; children get on the roadway; also, that the Shroys will be back ~and hope to stay where they a~e on Cpawford Drive. C~mmiss[oner Sc}x)neman was of the opinion the owners could put in a driveway; however, Mr. Walgpen said their office believed the access sheuld b~ PezDned if leadin~ to commercial. Mr. Schoneman stated there could be a covenant that the improvement would be for apa~'.b~tents. Mr. Prohardt suggested revertinK~ back to R-2 if going, to apartments; however, Mr. Burkhapt stated that would be_ a tfme-consumin~ process; that they have tv~ previous possibilities for motels and the one now is for an apartment buildin~ and the interested party is ready to go now and suggested put in covenant for ap~rOnent ~ouse and limit it to that on the ingress and eKresss. M~. Schoneman pearl from the Pl~nnin~ Co~,nission minutes on testimony of Mr. Frohar~t and Comnissioner Schoneman commented that if the. property went back to R-2 then the road could be used for access as R-1 lots. Mr. Prohar~t stated if residences were built there would be no problem as it would be for commercial with related tr,~ffic. .e~ne discussion was beld on whether an access could be g~aded on the upper property, using the :corner lot. Mr. Burkhapt and Mr. Froha~dt did not agree. Mrs. Romine objected to any road through there as she lives next door; that traffic backs up now at certain peak ~imes and people tr~/ing to get home to an aparbnent would have difficulty turning on to the ingress road. She_ stated the neighbors made concessions when the owner got B-3 and thev were to leave the homes as residential. ~avor Jarstad stated he didn't penember about the original application and hearing that they dropped out the lots and Mr. Plescher stated this took place on the planning cc~ission level. CJ0mmissioner Stewart commented that 100% of the residents a~e not in favor of the ~ezone and the Plannin~ Conmission voted unanimously to rejeet. COUNCIL MINUTES - JULY 2~ 1975 - CONTINUED Motion bv Co~ssioner Stewart to deny tbe rezone. No second, so motion died. oo~nissioner Schoneman stated that covenant could be put on to have proper screening and protect the homes on either side; that there is nothing, in an ordinance that they must blacktop on land they ~ and he believed a person could drive cars into his property on land he owns, He would have to Ko on that basis. Ccn~nissioner Stewart stated he has a letter frc~ Asst. Attorney Terry ~[cCluskev on the Arista that access could not be used for cc~mercial access. Mayor Jarstad stated he is not goinK to make a decision on it at this time; that he wants an engineer's evaluation on access from KitsaD Way or Crawford D~ive. It is a problem if land is landlocked so it can't be_ develo[md. Land cannot r~nain vacant where there a/~e utilities; so the mayor ~anted to look further into the matter. }~e stated that maybe the first lot might be used and leave the other tw~ lots. Cc~nissioner Stewart suKgested perhaps should rezone all c~,,ereial so that residents can ~et the best price out of their land; but Commissioner Schoneman stated this ~s scmething the owners would have to initiate. l.?otion by Mayor Jarstad and Cxm~niss[oner Schoneman that the decision be set aside until the ol~inc Council ]mcause of some questions (next Wednesday, ) carmied unanimously. CLAIM VOUC}LER - Island Const. Co. (M~. Searle being present. ) Clerk stated Island Const. Co. had paid the rate to an employee for a pipecoverer in accordance with prevailinK pate of wage furnished by Dept. of Labor g Industries; however, union says he must pay for plumber, a hiKher rate due to working on cast iron pipe rather than conczete pipe. Because of the conflict the cltv attorney's office, Jim Sells, had advised to hold up all his payments. Mr. Searle is willing to accept payment less normal 10% beinK withheld and an additional ~ount to equal the amount of the union's demand. Clerk stated the city attorney's office has now said this aruanK~3nemt would be satisfactory. Mr. Searle has sukmitted work sheets showing the exact calculations. DARRELL PARR Mr. Plescher introduced Mr. Parr who is woPkin~ on an intere proKrsm for one month. ~ARING - ;~4ENDMENT TO ZONINg= ORDINANCE Mr. Plescher stated the proposed amendment is simply a housekeepinK amenc~ent to the zoning ordinance in Kranting a variance; have been granting variances for a long time under Section 1~03 but that does not set forth specifically the powere of the PLanning Con~ission or the City Council to Kpant variances. City Clerk read Planning Commission No. 301, reec~mending passage of the ~nendment. Clerk stated he had published and posted as required by ordinance.
