SUMMARY: David P. Horton is currently handling most of the City's litigation. The current
contract with Mr. Horton expires March 31, 2006. An Assistant City Attorney has been hired and is
scheduled to begin work on June 1, 2006. The proposed professional services agreement amendment
extends Mr. Horton's contract through May 31, 2006 in order to maintain continuity of representation
for the City until the new in-house attorney arrives. It further amends compensation from a monthly
retainer to hourly commencing June 1,2006.

FISCAL IMPACTS (Include Budgeted Amount): A budget adjustment to reallocate funds from the
City Attorney's Office and Risk Management Fund personnel costs to legal professional services and
risk claims payments is required to fund the contract extension.

Move to approve the Professional Services Agreement Amendment between the City of Bremerton
and the Law Office of David P. Horton, Inc.,P.S. and authorize the City Attorney to finalize and
execute the agreement with substantially the same terms and conditions as presented and further to
authorize a budget adjustment to reallocate the necessary funds within the City Attorney and Risk
Management funds to fund the contract extension.
