TAPE #154 SALMELA SHORELINE SUBSTANTIAL DEVELOPMENT AND VARIANCE PERMIT
(B) 1180 Deputy Clerk stated the hearing had been posted and advertised as required by
law. She read letter from Frederick Salmela, dated Jan. 31, 1979, requesting
a variance from the setback requirement for the construction of a small log
sauna on the east shore of Oyster Bay at 1309 Lower Marine Dr. She then read
letter from Bay Area Council, dated April 3, 1979, opposing the building of a
sauna near the high tide line on Oyster Bay.
Ken Attebery, Planning Director, described the proposal and stated the proposed
building would be set back into the slope. He summarized the Staff Review and
stated he recommended approval with the following conditions: (1) Sauna structure
be developed in the location on the plans submitted with the application; (2)
The building permit application shall contain provision for temporary soil
stabilization upon completion of development to prevent erosion and subsequent
sedimentation ~n the beach area; and (3) None of the excavation or building
activity shall result in any earth or other materials being placed on the beach
or in the waters of Oyster Bay. He stated further the proposal meets the criteria
set forth by the Shoreline Master Program and Dept. of Ecology.
PROPONENT:
Fred Salmela, 1309 Lower Marine Dr., stated that sanitary facilities will be
limited to a shower and the existing septic tank will he used.
Harry Dunlap, 1320 Lower Marine Dr., stated he has no objection to this; that
he will not be able to see the building f~om his home, nor will the neighbors on

APE #154 REVISION TO SHORELINE PERMIT #42-77 (Gilman & Kruse!
(B) 1368 Ken Attebery, Planning Director, stated the revision is requested to allow a
different site design; that the new design would consolidate three previously
proposed structures into one. He stated 48 units are now proposed compared to
56 previously; and two alternate site plans have been presented for consideration.
Be summarized the Staff Review, which is on file. He stated the State Shoreline
Management Act administrative code allows revisions of previously issued permits
if the revision is within the scope and intent of the original permit. He dis-
cussed the alternate plans: Jan. Plan (No. 3) indicates one residential structure
three stories in height with parking except for public stalls located south of
the building away from the shoreline; and March Plan (No. 2) indicates the same
three-story structure but it is located further south to avoid building the
structure on the leased "harbor area" and 48 of the 78 parking stalls are located
on the waterside of the building and 30 are located south of the building.
PROPONENTS:
Leonard Kruse, Vice-President for Ryan Built Homes, stated his company purchased
this property and they determined it was not feasible to construct according to
the original proposal. He discussed the redes[gn and stated a portion of the
land lying to the right of the inner harbor llne is leased from the State; that
lending institutions will not lend money for construction of condominiums on
leased land. He stated the March Plan (No. 2) was devised to move all the
structures to fee owned land, but they prefer the Jan. Plan (No. 3). He requested
approval of both the Jan. and March Plans. He stated they have a 30-year lease
with the State for the harbor area and they will have first choice to renew the
lease.
Edna Eastwood, 1720 Elizabeth, discussed the discrepancy in the height of the
building on Elizabeth; that it cannot be any higher than 35 ft. She stated she
is also against a walk-way going from the apartment complex to Elizabeth. Mr.
Kruse explained that under the revised plans 2 and 3, the building height does
not exceed 35 ft. and there is no direct access from Elizabeth.
Discussion was held regarding whether two site plans could be approved and Mr.
McCluskey stated he knows of nothing that says it can't be done. Commissioner
Stewart stated he does not see anything wrong with approving two plans that are
acceptable.
Motion by Commissioners Stewart and Swanson to approve Site Plan No. 2 (Mar.) and
Site Plan No. 3 (jan.), with preference for Jan. Site Plan, and that the height
of the principal structure on the site be limited to 35 ft. above the average
existing grade and all permit conditions not affected by these changes should
remain, carried unanimously.
Meeting adjourned at 11:55 A.M.
Barbara L. Beahm, Deputy City Clerk
