WAYNE COWLEY PROPOSAL FOR BUILDING DEPARTMENT
Clerk read letter from Wayne Cowley, dated Dec.. 15, 1979, which recommended that
one building inspector position be removed from the 1980 budget; that this will.
reduce the budget for the Building Dept. by $17,760.00.

TOW I NG
Capt. Shoemaker recommended that a Twoing Commission be established for the City,
to consist of one police officer, one towing expert and one concerned citizen.
He stated the function of the Towing Commission would be to listen to complaints,
inspect equipment and test operators; that minimum requirements must be met before
a towing company will be considered to tow for the City on an emergency basis.
Commissioner Stewart stated this is duplicating what the State Patrol is already
doing; that the towing should be rotated and give everyone a chance.
Motion by Mayor Jarstad and Commissioner Swanson to instruct City Attorney to
prepare an ordinance for Towing Commission as recommended by the Police Dept.
Under discussion: Commissioner Swanson stated he talked to a number of cities
and one of the areas they are most concerned with is the establishment of a Towing
Commission. He stated he felt this could be very helpful. Motion carried as follows:
Mayor Jarstad, Yes; Commissioner Stewart, No; Commissioner Swanson, Yes.
A lengthy discussion followed regarding the requirements for a towing company and
Commissioner Swanson stated he felt a 20-ton wrecker would be sufficient; that a
25-ton wrecker is not necessary.
Motion by Commissioner Swanson and Mayor Jarstad .t~V~ ~r.~e ~e~ ndations of Police
~regarding requirements for towing companies^anl a~prove ro~a~ion system on a

Clarence Wilson, 71 Galyan Dr., asked if anything could be done about dogs running

dogs and there is an oPdinance in the City that states dogs cannot run at large.
Vern Dunlap, 1022 18th St.. discussed the closure of Chester Avenue by .Olympic
College. He stated the college has been closed but the barricades were left up
until 4:30 Friday afternoon. He wondered why the City cannot put up signs notifying
drivers that the barricades are lifted. Commissioner Swanson stated the barricades
will be down until after the first of the year. Mayor Jarstad stated that hopefully
an adequate by-pass system will be constructed soon.

CITY COMMISSIONERS' MINUTES
December 18, 1979
Page three
Ken Attebery, Planning Director, discussed the proposal and stated the Comprehen-
sive Plan shows the area as low to mediu~ density residential (4-6 dwelling units
per acre); that surrounding land use is R-1 in all directions. He stated the
Planning Comm{ssion recommended denial on the basis of the six-unit scheme; that
the applicant is presenting a new site plan for five units. He stated further
the access from Rickey Rd. was also a strong factor for the Planning Commission
to recommend denial; that Rickey Rd. is a narrow, one-way street and is considered
to be less than ideal.
PROPONENT:
Gerald E. Schlie, 6825 24th NE, Seattle, archi tect, discussed the proposal using
a colored sketch and site plan. He stated three duplexes could be built on this
property, but the owner felt a five-unit structure would fit in better with the
neighborhood. He stated they plan to sell the units as condominiums. He stated
he thinks it only fair that the developer contribute to upgradin9 Rickey Rd., as
they will be contributing to the traffic flow.
OPPONENTS:
Vernon Bouton, 2960 Rickey Rd., stated he is concerned with the density of the
proposal. He stated it is completely out of character with the neighborhood;
that duplexes will be put in if this rezone is denied. He stated he feels this
is unfair and he does not want the neighborhood inundated with duplexes. He asked
if this would set a precedent if it were approved and Mr. McCluskey stated that
another developer could make this point in requesting a rezone on adjacent property
(if this rezone were approved). Mr. Bouton stated he hoped the City Commissioners
will stand behind the Planning Commission decision to deny this rezone. Commissioner
Stewart asked Mr. Bouton if he preferred three duplexes or a five-unit structure and
Mr. Bouton replied from the standpoint of design, he finds the five-unit structure
more desirable. He stated his main concern is the opening up of R-2 in the area;
that other developers might not be as considerate as Mr. Schlie.
Barry Branch, 3115 Sahali Dr., stated he thinks this is a well-conceived project
and it will enhance the neighborhood. He stated he is concerned with upgrading
the road system; that he does not think it is unreasonable to ask the residents
to share the costs of an LID to jointly improve the entire road system and not put
the burden on one developer.
Commissioner Stewart stated he would like to see Rickey Rd. improved and an LID
would be an easy way to finance the improvements. Mr. McCluskey explained that
the property owners have to initiate an LID. Discussion was held regarding the
improvement of Rickey Rd. and Mr. Schlie stated. he did n6t think his client would
object to a fair division of the costs for improving that road. Commissioner Stewart
stated he felt $5,000.00 would be a fair assessment for the developer to pay and
Commissioner Swanson felt $3,000.00 would be a better figure. Bob Frisbie, Asst.
City Engineer, stated he thought it would cost between $10,000.00 and $15,000.00
to bring Rickey Rd. up to minimum standard.
Mr. Frisbie stated that storm drains are a secondary concern of the Engineering
Dept. and the applicant will be required to strictly control all water runoff from
the property in accordance with State law.
Vernon Bouton stated he is willing to work with the City in the development of
Rickey Rd.; that he owns 220 ft. along that road.
Mr. Slate, 351 East 30th, stated he would like to see Rickey Rd. improved, but
he does not feel he should have to fund it. He stated he likes the looks of the
proposal rather than duplexes.
C. L. Woods, East 29th, stated the sewer line is overloaded now and he asked if
the sanitary sewer will be tied to the one below. Mr. Schlie replied that there
are two sewer lines that are serving the site now.

