Callow Ave, I have enclosed memos from the Department of Community Development that outline the specific requirements for land use and building and fire codes as they relate to teen and/or adult dancing at your present location. All responding department officials believe that your organization has misread or misunderstood the prevailing code requirements. We urge you to schedule a follow-up meeting with Scott Erickson and James Coombes of Community Development to clarify these requirements. The current business licenses for Center of Many Ways and Higashi Kaze are valid under the current uses of "retail/exercise" and "retail", respectively. Your business premises came under review upon written application for the additional use of teen/adult dancing. We are attempting to clarify city code requirements so that your organization can effectively assess your plans for the expanded use of dancing. Upon review and consideration of the enclosed, keep in mind that the Special Use Permit requirement is the overriding issue at present. If you are not successful in obtaining this permit, the building and fire code problems become moot for the teen dancing activity since this would not be an allowed use without the Special Use Permit. Please direct further inquiry regarding land use and building/fire code requirements to the Department of Community Development at 478-5275. You can be assisted by Mr. Erickson or * Celebrating 50 Years of Freedom * ~~ OF _~!!e . Page 2 November 12, 1996 Jan Sunderlin Mr. Coombes. FAX (360) 478-5200 October 3, 1996 Jan Sunderlin Higashi Kaze 623 Callow Ave N Bremerton WA 98312 Dear Mr. Sunderlin: This letter is to confirm our understanding that Higashi Kaze will no longer be running a membership dance club at 623 N. Callow. As discussed at our September 19, 1996 meeting, your present location has serious exiting and fire code deficiencies for dancing and public assembly use. It was your decision not to pursue improvements at this time. We appreciate your voluntary compliance in ceasing this activity until such time when code compliance can be achieved. We encourage you to contact the Bremerton Parks Department regarding the possible use of their facility for teen dances. ~ Paula ohnston Business License Inspector PGJ / med cc: Marlene Nance, Land Use Specialist Janet Lunceford, Administrative Analyst Scott Rappleye, Deputy Fire Marshal Capt. To: City of Bremen on & Paula Johnson, Business License Inspector 239 4th Street, Bremerton, 'vVa. 98337 Ms. Johnson, This letter is to inform you that I understand the full meaning and import of your letter com- munication \vith me dated October 3, 1996. Sincerely, Jan Sunderlin Owner, Higashi Kaze ,\dditionally, [ would like to communicate the following from Center of j\;lany' \Nays: We find it difficult to agree with you that this building has "serious" exiting and fire code de- ficiences as both Center of Many Ways and Higashi Kaze have each passed your city's y'early fire inspection as recently as 7/23/96. The latest inspection having been performed by your Fire Marshall Mike Seacrest, during which time the City ofBremerton was fully aw'are that Center of Many Ways and Higashi Kaze were pursuing, upon oral approval in November of 1995 from one of your administrators, this Friday and Saturday dance, This aforementioned indicates to me a possible miscommunication between your administrators, servants of [he public, and such action can quickly produce ill relations. This building was approved for our use under our present Occupancy permit by the officials of the City ofBremerton on May 26th, 1993 with a maximum occupancy load 01'92 people at anyone time for the use of retail and exercising, A "B2" occupancy, as ours is, under the rules of the 199] Uniform Building Code by which our building was evaluated, and uDon which we have developed our business here, permits the use of our building for the purpose of 'amuse- ment, assembly and education' as long as the occupancy load in anyone ponion or room thereof does not exceed 49 peo[Jk, 1 ~-~ As long as Center of Many Ways maintains its occupancy load as required by the lJroUp B codes (for a refresher, see 1991 Uniform Building Code, page 59, sec.701; page 61, sec.702, subsection 7.; page 56, sec. 610; page 646, sec. 3314(c) it may conduct the activities permitted by such, and that includes dancing:. Dancing:, a form of entertainment. only falls under a Group A occupancy when 50 or more people are present in anyone portion or room of a buildinQ. In understanding the facts, it is probable that the Fire Marshall who issued the fire inspection report of 9/12/96 which directed Center of Many Ways to discontinue our dance misread the codes, and has therefore acted improperly. Keep in mind that the development of our business here in the City of Bremerton has been built upon that Business License and that Certificate of Occupancy and any infringement upon our business in this City ofBremerton through an ill reading of law is an injustice which will adversely affect our financial commitments to others and our civil right to conduct business. Furthermore, we would like to communicate that the meeting vvhich f'v'Ir. Sunderbn and tv1r. Griswold had with your DCD group on Thursday, Sept 19,1996, at 9:15am was not conducive for the development of a 'working together' type of relationship between the City of Bremerton and Center of Many Ways (We ofCNf\V wonder if this is the usual way in which you interface vrith the public and business?). First and foremost, it seems that dancing is permitted under a Group B. Division 2 occupancv permit, which we hav'e; yet your group coldly and repeatedly insisted that Center of Iv'fany Ways would need to be reclassified as a Group A occupancy. This is odd. Secondlv, you did not offer at all a path which \\ie might take towards pursuing financial aid, which the City has ayailable in loans and HUD grants, in order to improve our building as DCD outlined, \vhich nmv seems to be an improper imposition as all our activities fall under Group B occuoancv. Thirdlv, the manner in which your Business License Inspector cut short Mr. Sunderlin during his introduction of himself, one of our Directors, and what our non-profit corporation