on that same date".
Motion by Mayor Jarstad and Commissioner Swanson to pass Ordinance No. 3549.
Under discussion: Commissioner Stewart stated he thinks this is a valuable
service, but he does not think the money is needed at this time and that is
why he is not voting for it. Mayor Jarstad explained that this ordinance only
puts the question before the people and the people vote for this service if they
so desire. He stated the people should be given the opportunity to choose if
they want this service or not. Commissioner Stewart replied that when the Council
requests more taxes, they should be sure there is a need for them. He stated
that revenue is up $800,000.00 from last year and this is not the time to raise
taxes. Commissioner Swanson asked why the City had to cut back in so many
dep~rtments if revenue is up that much. A lengthy discussion followed regarding
revenue and expenses and Mayor Jarstad stated the Council is only giving the
citizens an opportunity to vote whether they want to spend the money for this
service or not. Commissioner Swanson agreed that the citizens should be given

TAPE #169 WASTEWATER TREATMENT PLANT
(A) 260 At the request of the City CommissiOners, Don Proctor was present to discuss the
problems at the Manette Treatment Plant. Mr. Proctor stated that the odor problem
is just the tip of the iceberg; the principal cause is digester upsets. He stated
the digesters are being overloaded; that the odor from Plant One is caused by the
piping arrangement when it becomes blocked up. He stated further that some steps
have been taken to solve the odor problem: (1) In March the primary digester was
cleaned completely; 440 to 525 cu. yds. of sand and dirt were removed. He stated
this was at a cost of about $800.00 each day and within two or three days, it
frequently breaks down again; (2) Have been trucking the sludge to Plant Two; and
(3) Have tried adding ammonia. He stated that the secondary digester must be
converted to primary; that the cost of the changes is estimated between $80,000.00
and $100,000.00. He stated that part of this will have to be done by contract
and part by work force as the plant must continue to operate. He stated there
will be a significant amount of odor during the cleaning of the secondary digester
and that cleaning will take about two weeks. He stated further that having made
these changes, the City will still have an unacceptable treatment plant; that
there are many problems throughout the City sewer system; that major repairs
have been held off because the City anticipated the new treatment facility.
Commissioner Stewart suggested sampling the Navy Yard's sewage to see if it is
toxic. Mr. Proctor stated that it would have to be sampled 24 hours a day, 7
days a week; that the City does not have the facilities right now to do this
type of testing.
Motion by Commissioners Swanson and Stewart to authorize City Engineer and Waste-
water Superintendent to formulate specifi at~o~ ~e~,~rs in the vicinity of
$150,000.00 and to proceed immediately.~de~ ~scu~n'? Commissioner Swanson
stated he has been talking to Jack Shirley about bonding. Mr. Proctor stated the
City is looking at approximately 80 million dollars worth of facilities.
He stated there should be a cumulative reserve for major problems that are going
to occur. Mayor Jarstad stated that the motion to follow the recommendation of
the Wastewater Superintendent to update the Manette Treatment Plant is proper.
Motion carried unanimously.
Mayor Jarstad stated that the question the City will get into is the budgetary
process. Commissioner Swanson stated the sewer and water rates have been very
attractive in the past.
Frank Whitehead stated he is concerned about someone doing something instead of
just talking. He stated he realizes the City has problems that will cost a lot
of money. -Commissioner Swanson stated that it should take two to three months
to be corrected. Mr. Whitehead asked if there is any way to get something done
on weekends and at night and Commissioner Swanson replied that the number of
qualified staff is too small to handle 24-hour staffing. Mayor Jarstad stated
he feels the City is moving in the right direction and with the delay in scheduling
for the new plant, it is mandatory that these repairs be made now.
Loren Jenkins stated that what has been done for the last few years is not working.
He asked if an outside advisor could be brought in and Commissioner Swanson replied
that there is a difference between trying to make do without spending any money or
making the repairs. He stated money needs to be spent on the plant rather than
on consultants. Mr. McCluskey left the me~ting and Ms. Haberly entered.
TAPE #169 GREEN SHORELINES HEARINGS BOARD APPEAL

Ms. Haberly discussed the findings of the Shorelines Hearings Board and stated
the Board ruled that the application and the City's denial of a variance were
null and void. Commissioner Stewart asked if the Greens have a vested right
because they went through a procedure that was not necessary and Ms. Haberly
stated no.
Robert Green, 3702 Cartier Dr., stated the main point of the decision of the
Shorelines Hearings Board was that they did not need to file for a variance
because the Master Program was not in effect. He stated it is not a question
of whether they have a vested right or not. He stated if they do not get a
decision that they like, they will take the matter to court.
Ms. Haberly explained that Council is bound to follow the ordinances that are
in effect at the time and an appeal can be made to the Superior Court. Mr.
Green asked if there is anything the Council can do and Ms. Haberly replied
there is no action Council can take. Discussion was held regarding the alterna-
tives available to the Greens. Ms. Haberly explained that these arguments must
be made before a Superior Court Judge.
