He summarized the circum- stances surrounding the request for vacation and stated it is a parcel 100' x 40' in size and is a portion of right-of-way on the north side of Kitsap Way, approximately 80' west of Weslon Place. He read.the Department Reviews and stated if the vacation is approved, the following conditions should be required: (1) The City shall require compensation for the vacation R/W as provided in RCW 35.79.030 and (2) Easements be retained for existing utilities, namely Puget Power facilities. Commissioner Swanson stated it is a maintenance problem removing brush and weeds from these azeas and if people can use these pieces of property, they should be returned to the tax roll. He stated he feels the City should be reimbursed. Joe Mentor, 8567 Tracyton Blvd., stated he has no objection to this vacation; but he feels there shculd be a restriction that it be used for parking only. Greg Shildm~er, 905 Weslon, stated he wants to build a garage or car shed, but it will be behind his house. He stated this is a useless piece of pro- perty and of no use to anyone. TAPE #156 MENTOR RIGHT-OF-WAY VACATION (A) 2233 Clerk stated the hearing had been posted'and advertised as required by law. Ken Attebery~ Planning Director, presented Planning Commission Resolution No. 526 recommending denial of the vacation. He stated the Planning Commis- sion recommended denial for the following reasons: (1) Encroachment with private development on public right-of-way prior to requesting vacation, and (2) Community opposition to the vacation request and.suggestions that the right-of-way could be used for other public uses. He stated that if the -4- CITY COMMISSIONERS' MINUTES April 24, 1979 Page five Council chooses to vacate the right-of-way, the following conditions should be required: (1) The City require compensation for the vacated right-of- way as required by RCW 35.79.030; (2) The applicant submit engineering design drawings of the improvements placed in the right-of-way to the City Engineer for his approval; (3) Erosion control shall be established on the slope areas; and (4) Erosion control shall be establishe~ at the catch basin which is located 200 ft. north of the motel entrance. Mr. Attebery discussed the Department Reviews and stated the area requested for vacation is a long, narrow strip approximately 530 ft. lcng. He stated a number of years ago a small portion of right-of-way was vacated in front of the Family Fitness Center and this extended to the front of the motel. Joe Mentor, 8567 Tracyton Blvd., stated a piece of property had been purchased from the Family Fitness Center and that is why that vacation extended up to his property. He stated he does not think this strip will be beneficial for anything else, only for parking for his facility. Jim Strait, 6530 Harlow Dr., stated he was representing the Kitsap Lake Neighborhood Association. He stated the Association was opposed tc this vacation. He stated this is a sizable strip of land that could bemused for other purpcses, such as a frontage road. He suggested that the City deny the application for vacation and lease the property to Mr. Mentor. Mayor Jarstad stated it has always been the City's policy to not vacate the property along Kitsap Way because it should be available to the public for public parking. He stated there have been improvements made on the public right-of-way, but it is still for public parking for the people who utilize the facility; that he does not think denying this would impair the utilization of that property. He stated he feels the C~ty should maintain the right-of- way because it might be needed in the future. Mr. Mentor requested that a portion of the vacation be granted~where the portico has been built into the right-of-way. Co~missioner Swanson stated he felt it should be vacated up to the 70 ft. line from the south, which would make a more uniform line. Mayor Jarstad stated that portion should have been vacated with the original vacation for the Family Fitness Center and Mr. Attebery explained that application was originally made for the entire porti0n~ but Mr. Mentor asked that this portion not be vacated because there was an access road coming through at that point. Motion by Commissioner Swanson and Mayor Jarstad to approve right-of-way vacation to the 70-ft. line from the south and the City require compensation for the vacated right-of-way and deny the remainder of the vacation, carried unanimously.
