He stated he feels some more consideration should be given to this and he hopes some compromise can be reached. Commissioner Swanson stated his main concern is pedestrian safety; that it is very difficult for pedestrians to cross such a wide driveway. He stated if this were approved, the City could watch' to see if the sidewalk were broken up by cars driving across it and if it does not break up, there would be no need to enforce it to 6 inches. TAPE #150 (7~mmissioner Swanson stated the purpose o£ the meeting tonight is the cons~dera- (B) ]407 tion of the joint Bremerton/Kitsap County Housing Rehabilitation Program Proposal. Ken Attebery, Planning Director for Bremerton, introduced some ut the agencies that have been invo]ed and presented the interlocal agreements between the City/C¢~unty/Housin~ Authority. He asked if the Commissioners wanted him to read the resolution or continue without reading it. Motion by Commissioner Stewart and Commissioner Mahan to continue without reading the resolution, carried unanimously. Mr. Attebery then gave the background on the Block Grant Program and intro- duced Dwight Edwards, Director of Housing Rehabilitation Program. Mr. Edwards went through the Interim Bremerton/Kitsap County Housing Rehabilita- tion Program Description and Operations Manual step-by-step. This is on file in the City Clerk's office. Commissioner Stewart stated that many contractors that do small jobs, like the ones to be done under this program, are not bond- able and i~ a performance bond is necessary, the bids may be higher than anticipated. Mr. Edwards stated they will try to help contractors get a performance bond. He stated they want to send the jobs out in packages o~ 10 or so twice a month and this will encourage contractors because there will be more jobs to bid on. Commissioner Lobe stated this is a needed program, but one concern he has is that many times the grants and loans don't go to people who need them the most. He stated he would like to have some kind of report monthly that indicates the value of the house before rehabilitation, cost of the repairs, what kind of repairs were done and the value of the house after rehabilitation. He stated he would like to see this program continued; that the dollars should come back to this program so someone else can be helped. Discussion was held regardin~ grants and loans and Mr. Edwards stated that only 1/3 of the grant money would go for grants, the other 2/3 would go for loans. Commissioner Lobe stated this is the first chance they have had to perpetuate a program like this and if some of the money is paid back every year, then more people can be helped. Discussion was held regarding fraud and scandals in the program and Commissioner Stewart stated the program should be audited and checked by someone who is not involved. Mr. Edwards stated there will be monthly reports distrib~ted. He stated that they have to document everything they do. Commissioner Stewart asked if someone was going to make an audit of the program and Mr. Edwards stated the Federal Government should audit it. Commissioner Mahan asked it there are checks and balances within the program and Michelle McFadden explained that both the City and the County will have building inspectors inspecting these jobs; that they will be able to verify the work being done. Mr. Edward stated they have a housing inspector. Commissioner Mahan requested that a method for setting up a check and balance system be developed. Commissioner Lobe stated this was important so the Commissioners could answer to the people at a later date if necessary. -4- CITY COMMISSIONERS' MINUTES February ]3, 1979 Page five Mayor Jarstad asked if the two-year lien could be changed to a five-year lien on the property of the grant recipient and Mr. Edwards explained that this was a recommendation from the Charleston/National Neighborhood Council. Commissioner Lobe stated again that he is still concerned about outright grants. He stated he felt grants should be a very small portion of the program. Mr. Edwards stated that $120,OO0.OO is allocated for grants and the rest is allocated for loans. James Skirving stated the property must be appraised at sometime; that FHA and VA used a field appraiser. He stated the State law requires that all contractors be bonded. Mr. Edwards stated they will get highly reputable contractors. Lyle Robards discussed the time frame and stated the program was supposed to be on the way by Feb. l, 1979. Ms. McFadden explained that there have been some delays and they did have a commitment to get it started by Feb. 1st. Mr. Robards then asked where the money that is returned from the loans would go and Ms. McFadden explained that some of it would end up back in administ~h tion. Mr. Sharp asked if the City and County would have to pay back money that into sidewalks and streets since the individuals will have to repay any mon~,- that goes to improve their homes. Mayor Jarstad stated that sidewalks and streets are for the general public and a house is private; that there ~ difference between private ownership and public ownership. Mr. Robard that elderly people do not want to have a lien placed on their property their children might have to pay off in case of tbeir death. Bert Gegner asked how renters would be able to rehabilitate their homes and Mr. Edwards explained that they are trying to utilfze Federal 312 funds for this purpose. Colleen Donley, Bremerton Block Grant Coordinator, gave re¢ommendatio,s from Smith Neighborhood, Charleston/National Neighborhood, Block Grant Citizen Advisory Committee, Phoenix Group, Bremerton Planning Dept., Kitsap County Dept. of Community Development and Dwight Edwards. These are on f~le in the City Clerk's office. 