Ken Attebery, Planning Director, gave the background of Harkins Place and the requests for rezone and vacation of right- of-way. Hearing was discontinued at this time and Commissioner Swanson made the following announcement: He announced that the Union pulled their emergency crew because the City did not relieve~Earl Riggs as foreman. He stated Mr. Riggs has been crossing the picket line and the Union felt he should not be doing a foreman's work; that the City felt it was necessary that Mr. Riggs stay on the job. He stated further that~ if necessary, the City will go to an outside contractor to finish. Mayor Jarstad stated he is very disappointed with the Union and he hopes a private con- tractor will be hired soon to finish the job. DENEND REZONE & R/W VACATION HEARING (continued) Mr. Attebery presented Planning Commission Resolution Nos. 52~ and 5~recommending denial of rezone and right-of-way vacation. He stated the Planning Commission again recommended denial for the following reasons: (1) Commercial use of the property would increase traffic problems at the intersection of Wheaton Way and south and west in the Olympic Manor Plat; (2) Commercial use would extend the -3- CITY COMMISSIONERS' MINUTES May 1, 1979 Page four unsatisfactory residential conditions deeper into the residential neighborhood; (3) The stability of the Olympic Manor residential area must be protected as much as possible from the impact of commercial development. The rezoning of this corner portion of the residential plat would not be a positive step toward the preservation of the larger residential neighborhood to the south and west; (4) The City should establish a point at which strip commercial development along the west side of Wheaton Way will stop. He stated 44 advisory ballots were sent; 16 returned; 8 agreeing and 8 disagreeing. He recommended that if the rezone and vacation are approved the following conditions be made a part of the approval: (1) No vehicular access shall be allowed to Wheaton Way; (2) Access on Sylvan shall be located as far w&st as possible and shall align with the westernmost access to the Wheaton Mall; (3) Final access plan is to be approved by the City Engineer; (4) That this rezone be established as the westernmost extension of commercial zoning on the south side of Sylvan Way west of Wheaton Way; (5) That a landscape buffer of not less than 6 ft. in width be provided along the west and south property line. This buffer shall be further augmented by a solid fence or wall not less than 6 ft. in height on the inside edge of the landscape buffer toward the development. The landscape material should be of such species that it will mature into a dense visual screen. Existing vegetation along property lines with trunk dimensions over 4" in diameter should be retained and incorporated into final landscape plans wherever possible; and (6) That the site shall be developed essentially the same as the site plan. Mr. Attebery stated that the staff has some reservations regarding the last condition; that it relates To the bulk of the building proposed because it will be significantly taller and out of scale with the residential units which surround it. He stated negotiations should be considered to attempt to reduce the size of the structure. Commissioner Stewart stated he is concerned about the left-turn lane on Sylvan going onto Wheaton Way; that it isn't adequate now and any more traffic will only make the congestion worse. Commissioner Swanson explained there are some long- range plans for improvements to this area, but they are quite far in the future. Hea~ing recessed for bid openings. DENEND REZONE AND R/W VACATION HEARINGS (continued PROPONENTS: Bill Denend, representing the Harkins Place owners, discussed the background of Ha~kins Place and stated the homes on Harkins Place are not fit for residences because of the noise and traffic. He stated they are trying to put something compatible in this area; that this property cannot be residential. He stated they have the support of the surrounding neighbors and he distributed a petition with approximately 115 names supporting the rezone and vacation. He stated the proposal is designed for small retail shops and office buildings; that it will not be high traffic generating. Bob Green, 4230 Kitsap Way, architect for the proposal, showed slides of the general surrounding area. These slides are on file in the Planning Dept. He stated the property proposed for development is on a plateau by itself and it is separated from~esurrounding property by 16 ft. or more. He stated the trees act as a natural separation between Harkins Place and Olympic Manor. He stated that all the conditions recommended by the Planning Staff would be met if approval is given. He described the proposal and stated the building is set around an open court with a skylight; that it will be an all-weather type mini- mall and there will be 107 parking stalls. He stated the building itself is not bulky; that it is more in keeping with the residential neighborhood. Elizabeth Buell, 1722 High, stated she no longer lives on Harkins Place, but she lived there for 18 years. She stated it is too late to protect the homes on Harkins Place with a wall and it is time the rezone is granted. She stated this development will not create anymore traffic and it is unreasonable to expect people to live where it should be commercial. Fred West, Hansville, stated he is the owner of 3315 Harkins Place and he wants to go on record as being in favor of the rezone and vacation. No one was present to speak in opposition. Mayor Jarstad stated he would like to delay a decision for two weeks. He stated a good presentation was given today and he feels the Commissioners should give it serious consideration before making a decision. He discussed the lack of opposition from neighbors. Commissioner Stewart stated he does not think this will be the end of rezone requests in the area; that people on Herron will also want a rezone for the same reasons stated here today. He agreed that this was not a very desirable place for residential units and he would like to restrict fast-food restaurants. Commissioner Swanson stated Harkins Place is almost uninhabitable and he feels this development has pretty well addressed most of the concerns of the people in the neighborhood. Motion by Mayor Jarstad and Commissioner Stewart to postpone decision on rezone and right-of-way vacation until May 15, 1979, carried unanimously. OFFER OF GRANT AWARD Clerk stated the Offer of Grant Award presented last week was reviewed and approved by the City Attorney's office.
