it was the consensus of the Council that it is proper.

listed above, carried unanimously.
TAPE #157 LANCE HAYNES VARIANCE DECISION
(A) Ken Attebery, Planning Director, stated the Building Dept. re-analyzed the site
and plans and determined that the lower level is a basement and that changes
slightly the setback requirements, although it does not relieve them from any
of the variance requests. He stated the required setbacks for a three-story
structure are as follows: side yard, south, 6 ft. (proposed 2.57 ft.), Side
yard, north, 5 ft. (proposed .33 ft.) and rear yard, 6 ft. (prOposed O ft.).

Clerk read letter from Robert H. Green, dated May 3, 1979, attached to which
was a letter from George Plescher. She then read the letter from Mr. Plescher,
dated May 3, 1979, which stated this project conforms to the purpose add intent
of the zoning ordinance. These letters are on file in the Planning Dept.
Glenn Vockrodt, 1409 Marlow, stated the variance can be allowed as long as it
is not tantamount to a rezone; that this would be tantamount to a rezone. He
stated he thinks there are several legal questions that should be addressed.
Mayor Jarstad stated the site has been evaluated and he is not in favor of
granting the variances; that the area is very small for the number of living
units.
Motion by Mayor Jarstad and Cormnissioner Stewart to deny request for variances,
carried unanimously.
TAPE #157 BREMERTON HOUSING AUTHORITY PRELIMINARY PLAT
(A) 340 Clerk stated the hearing had been advertised, posted and letters of notification
mailed to residents as required.by law. She read Planning Corfmission Resolution
No. 528 recommending approval. She then read letter from Sheridan Neighborhood
Association, dated May 7, 1979, which stated the Sheridan Neighborhood Associa-
tion passed a motion at their regular meeting that they consider the plat to be
undesirable as submitted because the density would exceed the 5 units per acre
designated in their Neighborhood Plan for Medium/Low Density. This letter is
on file in the Planning Dept.
Ken Attebery, Planning Director, stated the location of the site is on the west
side of Pine Rd. and the proposal is for a mixture of single-family and duplex
units, with a total of 21 units. He stated there are two recreation areas and
the plat also indicates a screening easement 15 ft. in width along Pine.
PROPONENTS: ~.
Paul Pazooki~ Engineer representing Bremerton Housing Authority, discussed a
letter submitted to the Planning Commission which clarified the recommendations
of'their soils reports. This letter is on file in the Planning Dept. He
stated the proposed structures can be built on the site with no adverse effects.
He stated the slope of the site is such that there is no way the area can be
served with just one access; that some of the shrubs will be cut for the south
entrance.
OPPONENTS:
Vernon Bouton, 2960 Rickey Rd., stated the concept is all right; he is arguing
the issue of density. He stated that 21 dwelling units is the maximum allowed
by the 1966 Comprehensive Plan and the density is not in keeping with the
surrounding area. He stated he feels 18 dwelling units is the appropriate
density and he requested that the City Council set the density at 18 dwelling
units on the site.
Mary Wagner, 3521Rickey Rd., asked if the density was figured on gross acreage
or net acreage and Mr. Attebery replied his calculations were figured on gross
acreage. She asked why the Commissioners did not use the Neighborhood Plan
when figuring density rather than the 1966 Comprehensive Plan. Mayor Jarstad
explained that the 1966 Comprehensive Plan has been adopted and the City has
been working with the neighborhoods updating a comprehensive plan, but a new
one has not been adopted. Mrs. Wagner stated she is concerned about 43 children
in the development and stated she felt this was too many for 3.5 acres. She
stated further she would like to see a fence around the development to protect
the neighborhood from encroachment, especially on the west side; that the adjacent
property owners will be overrun with children. She stated further she believes
this development smacks of segregation and she feels the low-income housing
should be sdattered throughout the City.

Laura Bouton, 2960 Rickey Rd., stated she was concerned about the size of
the play areas; that the location was bad.
Nancie Wood-Mahan, Housing Coordinator for the Bremerton Housing Authority,
stated the play area in the middle' will be an active play area and the one
in the corner will be a passive play area with picnic tables, etc. She stated
this proposal has been cut from 30 units to 21 units to meet the Comprehensive
Plan requirements; that this proposal is to provide a housing opportunity for
low and medium income families. She stated further that this is not a cost-
effective development; that they are already three units short and to cut it
by three more units will cause more hardship. She stated that as far as fencing
the development goes, she does not think people should be walled in and she
prefers not to have it fenced.
Mayor Jarstad stated that most developments are fenced. Laura Bouton stated
they had fruit trees next to the development and they would like to have them
protected. Paul Pazooki suggested that a 15-ft. screening easement be placed
on the west side and Mr. Bouton, stated there are 12-ft. high blackberry bushes
there right now and he was hoping they would be retained as a natural fence.
Commissioner Swanson requested that a decision be delayed for a week or two
to allow him time to study the size of the play areas and have a closer look
at the whole layout.
Motion by Commissioners Swanson and Stewart to delay decision until May
1979 at 10:30 A.M., carried unanimously.
RESERVOIR NO. 19 - Completion of Work

complete, carried unanimously.
TRIMMING OF TREES AND SHRUBS BEHIND MR. LEICHTMAN'S HOME
Commissioner Swanson announced that the City E~gineer has recommended that the
City work with Mr. Leichtman and that the evergreen trees behind his home be
trimmed to provide a minimum width of 10 ft. 6 in.; that this should give 15 to
16 inches of clearance for Mr. Alford's camper/trailer. Mayor Jarstad suggested
that Mr. Alford be contacted to determine if this satisfies him.
Motion by Commissioner Swanson and Mayor Jarstad to make contact with Mr. Alford
and Mr. Leichtman and try to resolve the problem, carried unanimously.
Meeting adjourned at 12:O5 P.M.
