sent to residents as required by law. She read Planning Commission Resolution
No. 475 recommending approval with restrictions and reported that 26 advisory
ballots had been sent, 10 returned with 9 agreeing, none disagreeing and one
neutral.
Ken Attebery, Planning Director, stated this r~uest is to remove land use
restrictions in a B-3 zone. He stated the applicant has presented a plan for
potential remodeling of the two buildings on the site and parking behind.
PROPONENT:
John Sleasman, 1841NW Kint Dr., stated he has his veterinary clinic in a
leased building at the present time and the lease has five years left on it;
that he is looking at the site as apotential site for his clinic sometime
in the future. He stated he may also incorporate it into other professional
offices; that anything that is done in this area, as long as it is low-volume,
will be an improvement.
No on spoke in opposition to the proposal.
Pat Carey, 1Og-B Oak St., asked Dr. Sleasman to attend the Sheridan Park
Neighborhood Meeting tomorrow night at 7:00 P.M. to present and explain his
proposal and Dr. Sleasman stated he would attend.

use restrictions subject to restrictions set forth by Planning Commission,

rape #136 BRANDT REZONE CONTINUATION
(B) 366 Clerk stated this was heard on June 12, I978 and continued until today at the
request of Mr. Brandt so they could talk to the neighbors and explain their
propdsal. She stated the Planning Commission recommended denial o£ the request
for rezone. She then read post card from Louisa H. Boehmer opposing the rezone.
Ken Attebery, Planning Director, summarized the proposal and stated the applicant
has indicated the proposal is still a four-plex but will be sold as condominiums.

if any bids arrived.

BRANDT REZONE HEARING (continued)
Mrs. David Moore, 2452 East Phinney Bay Dr., stated she was opposed to the
rezone at first, but she feels that since the units will be sold as condominiums,
she is in agreement with the proposal. She stated she felt the condominiums
will be an asset to the neighborhood.
OPPONENTS:
Clarence Martin, 1408 Winfield Ave., stated he feels this is a spot fezone and
he wants to go on record as being against the rezone. Mayor Jarstad asked what
else could be done with this property if no one will build a single-family
residence there and.Mr. Martin replied that this is an R-1 zone and it should
remain R-i; that rezoning only sets a precedent and they should stop encroaching
on a single-family neighborhood. Mayor Jarstad stated he agreed that there are
some areas that should always remain R-1.
Clifford Brandt, 742 So. Summit, stated he agrees that the best thing for this
property would be a single-family residence but the cost is prohibitive and
the only other alternative is to leave it as it is. He stated they are not
trying to change the character of the neighborhood; that they had discussed it
with many of the residents and they prefer a condominium rather than leaving
it as it is. He stated again it just would not pay to build a single-family
home on that property.
Mr. Vinson stated he agreed about spot zoning, but the City CommisSioners and
Planning Commission hear each request on an individual basis and according to
its own merits.
Mr. McCluskey stated the City Commissioners have the right to put reasonable
restrictions on rezones and he gave seven restrictions that he thinks would
reasonable: (1) That it be built as condominium and no sale of more than
one unit to any individual or corporate company be allowed; (2) Tree barrier
be placed on 15th & 17th sides; (3) Road be paved to City standards; (4)
Property be connected to City sewer; (5) Installation of street light;
(6) Internal sprinkler be installed in accordance with UBC; and (7) A 5 ft.
easement be granted the length of the property for the purpose of installation
of sidewalks.
Motion by Eommissioner Stewart and Mayor Jarstad to approve rezone from R-1 to
R-2 with restrictions as stated by Mr. McCluskey. Under discussion: Mayor
Jarstad stated it is not usual to go against the recommendation of the
Planning Commission but with the additional testimony given today and the
concurrence of the neighbors, he felt this was the proper decision to make.
Commissioner Swanson asked Mr. Attebery about setback requirements and Mr.
Attebery replied that all setback requirements have been met. Discussion
followed regarding whether it would be better to deed the additional five ft.

for right-of-way or grant an easement. Mr. McCluekey stated it is to the
City's benefit to have an easement rather than a deed because this leaves
the property on the tax rolls. Commissioner Swanson stated the objections
about traffic and density have not been relieved and the plan shows that
it will essentially be concrete with very little greenery left. He stated
all these things should be considered in weighing the decision. Mr. Vinson
stated that it would be landscaped with crushed rock and beauty bark. Motion
carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, Yes; Commis-
sioner Swanson, ~.~O.
JUDGE DANIELSON
