Ken Attebery stated the revision process as outlined by Washington State Code does not require public notice or public hearings. He stated he received a letter last week requesting a revision and he notified interested parties that this would be heard today. He stated further that State law indicates that revisions in permits may be granted if they are within the scope and intent of the original permit; that of the 7 conditions which accompany the original permit, it is his feeling that all the conditions with the exception of #1 are being satisfied through the building permit and departmental review process. He stated that the change in site plan will affect #1. (#l reads: Major vegetation shall be retained where feasible, particularly along the north property line and in the southwest of the site.) He discussed the two site plans and stated both plans indicate 20 covered parking stalls and the use utilized by the original permit is not changed. He stated that the parking area has been reduced from 35 stalls to 26 stalls and this is still 6 above the minimum requirements. He stated the survey resulted in a finding that the lot area is 5.7% less than the area indicated on the original site plan; that the original plan indicates 40,893+ sq. ft. and the revised plan indicates 38,570 sq. ft. OPPONENTS: Phil Best, Attorney for Mr. Vockrodt, discussed building permits that were issued for a building design that is completely different from the one approved by the Shorelines ttearing Board and requested that those building permits be formally withdrawn. Mr. Attebery explained that he has indicated to Mr. Ostrom that his building should be ceased until this process has been completed. Mr. McCluskey stated that issue is not before the Council at this time and only the revised plan should be considered. Mr. Best stated that the plan that is before Council is much more in conformance with the Substantial Development Permit that was approved than the plan for which building permits were issaed. He stated lurther that Mr. Vockrodt has some difficulty with his view because the new plan has a three-story structure. He discussed the parking spaces and stated some of the cars will have to park on the street and the cars parked in the SE corner w~ll have to back out into the street to exit the parking lot. tie requested that the City Council visit the site before rendering a decision. Mr. Ostrom stated he has already spent a considerable sum of money on this project because it was approved and it would work a hardship on him if he has to go through more hearings.
