PROPOSED MARINA AT NAD PARK
Clerk read memo from Parks Department Superintendent stating that a special
Park and Recreation commission meeting was held on Tuesday, June 13, 1978 to
consider a cooperative effort between the City and Port of Bremerton to develop
a Marina and Park at N.A.D. Marine Park. The Commission unanimously opposed such
a development. Mayor Jarstad stated that when the proposal was made to Council
it was referred to the Parks Department to hold hearings. In view of the public
hearings and response there is no question of the inaccuracy of that area for
a marina. In the long range plans we now only have docks for the sail boat clubs.
Motion ~y Mayor Jarstad that as a result of the hearings and reaction from
the community we inform the Port Commission that it is not logical to develop
a marina in ~his area. We hope to work wi~h them on a marina closer to the

Commissioner Swanson:
1. He discussed the need to modify pump station #35 (Park and Burwell) in
accordance with Notice of Public Work. Pump Station #35 as now existing will
not operate satisfactorily and is causing repeated byTpass or overflows of
sanitary sewage. He stated the emergency need for two pomp motor units
and requested purchase on an emergency basis. He stated that they need to
have employees out there every day because of the problems. A review of the
agreement with the Navy shows that the city has management control, replacement
of parts and operation responsibilities.'
Motion by Commissioners Swanson and Stewart to advertise Notice of Public
Works for Pump Station #35 and authorize purchase of two pomp motor units,
carried unanimously.
2~ The recreational vehicle dump site is now open on the first two days

Assistant City Attorney McCluskey:

many things to be aware of. He felt that city officials should attend these
to see what the situation is like.

Mayor Jarstad:
1. Stated that discussion regarding funding was a great concern at the convention.
The increased cost to local government and decreasing money coming in
because of the loss of sales tax was discussed. Many ideas were discussed
as to how to obtain sources of income. The collective bargaining panel was
split regarding binding arbitration and right to strike. The City of Bremerton
was very much in evidence at the convention. He stated that Commissioner
Stewart had a table at the forum answering questions about our utility system
and did a good Job for the City.
2. Stated that the pool construction is going along well. They did not
hit any rock.
HEARINGS - Amendment to Shoreline Management Master Program
Motion by Mayor Jarstad and Commissioner Stewart to hold hearing, carried
unanimously.
~PE #135
1974 Amendment to Shoreline Management Master Program
Clerk stated the hearing had been published and posted as required by law.
She read the proposed wording for Appendix D, Setback: "Every building shall
have a twenty-five (25) foot setback from the ordinary high water mark.
The setback shall be measured from the closest building line to the ordinany
high water mark."
Ken Attebery stated that at the hearing in May the commissioners asked that the
set back part be referred back to planning. The language proposed does not
provide for exceptions where the adjacent setbacks are less than the given
distance. The intent was to establish a uniform set back along the shorelines.
There is a non-conforming use section in the shoreline master plan that will
enable individuals to rebuild if a home is destroyed by fire.

CITY COMMISSIONERS MEETING
June 20, 1978
Page Six
Commissioner Stewart stated that he sees no logic when you have two houses
close to the shoreline and someone has to build way back. He stated that
you have to be flexible so people can use their property.
Ken Attebery suggested that the language regarding adjacent setbacks could be
put back in. He illustrated various situations that could arise if you have
an adjacency clause wherein the houses could move closer to the shore as
they are built and redeveloped.
Commissioner Swanson stated that we have to look at Bremerton's shoreline and
lot conditions and what now exists and felt that a locked-in 25 feet would not
work.
Ken Attebery stated that there are conditions of shallow lots with shoreline
setbacks on one side and zoning setbacks on the other. It is difficult to
meet all of the variables.
Commissioner Stewart suggested changing the language to add: "... except
where adjacent set backs are less than 25 feet.the setback should be the
average of the adjacent setbacks..."
Commissioner Swanson felt that most people who own water front want a certain
amount of yard and that the fear that they will move as close to the water
as possible is unfounded. He felt that we have lots of time to look at this
and should not rush into something that will not work.
Mayor Jarstad gave an example of a house close to the shoreline in the middle
of two points and stated that in some cases there is only one way a home
can be built on property. He stated that he would be in favor of the uniform
setback if we were starting from ground zero but we are not, we have the contours
of the land to consider also.
Ken Attebery stated that some people own the tidelands and others do not
and that the building department applies zoning from the property lines which
in some cases is high tide line and others is the tidelands. There are many
examples now of having setbacks from wherever ownership is and through the
master plan these could be made into a uniform application. The more restrictive
of the two ordinances would apply.
Stewart
Commissioner/suggested adding to his first change that "if the property cannot be
used the setback can be waived by the City Council at a public hearing".
Dennis Borcherding 1350 Jacobson Blvd. We are faced now with lots too small
to build'on under these ordinances. He suggested excluding those platted
prior to January 1978 or to use the square footage of the lot to determine the
setback. Commissioner Stewart felt that this was still too arbitrary. Mr.
Borcherding drew a picture of his lot and location of neighbors. Commissioner
Swanson asked if in cases like this the council could give back yard variances
without going through the shorelines management plan. Ken Attebery stated that
in residential zones the planning director can grant administrative variances for
yard setbacks under certain conditions, one being that the neighbors have no
objections. There are lots of administrative variances that are processed, it
is less expensive and more expedient.
Mr. Arthur Pederson, 2609 E. Phinney Bay Dr. Mr. Pederson asked how a back
yard variance is affected by the 200 feet from the shoreline required in the
shoreline plan. Ken Attebery stated that the shore line master program does
not prescribe setbacks in rear yards. Mr. Pederson stated that the Olympia
Office stated we would receive something by June 29 on the other shoreline
issues.

CITY COb~ISSIONERS MEETING
June 20, 1978

Commissioner Stewart stated that if the council is not comfortable with
his proposed changes he would be willing to continue the decision on
this matter. Commissioner Swanson asked Ken Attebery to determine the county's
shoreline plan and what it provides as people may or may not be building
in areas that could be annexed. Some degree of uniformity between the County
and City is necessary.
Motion was made by Commissioner Stewart and Mayor Jarstad to continue the
hearing until next week so that further information may be presented, carried
unanimously.
McCONKEY AMENDMENT TO SHORELINE }~NAGEMENT SUBSTANTIAL DEVELOPMENT PER}fIT
Ken Attebery presented the conditions of the Amended Shoreline Management
Substantial Development Permit on Application No. 42-77 for Park Place Apartments,
Paul McConkey which appeal was heard one month ago in Olympia. He stated
that this has been handled through Karen Conley of the City Attorneys Office.
Mr. McCluskey stated that these conditions are agreeable to all parties involved.
Motion by Commissioners Stewart and Swanson to amend the Shoreline Management
Substantial Development Permit on Application No. 42-77, Paul McConkey,
as presented, carried unanimously.
