Ms. Van Hoover stated she has no knowledge of the keypunch register, but she knows there are qualified applicants on the office assistant register who have worked for him as extra help. She stated tbat these people have been de[ermined by Commissioner Stewart to be qualified, and to say there are no qualified people left on the register is not true. She read Planning Commission Resolution No. 507 recommending denial of rezone request from "C" and R-2 to B-3. She stated 17 advisory ballots were sent, 8 rett~rned with 5 disagreeing and 3 agreeing. She then read letters from Chizuko Swan, E. M. Beach and R. E. Greenwood in opposition to the rezone. Commissioner Stewart stated he is selling property on Preble St. and he asked Mr. McCluskey if he should step down due to a possible conflict of interest. Mr. McCluskey asked if anyone present objected to Commissioner Stewart's presence, and no one objected. Ken Attebery, Planning Director, discussed the proposal and stated the site consists of three lots, one of which is presently zoned for commercial use. He stated the 1966 comprehensive plan indicates high density residential; that traffic impact would be light. He stated the Planning Dept. recommended approval of rezone to B-2, rather than B-3, subject to conditions, but the Planning Commission recommended denial. PROPONENTS: Jim Simpson, 13047 Westbrook Dr. SW, Port Orchard, stated he has a shop in the County where his equipment will be stored and this building will be used for an office only. He stated the amount of traffic will not be increased because his business does not generate much traffic; that most of it is done by telephone. Commissioner Stewart asked if he would consent to a rezone to B-2 rather than g-B, and Mr. Simpson replied yes. OPPONENTS: No one was present to speak in opposition to the rezone. Discussion followed and it was the consensus of the Commissioners to postpone making a decisiou until next week to allow them to view the property. Mayor Jarstad stated he felt the City is short of commercial property and this is a good area for low-density business. Commissioner Stewart stated maybe rezon~ng to B-2 with the restrictions suggested by Mr. Attebery would improve the area. Commissioner Swanson stated he felt storage of equipment should also be pro- hibited. Motion by Mayor Jarstad and Commissioner Swanson to postpone decision until next week to allow the Commissioners to view the property, carried unanimously. She read Planning Commission Resolution No. 509 recommending denial of the variance. She then read letter from Nick Garguile, dated Dec. 23, ]978, appealing the decision of the Planning Commission denying the variance to allow removal of wheel stops from the parking lot at Noab's East Grocery Store. Ken Attebery, Planning Director, stated the applicant is requesting a variance to Section 717 of the Zoning Ordinance which calls for wheel stops to protect landscaping and structural appurtenances at off-street parking areas. He stated the wheel stops had prevented vehicles from driving straight onto Pitt Ave. He explained that the wheel stops were removed; the violation noted; enforcement was attempted; and an application for variance resulted. Discussion followed regarding cars exiting onto Pitt and Mr. Attebery stated the wheel stops give pedestrians assurance that the cars will not run them down. Mayor Jarstad stated it is also a problem when shoppers walk behind cars in the parking lot. He stated he has very strong feelings about this particular situation because a petition with over 900 signatures has been presented asking that the wheel stops be removed because it is more convenient for them. Mr. Attebery stated that this facility existed as it was with the wheel stops for a number of years; that it is no doubt more convenient for the customer, but it presents a tremendous hazard for pedestrians and v~bicles on Pitt. Commissioner Swanson stated the City's responsibility is to protect the pedestrians who are on the sidewalk. PROPONENTS: Nick Garguile, Star Rt. l, Box 307, stated he requested the variance to remove the wheel stops and allow a more orderly exit and entrance from his grocery store. He discussed accidents that were caused by people backing into one another in the parking lot before the wheel stops were removed and stated there have been no accidents since they were removed. He stated that until the wheel stops were removed~ they actually lost money and were not paying their operating costs due to the inconvenience to the customers in belng able to get in and out of the parking lot. Commissioner Swanson asked questions regarding the wheel stops along the building and Mr. Garguile stated they were put in to prevent damage to vehicles and the building itself. Commissioner Swanson stated that cuts down on the use of the parking lot; that a 2x14 bumper guard could be installed and that would serve as protection for cars and the building. OPPONENTS: Glenn Vockrodt, 1409 Marlow, stated the parking lot configuration has been changed so it is an illegal parking lot. He discussed pedestrian safety and stated the purpose of sidewalks is to provide a place where the public can walk and feel secure from cars. He stated hefelt the parking lot should be brought to present-day standards. He suggested parking on one side only and have only one entrance and one exit. Arnold Grubb, 1133 Pitt Ave., stated he and his wife walk along the sidewalk often and many times cars are parking on the sidewalk and they have to walk in the street. He stated he thinks it is a very dangerous situation. Agnes Grubb, ]133 Pitt Ave., stated there is a large parking lot across the street that shoppers can use. She stated that cars come down Pitt very fast and she thinks it is very hazardous. She stated she was opposed to the variance. Mr. Carguile stated he intended to put in a speed bump along Pitt Ave. so cars won't park on the sidewalk. He stated that if the variance were approved, he' would not allow trucks to park on the side. He stated further that the parking lot across the street is over a very rough road and his customers do not want to park there. -5- CITY COMMISSIONERS' MINbfES January 23, 1979 Page six Jerome Alfred, 1728 Gregory Way, suggested having head-in parking on one side and parallel parking on the other side. He stated his concern is if the wheel stops are removed, the hazard of a car hitting a small child is increased. Commissioner Swanson pointed out that there is a parking lot across the street that can be utilized. tie stated tha~ cars have been parking almost consistently on the sidewalk since the wheel stops were removed; that they were removed without a permit; and there are other effective ways of preventing damage to the building other than the wheel stops that have been installed. Motion by Commissioner Swanson to deny variance appeal. Motion died for lack of second. Commiss[oner Stewart stated he wants to look at it and see if there are some alternatives; that he does not want to see an empty store. A lengthy discussion followed regarding different ways to solve the problem and Commissioner Swanson suggested removing the curbing along the building, installing a 2x14 bumper guard and implementing one-way traffic. He favored exit from ttarkins rather than the entrance due to the heavy traffic coming off the bridge. Motion by Commissioner Swanson and Mayor Jarstad to delay decision for one week to allow the Commissioners to look at the parking lot and discuss the alternatives with the Engineering Dept., carried unanimously. PROPOSED CHANGE ORDER - PINE ROAD INTERCEPTOR PROJECT Commissioner Swanson presented a proposal trom Hanson Excavating Co. for their negotiated price for the construction of a sanitary sewer on Sheridan Rd. from Rickey Rd. to Lebo Blvd. Hanson is the prime conttactor for the Pine Road Interceptor and this change order was requested in the amount of $26,786.26. Jim Root, City Engineer, explained the need for this change order at this point of time in the Pine Road Interceptor construction. Discussion followed as to whether a change order of this amount would be legal. Motion by Commissioner Swanson and Mayor Jarstad to approve change order, subject to review and approval of the City Attorney's office, to be paid from C.R. Sewer Improvements Fund, carried unanimously. BILLS Motion by Mayor Jarstad and Commissioner Swanson to give blanket approval to vouchers 8330 thru 8333 inclusive in the amount of $~8,721.83 and vouchers O~ thru 0~ inclusive in the amount of $81,727.57, audited by John Ross, carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, Abstain; Commissioner Swanson, Yes.
