Clerk read ]~t~er sJg,ed by Glenn Vockrodt, President of BACON, dated Oct~ 1.1, 1978,
which r~quested that interim action be taken until the sewer facilities are designed,
constructed and placed in service. The letter stated that present conditions have
become so intolerable that a publi9 rehearing should be requested from the DOE on
the temporary permit which allows the City to discharge sewage in violation of
present EPA standards~ that the purpose df. the'hearing would be to set forth new
conditions for the temporary permit such as: (1) No new "hookups" by multifamily
housing complexes; (2) Posting and reposting of public beaches as necessary; and
(3) The passing of an ordinance making it unlawful to take shellfish~ swim or
waterski within the Bremerton area until the new facilities are placed in operation.
The letter suggested ~instead of a hearing, that the City implement these three

no studies have been made by BACON regardfng sewer conditions in Bremerton.

PUBLIC RECOGNITION
Austin Clark, 440 Washington, was present to reiterate his comments made at a
previous Council Meeting regarding the Life Safety Code, 1976 Edition~ (1) The
1976 Life Safety Code was adopted verbatim and as it may be amended in the future
for all new and existing construction; .(2) Ordinance does apply to every kind
of building in Bremerton; (3) 1976 L~fe Safety Code is not adopted as reference
material; and (4) Bremerton is the only first-class city in Washington that has
adopted this latest issue of the Life Safety Code. He requested that City Council~
rescind Ord. No. 3427 in its entirety or at least rescind it as it applies to
existing structures. He suggested that a hearing be held to get public input.
Mayor Jarstad stated he has spoken to the Fire Dept. and they are putting together
changes to that ordinance. He stated the points Mr. Clark has brought up are
being looked at by the Fire Dept.
James Skirvin~ discussed supplying water to a particular area in the City limits
so that more low-income housing can be built. He asked if the City Council has
come up with a plan to bring water into the City l~mits in the forseeable future.
He also discussed water being furnished to areas outside the City limits and
stated that water should be furnished to the City before it is taken outside.
A lengthy discussion followed and Commissioner Stewart explained that the reason
there is no water in this particular area is because it is so high; that is is
higher than the reservoir and if a new reservoir were built, water rates would
sky-rocket. He stated further that Bremerton has more low-income housing than
any other City in the State. Commissioner Swanson discussed water supplies and
he stated that the City of Bremerton has sufficient water; that if Mr. Skirving
wants water in this area, he should follow the procedures for an LID. Mr. James
Robinson, 4904 Kitsap Way, stated he was the developer who was chosen by HUD to
put in 70 units of low-income housing but HUD pulled that program because they
were unable to get water. Discussion followed between Commissioner Stewart and
Mr. Robinson regarding low-income housing. Commissioner Swanson discussed water
pressure and stated the City has not received a commitment from the property
owners to bring water to this area. Mr. Robinson requested that he be given an
outline so he could partidipate with tbe~City in bringing water to this particular
area. Commissioner Swanson stated he could set up another meeting to discuss
obtaining water and include the Water Dept., Mrs. Mahan from the Housing Authority,
Mr. Skirving and Mr. Robinson.

read'Planning Commission Resolution No. 493 recommending denial. She then read
letter from S.P. and Margaret Carey, dated Oct. 16, 1978, requesting denial of
the preliminary plat.
Ken Attebery, Planning D~rector, stated the proposal is to subdivide three and
a portion of a fourth platted lots ~nto 8 lots and duplex development~is proposed
on 7 of the 8 lpts. He stated the.proposed preliminary plat indicates that 5
of the 8 lots would ~ave access via a 20 ft. easement.
No one was present to speak for the proposal.
OPPONENTS:
A1Colvin, 341Hi]l Court, stated his house is just above the second duplex that
is proposed for this development and he feels that additional excavation would
cause an adverse reaction to the loose gravel and ~ause his house to slide down
the hill. He stated he ~s opposed to this development.
Pat Carey, 109-B Oak, requested that this preliminary plat. not be granted.
Motion by Mayor Jarstad and Commissioner Swansdn to concur in recommendation of
Planning Commission and deny request for preliminary plat, carried unanimously.
FAPE #142 CPO INVEST?4ENTS PRELIMINARY PLAT'
(B) 2287 Clerk stated the hearing bad been posted and advertised as required by law. She
read Planning Commission Resolution No. 497 recommending approval.
Ken Attebery, Planning Director, stated the proposal is approximately one acre
located between Arsena! Way and Rogers St.; that the property is an existing
single ownership occupied by 5 houses. The owner desires to divide this single
ownership into 5 lots with one house on each lot. He stated the City Engineer
has requested that the owner dedicate 20 ft. of.R/W along the entire Rogers St.
side of the propoged plat for future street use.
PROPONENTS:
Charles Cash, Box 191, Si]verdale, gave the higtory of the property and stated
they desire to turn these houses into home ownerships rather than rentals. Ue
stated they do have an objection to dedicating 20 ft. of this land to the City
because it would move the street within 10 ft. of the existing homes. He requested
that ~thfs 'p'relJminary plat be approved but without the 20 ft. dedicatio~.

C~mmissioner Stewart stated he did not see why the City needs that 20 ft. and
Commissioner Swanson explained it is necessary to allow fire and garbage trucks
to turn around. Jim Root, City Engineer, stated Rogers St. is a 60-ft. road
all the way from Callow to Yantic and fron Yantic to Constitution it drops to
30 ft. A lengthy discussion followed regarding the 20 ft. dedication and Marliss
Anderson, another owner of the property, asked if an adjustment could'be made to
10 ft. dedication. She stated that would make the property more saleable.
Mayor Jarstad stated that a 60-ft. road is proper but in this case, he would
favor the recommendation of a lO-ft, easement because of the way the homes have
been built. Commissioner Swanson stated there is a possibility a lO-ft. R/W
and a lO-ft, easement which would allow these people to use that property might
be adequate. He sta~ed this is a problem the City E~gineer and Public Works
would have to look at.
Motion by Mayor Jarstad and Commissioner Swanson to delay decision until next
week to allow the Council to View the property and make a decision regarding
the R/W dedication, carried unanimously.
