stated the Boundary Review Board approved the petition as
amended. He showed the area that was included and stated the
signatures on the 75% petition represent more than 75% of the
assessed valuation of the area proposed for annexation. He
stated that if the annexation is approved, it should come in as
R-1 under the existing comprehensive plan and the owners of the

'APE #137 HARKINS PLACE REZONE HEARING and R/W VACATION HEARING
B) 2126 Clerk stated this was a continued hearing from June 6, 1978 and
they had both been advertised, posted and residents notified as
required by law. She read recommendations of Planning Commission
Resolution No. 462 denying the requests and stated 30 advisory
ballots had been sent, with 12 returned, 4 in favor and 8 against.
Ken Attebery stated this is a two-fold request - a rezone for 8
lots and a vacation of Harkins Place. He stated the Planning
Commission has looked at this particular site on a number of
occasions and has always recommended denial. He stated his Staff
Review indicates some conditions under which it might be approved,
but the Planning Commission has felt that it is not the best
action to fezone this area at this time. He listed these conditions:
(1) No access shall be allowed to Wheaton Way; (2) Access on Sylvan
shall be located as far west as possible and shall align with the
western most access to the Wheaton Mall; (3) Flnal access plan is
to be approved by the City Engineer and Police Traffic; (4) Uses
shall be limited to low traffic generating uses; (5) Landscape
buffer of not less than 6 ft. in width be provided along the west
and south property line; (6) This fezone be established as the
western most extension of commercial zoning on the south side of
Sylvan Way west of Wheaton Way; and (?) Building and parking set-
backs shall be at least 10 ft. from the north and east property
line and space between the building or parking area shall be land-
scaped and maintained.
PROPONENTS:
Elizabeth Buell stated she owns property on Harkins Place, but she
is very glad she does not live there; that it is not a fit place
to live. She stated the residents and owners don't know what to
do -- that they have formed a group and have come up with what
they believe is a good idea and they all want it zoned commercial
so they can get out of there.' She stated they are willing to do
anything and put in any kind of screening to protect the residents
in Olympic Manor.
Commissioner Stewart stated he did not want ingress and egress on
Wheaton Way and some sort of plan should be submitted before the
request could be approved.
Discussion followed regarding covenants and Mr. Attebery stated
there are covenants on those lots that there be no access to Wheaton
Way and that they be used as single-family residences only. He
stated these covenants apply at least to this 8-lot plat and he
does not know if any other area is included. Commissioner Swanson
stated those covenants are limited to Harkins Place specifically
and these people are acting as a group and all the owners want it
zoned commercial, Commissioner Stewart stated if the covenants
apply only to Harkins Place, the people should get together and
repeal it. Mr. Ryan stated if no one enforces the covenants, it
becomes a moot issue, but if someone is affected by them a lawsuit
can be brought against those property owners who did not keep the
covenants. Mrs. Buell stated they all want it zoned commercial
and they w~ll not sue each other. Commissioner Swanson stated
this property has lost its value as residential property and its
only resale value js commercial.
Motion by Commissioners Swanson and Stewart to fezone Harkins Place
to B-2 with the condition that proper sound barriers be put up,
and let the private owners resolve the covenants problem. Under
discussion: Commissioner Stewart stated he would like to get some
of the problems resolved before voting on this.
Hearing recessed for bid opening.

Motion by Commissioners Stewart and Swanson to accept bid from Hall's
Remodeling subject to review and approval of Commissioner Swanson
and his departments, carried unanimously.
HARKINS PLACE HEARING (continued)
Mayor Jarstad stated he is concerned that the petitioner is not
present for this hearing. Mr. Attebery explained that Mr. Beam
had suggested canecling the hearing because he was unable to get
all the parties to enter into a limited partnership. Commissioner
Stewart stated he is sympathetic with these people and he would
'like ~hem to be more specific so they can go ahead with a plan.
Mr. Attebery stated site plan approval would be the next step in
the process and he suggested that City Council set down
criteria to follow and possibly request one single integrated
development. He stated the vacation should not be approved until
there is an approved site plan.
Amended motion by Commissioners Swanson and Stewart to hold rezone
and vacation requests in abeyance until a reasonable development
is presented. Under discussion: Mayor Jarstad stated he thinks
it is proper to refer it back to the Planning Commission for action
when a site plan is submitted. Mr. Attebery stated the Planning
Commission has consistently'denied this request.
Discussion followed regarding vacating the street and Commissioner
Swanson stated it cannot be vacated until a site plan has been
approved. Commissioner Stewart stated the residents should get
one integrated plan; that the'area cannot be rezoned with a blanket
fezone because it could cause problems for the other residents.
Tom Pruitt, 8805 Harkins Place, stated they had a building planned
for this but Mr. Beam has all the drawings. He stated they all
agree that they want it fezcried, but some of them do not want a
limited partnership. He stated their biggest problem is that they
cannot get anyone to buy the property because it is not rezoned.
Commissioner Stewart suggesting recessing the hearing until a plan
is submitted. Commissioners Swanson and Stewart withdrew both
motion and amended motion and the seconds.
Motion by Commissioners Stewart and Swanson to recess hearing until
Sept. 12, 19?8 at lO:SO A.M. to allow the property owners to come
up with a comprehensive plan that meets the criteria set forth today,
carried unanimously.