Center of Many Ways includes in its activities was, simply put, disrespectful and rude. Fourthly, we find it interesting that the DeD group repeatedly attempted to use the "Land Use Tables" to attempt a redefinition of our activities anyplace of the "Uniform Building Code"; this indicates either an unfamiliarity with the differences between these 1\vo guides and where they apply, or an agenda other than the support of our business and other businesses in the City of Bremerton. Incidentally, the Center of Many Ways building is zoned "GB" (General Business) under the guidelines of the "Land Use Tables", and dancing, as well as many other ~ses, are allowed as an "A" use in such a zone. "A" means "Allowed Principle Use". . Pending other research we will not allow Higashi Kaze to operate its dance at this time. If vou find that Center of Manv Wavs has misread. or is unaware of certain aspects of the Uniform Building Code or Uniform Fire Code, or asoects of 'grand fathering'. then we welcome correction and enlightenment. 2 =--,.~ \Ve of Center oft'vtany Ways wiii continue to pursue its business in Bremerton ami \vorK for ,\ productive relationship with the City of Brernerton. L1CE~a9~ 18,1999 From: Center of Man Wa s 623 North Callow . remerton, To: The City ofBremerton Our Company's economic condition is pitiful and I and the other two reml'lining members of the the Board of Directors have now exhausted our energies and financial capabilities. For Center of Many Ways, the economic reality which has occurred over the past 3 years, e.g. Government cutbacks, a massive shift in retailing to Silverdale and Waaga Way, a significant in- crease in other Martial Art schools in the area, the City of Bremerton continuing to ignore small business aspects and seemingly acting to suppress certain small business endeavors through its Fahrenheit 451 branch, and a general fear of Callow Ave. on the part of the public, has caused us to be absolutely unable to continue with business of any sort. Additionally, we and others on Callow Ave. see on a monthly basis an increase recently in violent acts and prostitution...again not that which is conducive to business. We now see Callow Avenue, and perhaps Bremerton in general, as a place continually strug- gling to define a moral basis but cannot because of its its transient nature. We have no energies remaining which could cause us to spring back towards a positive attitude. Therefore, we will be vacating the premises at 623 North Callow and letting the building return to the Mortgagor, Mr. Arlan Swanson, according to contract and law. We, Center of Many Ways, will cease business operations on March 31, 1999 and will have vacated the premises by no later than April 10, 1999, hopefully by April 4, 1999. No later than April 10, 1999, we, Center of Many Ways, will surrender our City ofBremerton license and oc- cupancy permit. It has been an interesting adventure... The forwarding address for Center of Many Ways is: 15826 Virginia Pt. Rd. N.E., Poulsbo, Washington 98370. Sincerely for, and unanimously by the Board of Directors, .~ Li \- " ,~. Sincerely, Jan Sunderlin Owner, Higashi Kaze ,\ddilionalJy, [ would like to communicate the follO\ving from Center of Many \A/ays: We find it difficult to agree with you that this building has "serious" exiting and fire code de- ficiences as both Center of~/lany Ways and HigashiKaze have each passed your city's yearly fire inspection as recently as~~ The latest inspection having been performed by )'our Fire Marshall Mike Seacrest, during which time the City of Bremerton \vas fully aware that Center ofrvlany Ways and Higashi Kaze were pursuing, upon oral approval in November of 1995 from one of your administrators, this Friday and Saturday dance. This aforementioned indicates to me a possible miscommunication behveen your administrators, servants of the public, and such action can quickly produce ill relations. A-Pfu ckl1~ Q-I2..-1b This building \-vas approved for our use under our present Occupancy permit by the officials of the City ofBremerton on l\IIay 26th, 1993 with a maximum occupancy load of 92 people at lL-any one time for the u~;e of retail and exercising. Pu b (;c::.. J~ e Furthermore, we would like to communicate that the meeting which rvlr. Sunderlin and rvlr. Griswold had with your OCD group on Thursday, Sept. 19,1996, at 9: l5am was not conducive for the development of a 'working together' type of relationship between the City ofBremerton and Center of Many Ways (We ofCrvIW \vonder if this is the usual way in which you interface \vith the public and business?). First and foremost, it seems that dancing is permitted under a Group B. Division:2 occupanc'l permit, which we have; yet your group coldly and repeatedly CY 802. ~ insisted that Center ofT"'fany Ways would need to be reclassified as a Group A occupancy. This 3 is odd. Secondlv, you did not offer at all a path which \'v"e might take to\vards pursuing financial ~M.Nrtc..., <lid, which the City has available in loans and HUO grants, in order to improve our building as 5f~'JJ~ DCD outlined, \vhich now seems to be an improper imposition as all our activities fall under ' t.J ~uswJ Group B occupancv. Thirdlv, the manner in which your Business License Inspector cut short Mr. Sunderlin during his introduction of himself, one of our Directors, and \vhat our non-profit corporation Center of Many Ways includes in its activities \vas, simply put, disrespectful and rude. Fourthlv, we find it interesting that the DCD group repeatedly attempted to use the "Land Use Tables" to attempt a redefinition of our activities anyplace of the "Uniform Building Code": this indicates either an unfamiliarity with the differences between these 1\vo. guides and where they apply, or an agenda other than the support of our business and other businesses in the City of Bremerton. Incidentally, the Center of Many Ways building is zoned "GB" (General Business) under the guidelines of the "Land Use Tables", and dancing, as well as many other uses, are allowed as an "A.' use in such a zone. "A" means "Allowed Principle Use". ~ '3''31'+ ~ ~rr ~, eJJ5 / I LWMINIfrIt:1A . Pending other research we mIl not alIoV\'" Higashi Kaze to operate its dance at this time.
