She stated advisory ballots were sent twice: 33 sent the 1st time, 7 returned with 7 disagreeing; 33 sent the 2nd time, 10 returned, 9 against and l for. She presented letters from Linda Cocbran requesting an evening hearing and letter from John S. Tracy favoring low income housing. She then presented letters of opposition from the following: Vernon W. Bo~lton, Mrs. Keith Hansen, John & Barbara Mills, A1 Fox, Virgil Slade, Ernest C. Stel[ing, A. J. Zurbrugg, Mrs. E. J. Braendlein, Pat Carey, W. D. & Margaret Fountain, Walter & Christens Bower, Anita F. Schaa[, Mr. & Mrs. Henry Pomerenk, and Sandra L. Binz. These letters are all on file in the Planning Dept. -6- CITY COMMISSIONERS' MINUTES February 27, 1979 Page seven Ken Attebery, Planning Director, summarized the findings of the Planning Commission and presented a new site plan submitted by the Housing Authority. He pointed out a driveway around the site which is of concern to the Fire Dept, because it might be used for parking and emergency vehicles must have access to the buildings. Mayor Jarstad stated that he owns property close to the proposed development and he asked if anyone [elt he should step down due to an appearance of fair- ness. Linda Cochran, attorney for Mr. Bouton, stated she objected, not to his ownership of property close to the proposed development, but on the issue that it has been prejudged. She stated she is not suggesting that the Council has done anything improperly; she does not want to waive her clients' rights because these questions were not raised at this time. Jim Root, City Engineer, discussed the carrying capacity on Pine, sight dis- tances and trip generation. He stated there are 9.72 trips generated per unit per day, 292 trips generated for 30 units per day; the average week day traffic on Pine is 3,514 vehicles per day. He stated that Pine Road is being used as the Wheaton Way bypass and by 1985 there will be an average of 9,350 vehicles per day. He stated the situation is not ideal for making a left turn from either the north or the south drive as far as sight distance goes. Discussion followed and Vernon Bouton, 2960 Rickey Rd., stated it is predicted that Pine will be 4-Iane soon. Mr. Root stated the City has no plans in the next 6 years to widen Pine Rd. to 4 lanes. Brook Snyder was concerned about the play areas and possible tennis courts, along with traffic on Pine. Barbara Conley asked if sidewalks would be put in and Mr. Root stated there would be no objection to sidewalks if the Housing Authority wanted to develop them. Don Proctor, Wastewater Superintendent, discussed the sewer system and stated overflows can occur at any time. He pointed out various drainage areas on a map and stated both treatment plants provide primary treatment only. tle dis- cussed secondary treatment and stated when Step II Grant Funds are received, the new facilities could be operational in three years time. Gene Berthoil, 422 E. 31st, asked what the impact of this development would be on the existing treatment plant and Mr. Proctgr stated percentage-wise, it is very small. Owen Tripp, 3030 Pine Rd., questioned adding any more units to the sewer when the Elks were turned down because it was overloaded. He asked what has taken place that it is new suitable to add additional sewage to this system. Mr. Proctor replied that it involves an Outside Utility Agreement. Mr. Tri. pp asked if the Bremerton sewer system is operating witbio the EPA guidelines and Mr. Proctor answered . the City is in compliance only hecause court orders have been issued by DOE which recognize that the City is underway to get a new treat- ment plant built. PROPONENTS: Gerald Matosich, Attorney for the Bremerton Housing Authority, went through the Planning Commission's findings point-by-point and discussed each one in detail. He stated this rezone request was made for design purposes; that it is requested not to circumvent density; that they feel this is the best use of the land. He stated they have taken a very positive approach and not a negative one to use this land to its best advantage. tle stated further they are concerned about density and because of that issue and time factors and funding requirements, they are prepared to propose that it be developed with less units than 30; that they are willing to reduce the number to 26 units. lte stated this would be 7 units per acre; that the present task force is working on a new comprehensive plan and new medlum-low density is 7 units per acre under special circumstauces. Bill Frazier, Architect, stated each unit will be approximately 1,1OO sq. ft. and they do not intend to put in tennis courts or a swimming pool. He stated the play areas were moved to keep the wooded areas intact. lle stated two fire hydrants have been added at the request of the fire marshall and they have kept all the vegetation and trees possible. -7- CITY COMMISSIONERS' MINUTES