tions at $5.00. Commissioner Stewart suggested that these tickets be envelopes
like the parking tickets so people can place the envelope in the overtime parking

Motion by Commissioners Stewart and Swanson to follow recommendation and increase
~ee for violation of "No Parking 2:00 A.M.-6:00 A.M." to $5.00, carried unanimously.

sioner Stewart stated that if something breaks over the weekend, it should be
fixed. Commissioner Swanson stated he is sure no one is sending vehicles out

includes the site of the water tank, there is nothing the City can do to make
recommendations on utilization of some of that land for available parking
around the hospital.
Commissioner Swanson stated the City is obligated to supply water to the new
Jackson Park Hospital and one of the few areas with sufficient land and eleva-
tion is in the NAD Park. He stated the City may be approaching federal agencies
with a proposal to erect an underground tank in NAD Park. Mayor Jarstad stated
that after the 20-year period, the restriction that NAD Park be used for park

of noise and harrassment from their next-door neighbor, Steven Jacobson. A note
from Nick & Valerie Rudman, attached to the letter, was also read. This note
also complained of noise from motorcycles in the early morning. Mr. White was
present and stated he hoped someone can take some effective action regarding
Mr. Jacobson. Commissioner Stewart stated that Mr. White has been harrassed
and bothered for sometime and he thinks it is time something was done about the
situation. He stated that if the courts won't enforce the laws, the City Council
should take action. He suggested that the Police make surprise patrols of the
area. A lengthy discussion followed and Mayor Jarstad stated he would meet with
the Police Chief and the Judge to determine what is being done and what legal
processes should be followed. Mr. White voiced his appreciation.
Waltrine Taylor, 2708 Callahan Dr., discussed the increase in her water bill.
She stated the last bill she received was for $61.00 and the one two months ago
was $13.41. After considerable discussion, Commissioner Stewart requested that
she talk to Marylyn Hamilton in the Water Dept. Mrs. Taylor also discussed cars
parkin~ on sidewalks and asked that this situation be brought to the Police Chief's
attention. She was asked to contact the Police Dept. and give them the area in
which cars are parking on sidewalks.
REQUEST FOR USE OF EVERGREEN PARK FOR BALLOON RELEASE/PRESS CONFERENCE
Deputy Clerk read memo from Parks Superintendent, dated Sept. 4, 1979, which
stated the Crabshell Alliance has requested use of Evergreen Park for a balloon
release/press conference. The memo stated that this proposed event is not
consistent with traditional uses of City park facilities. She then read letter
from Crabshell Alliance, dated Aug. 30, 1979, requesting permission to use Ever-
green Park on Sept. 22, 1979 for a balloon release/press conference. The letter
listed the topics to be presented and stated approximately 1000 balloons will be
released to gather scientific data about the meteorological conditions in the
Bremerton/Puget Sound area. The letter stated further they expect approximately
150 people to attend, the rally will last about 2½ hours and they will have a band.
Mayor Jarstad stated that concerts are held twice a year and other than the con-
certs, the City has denied just about all requests for use of the park property.
He stated he finds it hard to believe they only expect 150 people. Loren Chilson
stated they do not figure there will be that many at this event. He asked if there
is any problem with having a balloon release in the park; that they don't see any
problem with having a small rally in the park. He assured the Council of their
good intentions for the rally. Mayor Jarstad explained that the Council's reaction
on this short notice would be the same for whoever petitioned. The Conmlissioners
then discussed the request for a band at this rally.
Susan Lang stated that in the early 60's, the park was used for Viet Nam demonstra-
tions at least twice. Mayor Jarstad explained that it is difficult with such short
notice. He stated they should have started early enough to go through the Park
Commission and the Parks Superintendent.
Motion by Commissioner Swanson and Mayor Jarstad to follow recommendation of Parks
Superintendent and deny request for use of Evergreen Park. Under discussion:

Mayor Jarstad suggested they check with the County to determine if there are
other areas that might be open. He stated that traditional use of the Park
has been within the Park Dept. Program. Mr. Chilson stated that requests for
picnics and marriage ceremonies have been approved and Ms. Lan9 stated they
want to make this a traditional use.
Mr. Chilson went through their list of scheduled speakers and stated they will
be focusing their rally on the water pit facility and the EIS regarding that
facility. He stated they want to hold the rally to inform the citizens.
Commissioner Stewart stated he does not think the motion is relevant because
the Parks Superintendent did not make a recommendation. He stated it should
.be referred back to the Park Commission. Commissioner Swanson stated his motion
was to deny the request for use of Evergreen Park. Mr. Chilson stated that if
their request is denied, a Writ of Mandamus will be filed. He stated they are
just trying to inform the citizens of the potential danger of this facility and
there should not be any problem with having a gathering of concerned citizens
to listen to speakers and try to determine what can be done in the future. He
stated further that this is a non-violent group. Commissioner Stewart stated
it ~hould be referred to the Police DeFt. to determine if there is a problem and
get a recommendation from the Parks Superintendent. Mayor Jarstad stated that
requests for use of the park have been denied time and time again for this and
other types of activity of a like nature. He stated the request should have
been presented far enough in advance to get recommendations from the Park
Commission and Parks Superintendent. Commissioner Stewart agreed that time is
short. He stated he would like to get some recommendations from the Police Dept.
He stated further that he does not want a riot in that neighborhood; that he
would like to know what kind of noise the neighbors would be subjected to. Mayor
Jarstad stated that anyone who lawfully and properly wants to protest should do
so under the strictest rules; that the City will not have any illegal or unlawful
demonstrations. Question was called and motion carried as follows: Mayor Jarstad,
Yes; Commissioner Stewart, Abstain; Commissioner Swanson, Yes.

Mayor Jarstad stated he would not recommend this if there were funds within the