0elf Hosed stated that since the va]ue of the improvement decreases with each year, the payment should also decrease. Mayor Jarstad stated that a depreciati< schedule is not a bad way to go. Commissioner Horsley asked if plumbing and electrical fixtures would have to be brought up to code and Paul Hoskins stated that any work they do on a house will have to be brought up to current standards: that if the existing fixtures are not touched, they will not have to brought up to current standards. Lyle Robards stated he felt the grant is being pushed into a corner and the neighborhood groups have said they need some grants the first year to get this program going. He asked who would collect the loans and Ms. McFadden stated a program would have to be set up for collection of the loans. Mr. Robards stated that elderly people don't want to leave their children any more debts and some grants are necessary. Commissioner Horsley stated that no one would lose any money; that they will get the value of that house plus any improvements that have been made. Edna Marshall stated there are many people who need only a small amount to improve their homes and make them more comfortable and livable. She stated she does not like the word "charity"; that she does not think it Js charity to give these people some money to make their homes more enjoyable. Commissioner Lobe stated maybe those small amounts should be total grants. He stated that if they want to make this work over a long period of time, they have to have this money repaid so others can be helped too. Commissioner Horsley stated there is another program called the "Home Repair Program" which m~ght be more appropriate ~or these improvements. -5- CITY COMMISSIONERS' MINUTES February 13, 1979 Page six Commissioner Lobe stated he felt that a five-year lien with a 20% write-off on the lien each year up to the 5th year is a good compromise for the grants. Commissioner Horsley discussed apprecRation and depreciation and asked if it would be difficult to differentiate between the two. Mr. Edwards replied no. Commissioner Lobe stated that the 20% write-off would take care of the deprecia- tion. Mayor Jarstad agreed that this is a good compromise. Commissioner Mahan stated they are talking about ~5 loans at the maximum and he cannot believe there are 15 families who would turn down a deferred loan. He stated that money has to be made available to others if they are going to keep the program going. Mr. Robards stated there is no guarantee this money will be used for more loans; that they want grants the first year in order to get the program moving. Commis- sioner Maban stated the money will go right back into this program minus any administration costs. Flu Swope stated she is a low-income person and her concern is her retarded son. She stated she would like him to be able to stay in their home after she is gone. Commissioner Mahan stated that these kinds of situations would be looked at and special consideration given. Brook Snyder spoke of the work the neighborhood participation groups have done. He stated that tonight is the first that he has seen any of the recommendations aT, d he feels many of the group's ideas are being overridden. He stated the whole. program is getting out of balance; that either the neighborhood participation grc~ups continue to participate or maybe it is better that they step out and not ca~se so much confusion. Commissioner Lobe explained t~at each one of these recommendations will be given careful consideration and there will have to be a ~ompromise. Mark Cross, County Community Development Block Grant Program, stated they felt all the recommendations were worthy of the Commissioners' consideration. Motion by Commissioner Mahan and Commissioner Stewart that the Interim Bremerton/ Kitsap County Housing Rehabilitation Program be adopted with the following modifications: Block Grant Citizen Advisory Committee: ]. Page 3 under "Grant Requirements"---Define liquid assets as bonds, securities, and cash. 2. Page 4 under "Eligible And Ineligible Costs"---Add an appeal process and a review committee. The review committee would have the power to approve exceptions. 3. Page 5, first paragraph---Clarify that "Assistant Financing" expenses are covered by a contingency fund and are not included in the loan or grant amount. Charleston/National Neighborhood Council: Page 1 under "Definition of Grant"---A five-year lien would be required on the property of the grant recipient rather than the program's proposed two-year lien with a twenty percent (20%) write-off on the lien each year up to the fifth year at which time the lien would be dissolved. It was felt this would provide more protection against abuse of the program. The Phoenix Group: 1. Deferred Loan - Schedule 1I A 0% interest Deferred Loan, which is due in twenty years or when the property is sold or condemned, the owner(s) cease to reside in the home, or upon the death of the homeowner. For those households not on fixed income, a payment schedule will be established to start two years after completion of the rehabilitation, and to run no more than twenty years. The schedule will be established based on the household's ability to pay. Payment according to the schedule may be deferred or forgiven if there is an inability to pay. 2. Page 3, Section IV: Define the Project Rehabilitation Standards as the minimum standards of the Uniform Housing Code with the exception of the ceiling height and room width requirements,in the chapter on space standards. -6- C1TY COMMISSIONERS' MINUTES February 13, 1979 Page seven 3.