February 27, 1979 Page eight Mr. Matosich presented a petition signed by approximately 108 individuals supporting the rezone request for low-iDcome housing. Edna Carson, 3115 Rickey Rd., asked where the people live who signed the petition. Commissioner Stewart stated that some of them do live in the surrounding area, but the majority of them do not. Ms. Carson stated she does not think it is any of their concern; that it is the concern of the people who live in the area. She stated it does not seem fair to have that much congestion on such a beautiful location. Mr. Matosich explained that the petition was signed by interested parties who are interested in seeing low-lnc.ome housing properly developed. Ruth Ghrist stated she lives in low-income housing in Westpark and there is a need for additional housing in Bremerton for low-income. Barbara Conlcy agreed that there is a need for low-income housing, but she stated she felt this property was inadequate. Meeting recessed from 9:02 P.M. until 9:15 P.M. OPPONENTS: Linda Cochran, Attorney for neighbors opposing this rezone, stated they are not opposed to low-income housing; they are opposed to the rezone. She stated this area is now a single-family, medium/low density area. She stated that before the Housing Authority bought the property, they knew it was zoned R-I; that they should have looked for property already zoned R-2 for their project. She stated this would be classic spot zoning if it were approved and it is not in accordance with the comprehensive plan; that the comprehensive plan indicates 4-6 units per acre. She stated further that the potential indicates the possibility of 50 units on this property and there is nothing to prevent the Housing Authority requesting more units at a later date if it is rezoned. She addressed Mr. Matosich's presentation and stated the sewage system is not adequately processing sewage. She stated it is not fair to fezone this property because the residents of the area bought their homes and they want it to remain R-1. Brad'Gehring, 3020 Pine Rd., stated he lives across the street from the proposed development and traffic is very bad; that it is difficult for him to back into the street at times. He stated it is dangerous for people to walk along Pine and it would be even more dangerous for children going to and from school. Vernon Bouton, 2960 Rickey Rd., spoke of the steep grade on the property and stated it would be difficult for people to walk from the parking area to thelr homes because of the grade. He stated the parking lot is too far from the living units. He stated the proposed deve]opment is completely out of character with the surrounding area; the density is higher than the comprehensive plan; this would be a spot fezone; and it is opposed by the surrounding neighbors. He asked that the Commissioners deny the rezonc. Craig Powers, 4049 Pine Rd., stated that the boundary shown on the site plan goes through his property. Nancie Wood-Mahan, housing coordinator for the Bremerton Housing Authority, explained that there was a mis-survey years ago and it can be solved through a quit claim deed; that the Housing Authority has no intention of taking any of his property. Lorna Bouton stated that if this were rezoned, ~t would set a precedent for additional rezones to R-2. A1 Fox, 2821 Pine Road, stated he is agains.t the rezone. Mr. Matosich spoke in rebuttal and stated there are multi-family developments in the area and this would be better than duplexes. He stated this is a needed subsidized housing program; that they have never mentioned putting 50 units on the property. Ms. Cochran stated it should stay R-] west of Pine; that if it were rezoned, there is nothing to prevent the Itonslng Authority from coming in and requesting permission to build more units. -8- CITY COMMISSIONERS' MINUTES February 27, 1979 Page nine Mayor Jarstad discussed the work the Housing Authority has accomplis~ed in providing housing for many people and stated they have done an outstanding job meeting these needs. He stated he is not against planned unit develop- ment but h~ feels they should follow the wishes of the neighborhood. Commissioner Stewart stated he will vote against the rezone because the Sheridan Neighborhood is against it, there were so many letters of opposition, Planning Commission voted no and most of the testimony was against it. He stated that this Council has never been against low-income housing. Commissioner Swanson discussed storm sewers and stated that treatment plants are flooded by rain, not by sewage. He stated the problem is not with the capacity to treat sanitary sewage; it is the capacity to treat storm water. Motion by Commissioners Stewart and Swanson to follow recommendation of Planning Commission and deny fezone, carried unanimously. Meeting adjourned at 10:50 P.M. Kathleen L. Mandio, City Clerk Approved: adG1 K J t -9-
