He stated discussions have been held with almost all the'department heads and the budget is balanced. Commissioner Stewart stated he does not care how it is done -- either cut costs or raise the fees. Mayor Jarstad stated a figure of 8% was used for a wage increase, but it will probably be larger. He stated that at the present time, the City is in a minus category of $120,000.00. Mr. Davies stated that $307,900.00 was projected for Parking System Revenue; that this was based primarily on the first nine months' performance for 1979. He stated it ~s necessary to have some money carried forward each year in order to be able to pay the bills that are due the first of the year. He stated there is an increase in the Transit budget of $55,700.00 over last year because the State Auditor's office has found that the City is required to pay sales and State B&O tax on municipal operations. Commissioner Stewart stated that fare box revenue is up about 18% with no increase in fares. There was further discussion regarding motor vehicle excise tax and household tax, along with several other line items in the preliminary budget. Mayor Jarstad asked for public testimony. Noel Barrett stated he was speaking for the Citizen's Bicycle Advisory Col~nittee. He requested that a line item in the amount of $10,000.00 be established in the 1980 budget for the implementation of the initial bicycle route plan of the City of Bremerton. His written statement is on file in the City Clerk's office. Motion by Commissioners Stewart and Swanson to put at least $10,000.00 as a line item in the 1980 budget for the implementation of the initial bicyle route plan in the City. Under discussion: Mayor Jarstad stated the City Treasurer had been instructed to put that amount in as a line item in the Street Department's budget. Mr. Davies stated that would be entered into the Traffic Control Division. Motion carried unanimously. Patty O'Brien, 2111 E. 31st St., stated she is very pleased with the budget. She stated she thinks it is very important that the Planning Dept. be given enough funds to sufficiently help the City and guide it in ~he right direction and she is pleased a line item is being put in for bicycle paths. Commissioner Swanson stated these salaries are now in line with other cities; that there are several areas where there has always been a degree of inequity and he feels these salary adjustments should be made now. Commissioner Stewart stated he thinks the City's supervisors should receive comparable salaries. Mayor Jarstad stated he objects to these salary increases at this time; that all the supervisors salaries should be re-evaluated at the same time. He stated this re-evaluation should be done as part of the budget negotiations, not at this point in time. Commissioner Stewart stated that Mayor Jarstad gave raises to the Police Chief and Fire Chief and he cannot go along with those raises and not go along with these today. Mayor Jarstad stated that the raise to the Police Chief and Fire Chief was to keep an historical balance between those positions and the captains; that he is only saying the salary structure for all supervisors should be re-evaluated at the same time. Commissioner Stewart stated that in the future they should have the Civil Service Commission check salaries in other cities to determine if they are comparable. Motion by Commissioners Swanson and Stewart to approve changes of pay status. Motion carried as follows: Mayor Jarstad, No, because he thinks all supervisors' salary increases should be handled at one time; Commissioner Stewart, Yes; Commis- sioner Swanson, Yes. Motion by Commissioners Stewart and Swanson that in the future all supervisors salaries be looked at to determine if they are in line with other cities. Under discussion: ColmHssioner Swanson stated that if some equity had been established before, they would not have had this debate today. Mayor Jarstad stated that these salary increases affect the budget and it should have been discussed at the proper time. Commissioner Swanson stated the issue is a pay scale matter and has nothing to do with the budget. Motion carried unanimously. Meeting recessed from 10:20 A.N. until 10:30 A.M. FREE PARKING DOWNTOWN FOR CHRISTMAS SEASON Eddie Bjork, representing the downtown merchants, discussed free parking downtown for Christmas and stated it was a success last year. He stated the downtown merchants felt they could guarantee $10,000.00 this year and asked that that amount be approved. Commissioner Stewart stated that the bonding company has to have the highest amount of revenue that has been generated during the year from parking system revenue guaranteed for the time free parking is in force. He stated that amount can come from other sources, but it must be guaranteed. Mayor Jarstad stated the request from the downtown merchants for ~ree parking is a long-term benefit to the City; that he hopes the Council will take into consideration what the merchants feel they can guarantee and raise. Mr. Bjork stated the $10,000.00 figure is what the merchants feel they can handle very well without any problems. He stated they are. asking for -2- CITY COMMISSIONERS' ~J,~4UTES November 20, 1979 Page three a $3,000.00 reduction from last year. Discussion was held regarding revenue from the parking meters in other parts of the City and it was the consensus of the Council that any additional funds needed after the guarantee of $10,000.00 from the downtown merchants and the revenue from the other parking meters could be appropriated from the general fund. Motion by Commissioners Swanson and Stewart to appropriate whatever funds are necessary to m"~l~e up the difference between the $10,000.00 and revenue from the other parking meters. Under discussion: Con~nissioner Stewart asked Mr. Bjork if the downtown merchants would guarantee $10,000.00 and Mr. Bjork replied yes. Motion carried unanimously. USS BREMERTON Jack Randall discussed raising funds for the gift to the USS BREMERTON from the City of Bremerton. He stated their goal is $10,000.00 and the committee is hopeful the entire community will help. Mayor Jarstad thanked the committee for their work and stated he hopes there will be many representatives from Bremerton at the commissioning. WATER BILLS - School Districts Hal Hoover, Central Kitsap School District, .stated they are present because of one question: "Should the school district have to pay late charges and penalties because they are not able to pay within the short time that is given to them by the City?" He stated that it appears to them, after consultation with legal counsel, that some relief could be found; that according to WAC 480-110-101, the City Council does have the authority to provide relief from late charges. Commissioner Stewart stated he called the Utilities and Transportation Commission and the WAC ruling has nothing to do with the City. Mr. Hoover asked for cooperation from Commissioner Stewart in trying to solve this problem. Commissioner Stewart stated he could not give a "sweetheart" deal to the school district; that he had to treat all customers the same. Mr. Hoover stated that State law prohibits them from paying late charges; that Commissioner Stewart is asking them to break the law, but