HEARINGS - Harkins Place Rezone and R/W Vacation Continuance and Islam Rezone and Change in Land Use Restrictions Motion by Mayor Jarstad and Commissioner Swanson to hold hearings in orde~ listed above, carried unanimously. HARKINS PLACE REZONE AND R/W VACATION CONTINUANCE Clerk stated this hearing has been~continued and she has received nonew cor- respondence. Dorothy Smith, Admiqistrative Assistant, explained the proposal and stated the site is located at the corner of Sylvan Way andWheaton Way. Bill Denend, attorney for the applicants, distribhted copies of the site plan and stated it will be a concrete steel building and the only entrance and exit for traffic is from Sylvan Way. He stated there are pedestrian entrances from Wheaton Way. He stated the design emphasizes buffering between the proposal and the adjoining property; that there will be an 8-ft. wall on the west and south with a hedge on the inside. He stated further that all shops will be contained in the building and it is a mall-type structure. Discussion followed between Commissioner Swanson and Mr. Denend regarding the proposal and Mr. Denend stated they will meet all criteria of the City in developing this property. Mr. Harris, architect, stated they want to conform in every way with the City code. PROPONENTS: Elizabeth Buell, 1722 High Ave., stated they have tried to do everything that was requested to protect the neighbors. She presented a petition with signatures of the majority of the property owners that approved removal of the covenants. OPPONENTS: David Warham, 1111Dibb, presented a petition opposing the rezone and removal of the covenants. He stated he feels if HarkiDs Place is rezoned, it will open up the whole area for rezone and he wants it to remain residential. He stated he does not want any more business in Olympic Manor because it would create more traffic and noise. William F. Lewis, 1120 E. 33rd, stated he is opposed to the rezone and he thinks it is still a pretty nice place in which to live. Mrs. Brownhill, 1109 Dibb, stated that people closest to the proposed rezone are against it; that Harkins Place is part of Olympic Manor. -5- CITY COMMISSIONERS' MINUTES October 10, 1978 Page six Evelyn Hill, 3230 Herren Ave.~ stated she is against any more commercial development in this area; tha't there is enough traffic in the area already. Mrs. Buell read from the covenants and stated the signatures she obtained were in favor of removing the covenants and also in favor of the fezone. She stated the neighbors would be better off because the building itself would be a sound barrier. She spoke of the green belt being removed and stated the residents of Harkins Place have no sound barrier at all. Mrs. Brownhill stated there are trees and shrubs all along that highway from Dibb to Harkins Place and it is a good place to live. Mrs. Hanson, 3308 Harkins Place, stated that when the highway was extended, the City took their green belt to widen the street. She stated 25,000 cars come over the bridge and 80% come by her place; that there is no buffer zone and the traffic and noise continues day and night. Kathy Pruitt, 3305 Harkins Place~ spoke of the danger to children due to the traffic and stated someone has to accompany her daughter to the school bus to make sure she doesn't get hurt. She also spoke of the difficulty in getting out of Harkins Place because of the traffic. Mr. Denend stated this proposal is the best utilization of the property and it will provide the City and the area with another facility to house some of the commercial business that is coming into the area; that the noise generated by the businesses will be confined in the building. He stated they have met the criteria that was established and he urged the City Council to approve the rezone. Ralph Hanson, 3308 Harkins Place, stated they want to beautify this corner and he thinks this proposal will be beneficial to the community. He stated they have already lost part of their p~operty and he thinks they should be allowed to get out of there. Chuck Denend stated they have a letter from the Sheridan Neighborhood which supports this rezone. He stated that most of the complaints have been against the traffic that is already there and their businesses will use the existing traffic. Mayor Jarstad spoke of the difficulty in making a decision; that there is a very strong feeling from the neighborhood that they do not want any further rezoning in this area and at the same time there are three corners that are already zoned business. He stated the Planning Commission has denied this rezone request on a policy decision. Commissioner Swanson stated that one of the problems is projecting wh~t will happen if this rezone is denied and what will happen to the residences in that area. He stated he does not feel those residences have any viable value unless there is a sound barrier built. Commissioner Stewart stated he would like to see something done, but the thing that bothers him is that the applicants did not bring in the plan until 10 minutes before the hearing and he thinks it is unfair to have these people cQme down to so many hearings. He stated the applicants had plenty of time to submit their plans before today and for that reason he will vote no. Discussion followed and Mayor Jarstad stated it comes down to either sustaining the decision of the Planning Commission or not sustaining it. Motion by Coramissioner Stewart and Mayor Jarstad'to sustain the decision of the Planning Commission and deny the rezone request. Under discussion: Commissioner