GREEN HEARING (continued)
Jim Root, City Engineer, stated he felt that the variance request and the short
plat are tied together. He stated he felt that very little could be built on the
northern lot; but the Planning Dept. informed him that as long as there was over
4800 sq. ft., it could be short platted. Mr. Attebery explained that with the
repair of the bulkhead, there would be sufficient land to build on this lot.
PROPONENTS:
Robert Green, 4230 Kitsap Way, stated he did short plat the prcperty, but he is
asking for a variance on the northern piece of property so he can build a single-
family residence for himself. He stated he has invested approximately $25,000.00
on this already. He showed slides of the property and stated people are using
the property for a parking lot. He stated he believes this piece of property fits'
all the criteria set forth for a variance and it is a reasonable permitted use of
the property.
Mr. McCluskey stated that the question before the Commissioners is whether the
irregular shape of the northern lot was caused by Mr. Green's own action in short-
platting the property. Mr. Green stated he did not know there was a 25-ft. setback
on the side, too. He stated he can see no zeason for the setback on the side; that
it was City a'~tion that caused him to short-pla~ the property; that the loss of money
from a~l the previous actions has been very severe.
Myrna Green stated the intent of the 25-ft. setback is to not block anyone's
view; that no one's view would be blocked if the.variance were approved. She
stated they have posted their property and have asked all trespassers to stay
away. She stated they will build something on this property whether the variance

OPPONENTS:

stated they will lose most of their view, but they don't own the view.
Clyde Osborn, 2457 Snyder, stated there is no visibility coming around the
corner; that it is hazardous for cars to pull out there. He stated he feels the
problem has been created by the approval of the short plat.
Gordon Stevenson, 2441Snyder, stated he is opposed to the variance; that Mr.
Green is a professional and he should have realized the setback requirements.
He stated that mistakes made in the past should not be magnified by making more
mistakes today.
Diane Mize, 2340 Sn~der, stated her main concern is traffic safety. She stated
she finds it hard to believe that a professional would assume that the 25-ft.
setback did not apply to both sides.

bulkhead is repaired. He stated that Mr. Green made his own hardship.

what was legel when they bought the property is no longer legal.
Myrna Green discussed the traffic and stated the view Qf traffic from their pro-
perty is better than further down the street. She stated that no view is being
blocked except for the property they own. She stated they are going to enhance
this property.