for the area. Motion carried unanimously.
TAPE #176 HOLLIDAY REZONE R-1 to B-3
(A) 2242 Clerk stated the hearing had been advertised, posted and letters of notification
mailed to residents as required by law. She read Planning Commission Resolution
No. 550 recommending denial. She stated 15 advisory ballots had been sent, three
returned and all three disagreeing. She then read letters from Mary E. Zabel and
Joseph Ott opposing the rezone. She stated a call had been received from David
and Janet Hayford opposing the rezone.
Ken Attebery, Planning Director, stated Mr. Holliday had contacted him and Mr.
Holliday is considering modifying his proposal and could not be present today. He
stated Mr. Holliday has requested a continuance. Discussion followed and Commis-
sioner Stewart stated it is not fair to bring the neighbors down time and time
again and have a different plan presented. Mayor Jarstad stated that the Council
had passed a motion sometime ago that scheduled hearings would continue as scheduled
and this hearing will continue.
PROPONENT:
No one was present to speak for the rezone.
OPPONENTS:
Ed Okerman, 1015 Hanford, stated that anything that generates more traffic would
be a hazard to the neighborhood. He asked where the commercial zone is going to
end; that hedges not think it should be extended down side streets from Wheaton
Way.
Mike Schrader, 1012 Hanford, stated it is difficult' to ~urn left from Hanford onto
Wheaton Way and they do not need any more traffic on Hanford.
Henry Cummings, 922 Hanford, stated he is against any business encroachment in the
neighborhood.
John Peabody, 910 Hanford, stated he objects to any business encroachment; that
any more traffic would increase the hazard to children.
Mrs. Henry Cummings, 922 Hanford, stated that encroachment on single-family dwellings
can have a domino effect and she would prefer to see commercial go no further than
it is right now.
Barry Branch stated an adequate site plan should have been submitted to Council
before the hearing.
Mayor Jarstad stated it is very difficult to make a decision when the petitioner is
not present; that concern has been voiced that an adequate site plan be submitted
and the petitioner be present at the hearing.
Motion by Mayor Jarstad and Commissioner Stewart to concur in recommendation of
Pa"l~'~l'ng Commission and deny request for fezone, carried unanimously.

TAPE #176 DAWKINS REZONE R-1 to R-2
(B) Clerk stated the hearing had been advertised, posted and letters of notification
mailed to residents as required by law. She read Planning Commission Resolution
No. 547 recommending approval. She stated 32 advisory ballots were sent, 21
returned, with 3 agreeing and 18 disagreeing. She then read letter from Donald
' Van Ruth, 2803 Halverson, opposing the rezone.
Ken Attebery, Planning Director, stated the site is located along Sheridan Rd.;
that single-family and duplexes surround the proposal. He stated the proposal
is to construct 16 units to be sold as condominiums; that there will be 32. parking
spaces and the greater portion of the parking will be covered.
Mayor Jarstad stated Mr. Dawkins has been very active in his political campaign
and if anyone wished, he would step down from the hearing. He stated this would
have no bearing on whatever decision he might make. No one requested that he
step down.
Bernie Dailey, 2728 Cherry, stated one of his primary concerns is the water runoff
to his property. He stated he should be protected by having the proper drainage
put in; that proper traffic lights should also be put up. He stated there is a
need for a caution light at Chestnut.
Gaylan McLaughlin, 2740 Cherry, stated drainage is the biggest problem. He stated
that traffic is bad and there should be a light at Sheridan and Cherry. He dis-
cussed the sewage problem and stated the sewer is totally inadequate.
Mayor Jarstad stated that a development like this will help to control the drainage;
that the water will not just run off and come onto his property. He stated the
water will be diverted into the storm drainage system.
Morrie Dawkins, 2818 McClain, introduced Barry Branch, the architect for the
development.
Barry Branch discussed the proposal and stated the units will be sold as condominiums
and there will be covenants which provide for repair, n~intenance and upkeep of the
building and the grounds. He stated they are fully prepared to comply with all
regulations to handle water runoff and the collection of water. Commissioner Stewart
stated the drainage problems should be taken care of so it will not be a financial
burden on the neighbors.
Motion by Mayor Jarstad and Commissioner Swanson to approve rezone R-1 to R~2, subject
to the following conditions: (1) The site shall be d~veloped essentially the same
as the Barry Branch site plan dated Nov. 20, 5979, which was presented to the Bremerton
City Council on Dec. 18, 1979; (2) That the development be built as a condominium
and no sale of more than one unit to any individual or corporate company be allowed.
A condominium declaration shall be filed with the Planning Department prior to the
issuance of an occupancy permit; and (3) The storm drainage and sanitary sewer
system shall be developed to the standards set by the City Engineer. Under discussion:
Commissioner Stewart stated the motion should also state that there will not be any
financial burden to the neighbors for water runoff; that the developer should be
financially responsible. This amendment was not added to the motion and motion carried
as follows: Ma.vor Jarstad, Yes; Commissioner Stewart, No; Commissioner Swanson, Yes.
Meeting recessed from 2:00 P.M. until 2:30 P.M.