Mr. Stewart is not willing to break the law. He stated they are not willing to do that. Commissioner Stewart asked why the school board doesn't approve the bills in advance and Mr. Hoover explained that the law states they cannot approve anything until the services have been received. Field Ryan, Bremerton School District, requested the following: (1) Reaffirm the position that the City and School District work together toward common goals~ (2) The Commissioner of Finance be directed to have drawn an ordinance to support the operation of other public agencies and that interested agencies be asked to testify before adoption of the ordinance; and (3) The Bremerton School District have credited back to its account any late charges without having to go through any legal action or a shutdown of the School District. He stated a modification of his second request is that the City direct the City Attorney to prepare either the necessary ordinance or find the methods of operation that would allow them to work within that 30-day time period. He stated he is again pleading for cooperation to solve the problem. Commissioner Stewart stated he does not mind cooperating as long as it does not break the law, but the law should be uniform for everyone. He stated he would not vote for any special or sweetheart deals for the schools. Discussion followed regarding the automatic transfer system and Commissioner Stewart stated this is available to the school districts as well as any other customer. Mr. Ryan stated the Commissioner Stewart does not treat all the customers the same way; that the Navy is treated differently. He stated that Commissioner Stewart has an opportunity to work with the School District and try to solve the problem, but he refuses to cooperate. Commissioner Stewart stated that RCW prohibits the City from making any sweetheart deals with the School District or anyone else and he does not know what else he can do. He stated he does not think the School District is entitled to a special deal. Mayor Jarstad stated he is aware of the cooperation between the City and the School District; that he does not think there has ever been a question concerning whether their bills will be paid. He stated this is not a question of the City attempting to give another governmental jurisdiction special consideration; that the City Attorney -3- CITY COMMISSIONERS' ~INUTES November 20, 1979 Page four should be requested to research this particular problem regarding payment and give a legal interpretation. Commissioner Stewart stated they should get an opinion from someone else because the City Attorney also represents the School Board. Commis- sioner Swanson suggested that the City Attorney discuss the problem with the Attorney General and get a written opinion on all the aspects of this. He stated the Attorney General's office is the proper place to go now. Commissioner Stewart stated they should ask if it is possible for the School .Board to pay these bills in a timely manner and if it isn't possible, should the City make an exception. Mayor Jarstad stated he thinks this has grown way out of proportion and he feels the City Attorney and the attorney for Central Kitsap can talk with the Attorney General and settle this problem. Mr. McCtuskey stated they are not asking for different rates from anyone else; they are only asking for relief from the delinquent charges. He stated there is no set time in the ordinance for a payment date; that the Treasurer's office controls the L date due and it can be switched around. He stated he is not worried about having to collect water bills from the School District or the State Patrol. Commissioner Stewart stated he still feels the City should get an opinion from the Attorney General. He stated he will find out if the School District can pay their bills on time. Mayor Jarstad stated he hopes this particular problem will be worked out satisfactorily and the cooperation between the School District and the City will continue. Motion by Mayor Jarstad and Commissioner Swanson that a satisfactory solution be worked out to take care of the time span for the Bremerton School District, Central Kitsap School District and State Patrol and that their payment system be researched through the Attorney General's office to determine if there is a reasonable, legal way for them to make payment on time. Under discussion: Mr. McCluskey stated that because of the complications of the payment system for the School Boards, the City could set a long time limit for them individually or waive any delinquent charges because there is a specific case and a specific reason for doing so. Commissioner Stewart stated he is against this motion, but if the Council is going to do it, they should just waive delinquent charges for any group. Mr. McCluskey explained that it can only be done on an individual basis. Commissioner Stewart stated the simplest thing ~ieuld be to exempt them from delinquent charges; that if the Council wants him to do that, he still plans to get a legal opinion on whether they can pay their bills in a timely manner and whether the City can legally give them special treatment. Mayor Jarstad withdrew his motion and Commissioner Swanson withdrew his second after considerable discussion regarding the School Board's payment system. Mr. Hoover explained the process for payment of bills and stated it is impossible for them to make payment on time. Motion by Mayor Jarstad and Commissioner Swanson that after hearing all the testimony in two meetings, that the State Patrol, Bremerton School District and Central Kitsap School District have their delinquent charges waived as long as they cannot physically make the payments on time. Under discussion: Commissioner Swanson stated a supporting opinion should be obtained from the Attorney General. Ms. Mandio explained that there are several different registers within a register~ that it was very clear to her. Commissioner Stewart requested that "particular' be inserted before "register". He stated Section 2, Qualifications of Examiners, is all right and he does not see anything wrong with that amendment. Discussion followed regarding Section 3, Expiration of Eligibility, and Commissioner Stewart stated he is against two-year registers. Ms. Mandio stated the Civil Service Commission was agreeable to changing the registers to two years or less. Co~issioner Stewart stated he does not think this system is in the best interest of the citizens or the City; that there is a need to hire qualified individuals who are available and he does not want to block anyone from getting a job with the City for two years. Mayor Jarstad stated that employees can be let go during the probationary period and if shorter registers are necessary, all he has to do is ask for approval of the Civil Service Commission to make the register less than two years. Commissioner Stewart stated he thinks this is a terrible rule and it defeats everything he has tried to do. He stated he thinks they should have open registers. Ms. Mandio stated the Civil Service Commission was totally opposed to open registers. Commissioner Stewart stated he would not vote for this amendment; that he would like to submit it to the public and see if they want to keep it.
