PUBLIC RECOGNITION
John Tracy, Attorney with Evergreen Legal SerVices and representing ACLU, was
present and stated he was concerned about three areas of the Criminal Code. He
questioned the ordinance regarding distributing handbills and stated it is very
vague and should be better stated. Mr. McCluskey suggested that he discuss this
with Mr. Olbertz for clarification. Mr. Tracy discussed Disruption of School
Activities and stated there are other statutes which apply to this and it is very
vague. He asked that this portion be stricken. Mayo~ Jarstad stated there is a
serious problem around schools; that the police are called out many times because
of the disruption of school activities. Mr. Tracy discussed Offenses Against
Public Morals and stated he is against the entire statute because there is an
incredible problem of enforcing it. A lengthy discussion followed regarding
pornography and Mr. McCluskey suggested that'Mr. Tracy discuss these points with
Mr. Olbertz.
TAPE #154 LID 3~2 HEARIN~
(A) 1615 Clerk stated the hearing had been advertised as required by law. She read letter
from Ronald D. Henderson objecting to LID 322 because the alley is being used as
a public street and traffic not obeying the posted speed limit.
Jim Root, City Engineer, explained that LID 322 was approved in 1977 and this
is the hearing for the acceptance of the final assessment roll.
Gerry Thornburgh, Office Engineer, stated the total cost is $6,638.98 and front
footage cost is $8.71 a front foot.
Ron Ireland, 1521 Warren Ave., presented a letter signed by Willard Page, dated
March 19, 1979, which stated that traffic is being routed through the alley as
though it were a street and no assessment should be attached to their utility
bills. Mr. Ireland stated the alley was originally set up as an entrance to their
homes but it is used as a street now that it has been paved. He stated he feels
everyone should pay for it, not just the few who live there. Mr. McCluskey
explained that it is more of a traffic and police problem and it will have to
be resolved by the Traffic D~vision; that this is a hearing on the final assess-
ment for the LID. Commissioner Swanson stated that the resolution would be to
open Chester or some other access around the college. Mr. Ireland stated it is
posted lO mph now, but no one drives that slowly through the alley. Commissioner
Stewart stated the Police Dept. should look at it and try to enforce the speed
limit. Mayor Jarstad stated the City can only work to enforce the speed limit;
that it is a public alley. Mr. Ireland asked if it could'be made one-way ~nd
Mayor Jarstad stated that suggestion would be evaluated.