Swanson stated there are two things that should be noted: (l) The Planning Staff reluctantly thought this should be rezoned with the proper restrictions, and (2) At the time the Wheaton/Sylvan intersection was ~esigned, it was assumed that this would go commercial. He stated he thinks the City ha~ a moral obligation to replant along that strip if the rezone is not approved. Mayor Jarstad asked -6- CITY COMMISSIONERS' MINUTES October 10, 1978 Page seven if it was the Council's policy or the Engineer's policy that this would go commercial and Commissioner Swanson stated it was the concept and understanding of the Engineering Dept. Question was called and motion carried unanimously. Meeting recessed from 11:45 A.M. until 11:55 A.M. ISLAM & ~SSOCIATES REZONE AND CHANGE IN LAND USE RESTRICTIONS Commissioner Stewart stepped down due to a possible appearance of fairness. Clerk read letter from Dr. Islam, dated Oct. 6, 1978, which stated they have no objection to his participation in the hearing. Commissioner Stewart stated he felt he should step down anyway and he left the meeting. Clerk read Planning Commission Resolution No. 4~4 which recommended denial of the rezone request. She explained that the Change in Land Use Restrict{ons on Lot #19 had been approved Aug. 29, 1978 and Lot #4 had been held in abeyance Until the rezone request was heard. She stated the hearing had been advertised, posted and letters of notification mailed as required by law. She then stated that 32 advisory ballots were sent, 17 returned with 6 agreeing, 10 disagreeing and 1 neutral. Ken Attebery, Planning Director, spoke of the proposal using sketches and site plans. He stated the designated use is for a restaurant and a parking lot. Jim Sanchez, attorney, spoke of the fragmentary decisions which have been made regarding this proposal and stated they hope to clear up some of the confusion. HeTpointed out that the Bridgeview Medical Center has been constructed and experience has shown that there is a wealth of parking without using Lots 4 and 19. He stated that Dr. Islam has said he does not need this parking for the Clinic and he knows that adequate parking isessential. Mr. Sanchez stated they want to,maintain this area as a health care center but other facilities must be provided for people visltihg this health care center. He stated the restaurant which is being proposed is a medium-price, family-type restaurant. William Richardson stated there is a mad scramble at lunch time with people driving to a congested area and the majority of the people were overjoyed at the thought of having a restaurant within walking distance. He stated the hospital cafeteria is open only for short periods and it seems logical to him to have an attractive restaurant that is close by. Jim Harris, architect, went through the sequence of development on these lots and pointed out the area requested for rezoning to B-2. He stated they will locate the building at any location on the parcel and requested that City Council approve rezone to B-2 for construction of a restaurant facility. Paul Bernie stated he was a representa'tive of Sea Galley Restaurants and he feels his restaurant will add a lot to that area. He described the type of restaurant it wilt be and stated it will be open from 11:OO A.M. to 4:00 P.M. for lunch and 4:00 P.M. to 11:OO P.M. for dinner, with the lounge staying open one hour later than the dining room; that Saturday will remain open one hour later and Sunday it will close at 10:OO P.M. and the lounge will not remain open on Sunday. Dr. Islam stated a restaurant is needed in this area to help support the health care center. He also stated that he does not think they will ever need Lot #4 for parking. Commissioner Swanson questioned Mr. Attebery about parking facilities and Mr. Attebery stated there is adequate parking according to City standards. OPPONENTS: Wayne Deitz stated he is re'presenting his mother who lives directly behind the proposed rezone and he asked that. the building be placed in the southwest corner of the development, away from his mother's home. H.e stated that a restaurant probably is needed in the area. Discussion followed regarding parking and M~. Harris stated there are 122 parking stalls required by code and the Medical Building has 155 now. Further discus- sion followed regarding placement of the building and Mayor Jarstad stated he -7- ( I ]¥ GOMM1SS] ONERS ' MTNUTES October lO, 1978 Page eight felt it should be placed in the southwest corner of the development; that this would allow beauEification of the parking lot and protect the residential area on the hill. He stated further that he feels this should be rezoned to B-2 as Wheaton Way will not sustain R-1 zoning; that this is a medical complex and it will continue to grow. Commissiol~er Swansol~ agreed that the buiding should be placed in the southwest corner and be stated that considerable attention should be paid to parking. Motion by Commissioner Swanson arid Mayor Jarstad to lift Land Use Restrictions from Lot #~, carried. Motion by Commissioner Swanson and Mayor Jarstad to approve fezone to B-2 with Uhe following conditions: (1) The site to be developed essentially as shown on the site plan; (2) Access to Wheaton Way to be determined upon approval of the City Engineer and Police-Traffic Division; (3) Main structure on the site shall be located in the southwest portion of the site; (4~ No vehicular access shall be provided to Cherr) Court; and (5) Screening along east and north property line as required by ordinaf~ce, carried.
