~lerk stated a log trailer and flat bed truckwere auctioned subject to Council
approvin9 surplus of this equipment. Commissioner Swanson stated that this
equipment is still being used periodically by the Water Dept. and should not be
surplused.
TOWING
~oerner, Webber Towing, discussed the rotation system for emergency towing in
Port Orchard and the County and stated there were many problems with CENCOM keeping
to the rotation system; that his company missed many calls. He explained the system
used by CENCOM and stated it was very difficult for CENCOM to keep track of who had
been called last.
Pat Tucker, Chico Towing, stated he applied for the City's emergency towing about
six years ago and if there is a need for another towing service in 'the City, he
should be considered before H&P.
Discussion was held regarding emergency towing and Mr. Boerher and Mr. Tucker both
stated the percentage of their emergency calls was very small. Mayor Jarstad stated
the main concern of the Police Dept. was that towing companies have adequate man-
pcwer and equipment.
Jim Leyde stated the only reason H&P wants a portion of the emergency towing business
is because Leyde Towing towed Mr. Penor's car and Mr. Penor thinks Leyde's rates are
too high. He stated Mr. Penor's rates are comparable. He reiterated all the advant-
ages Leyde Enterprises has and stated the City will lose a good service if it considers
adding H&P Towing to the emergency towing list.
AMBULANCE ORDINANCE VIOLATION
Clerk read letter from Robert Mussman, dated Nov. 29, 1979, regarding Council approval
of the ambulance rate schedule retroactively. He questioned whether this was proper
and asked for an opinion from the City Attorney. Mr. McCluskey stated he had given
Mr. Mussman an opinion earlier that the Council has the power to change rates retro-
actively. He stated that the people who were charged the new rate before Council
approval have a right to object, but that is between them and Leyde.
Jim. Leyde stated he presented a copy of the rate change to the City on Aug. 8, 1979
but there was no record of it; he hand-carried another copy on Sept. 19, 1979 and
Mr. Ross signed to indicate receipt. Ms. Mandio explained that she was told there
were no changes to the rate schedule; that it was only correcting a typing error.
Mr. Leyde continued that his point is that the reason the rate schedule was not
approved immediately was because the City lost the first two copies he submitted.
COMMISSIONERS' REPORTS
Commissioner Stewart:
1. Suggested hiring an audit firm with a computer background to look at the internal
control procedures in the Finance Dept. the first of the year.

contract allowing the City Council to remove any bench it feels is in the wrong area,
carried unanimously.
Meeting recessed from 10:15 A.M. until 10:30 A.M.
Commissioner Swanson:
Asked Don Proctor to present recommendations ~or sewer service rate structure and
1980 service rates.
Mr. Proctor stated he has tried to determine a fair and reasonable rate structure
a~d~Cnat the rates within that structure should be for 1980. He staked all costs
associated with the provision of utility service should be supported by revenue
derived from the customers of the specific utility. He recommended that the sewerage

service rate structure be composed of two distinct elements or portions: (1) A
base charge for each account that covers the non-volume-related costs of the
utility; and (2) A volumetric charge rate that will generate revenue to cover
the volume-related costs of the utility. He stated a detailed analysis of the
proposed 1980 Wastewater Facilities Department Budget has been made to determine
a reasonable split between revenues from base charges and volumetric charges.
This analysis report is on file in the City Clerk's office. He stated that 60%
of revenue should be derived from base charges and 40% from volumetric charges;
that two different expenditure/revenue levels are to be considered: (1) Level A
is $2,136,000.00 and would provide for a Cumulative Reserve for Renovation, Repair
or Replacement Projects; and (2) Level B provides $1,354,200.00 which does not provide
for a sustaining rate of renovation, repair or replacement as the facilities are
being used. Mr. Proctor recommended that the sewage service contracts for the Navy
facilities be renogotiated as soon as possible to avoid possible jeopardy of
eligibility for EPA Construction grant funds. A lengthy discussion followed
regarding Mr. Proctor's recommendations and it was the consensus of the Council
to look at the information submitted by Mr. Proctor before making a decision on
a rate increase.
