CHANGE ORDER #6, WHEATEN WAY - BROAD TO RIDDELL
Clerk read memo from City Engineer, dated April 24, 1978, attached to which was
Change Order #6 for the Wheaten Way project~ Broad to Riddell. The estimated
amount of the change order is $2,430.00 and a two calendar day time extension
was also requested. The memo stated this change order authorizes the labor and
material necessary to widen Wheaten Way north of R&ddell so as to provide for
the proper flow of traf£ic through the intersection; that the State of Washington
Dept. of Transportation will reimburse the City in the amount of the matching
funds required.
Motion by Commissioners Swanson and Stewart to approve Change Order #§ in the
net amount of $2,430.00 and grant a two calendar day time extension. Under
discussion: Mayor Jarstad stated he was very happy that Commissioner Swanson
was able to work this out because it is really needed. Motion carried unanimously.
HYDRANT CHARGES
Clerk read memo from Water Superintendent, dated April 24, 1978, which stated
the Tr&cyton Fire District and the Brownsville Fire District have been combined;
the Tracyton Fire District had an agreement on hydrant rentals but since the
combining of the two districts~ they claim there are no funds for paying the
hydrant rentals; that if the benefiting customers were charged 25¢ per month,
this would pay for the hydrant rental. The memo stated further that this charge
would be comparable to what the City Fire Dept. is paying for the same service.
The memo recommended that City Council authorize the Finance Dept. to increase
the water charge to East Bremerton customers outside the City limits by 25¢ per
month, said water change being a hydrant rental charge; A lengthy discussion
followed and Mr. McCluskey stated the City will not be charging 25¢; that the
D&strict is charging them 25¢ a month and the City will merely collect. It
was the consensus of the Commissioners to have the City Attorney's office review
the request and report back next week.
PROVISIONAL HIRING OF WELL DRILLER
Clerk read memo from Water Superintendent, dated April 24, 1978, which requested
permission to hire Lowell Castle as a provisional well driller. Mayor Jarstad
stated this act&on was taken earlier in thelmeeting.
MEADOWDALE WELL
Clerk read memo from Water Superintendent, dated April 24, 1978~ which stated
that North Perry Avenue Water District has offered $20,000.00 for the Meadowdale
Well; that he believes this is a fair realistic pr&ce to both parties because
of the following reasons: (1) Destruction to the well house, electric control
panels, the chlorination faci].ities, metering and other facil±ties; (2) The well
produces only 185 gpm; and (3) This well pumps a little sand and'w±11 require
a sand trap or filter before the water can be used in the system. Clerk presented
letter from North Perry Avenue Water District:, dated April 20, 1978~ offering to
pay the City $20,000.00 for the Meadowdale Well. Commissioner Stewart questioned
whether or not the City could sell property below the appraised value and Mr.
McCluskey explaine.d that RCW 39.33010 states the City can se11 it on such terms
and conditions as are mutually agreed upon by the proper authorities of the state
and/or the subdivisions concerned. Discussion followed regarding the sale of the
well And adjoining property.
Motion by Commissioners Swanson and Stewart to refer to City Attorney's office
for one week's study to verify what the Washington code actually states, .and
see if the City can move along these lines to sell the Meadowdale Well to North
Perry Avenue Water District~ carried unanimously.

regarding property at Lake Tahuyeh. The memo stated this property is extremely
valuable as development property and is no use to the City water supply; that
it is a maintenance problem and a cost to the City with no return now or for the
future. The memo suggested getting an appraisal and selling to the highest
bidder. Clerk stated the property'consists of lg0 acres at Lake Tahuyeh and
Alexander Enterprises has offered $150,OO0.OO. Mayor Jarstad stated this property
was purchased in 1950 for $8,5oo.bo and this has been a good investment over the
years. He stated he feels the City should hold onto this property because the
value will continue to increase. Commissioner Swanson stated the land takes a
certain amount of maintenance and this takes away, to a certain extent, from the
appreciation of the property. He Stated if the City keeps this property, the
existing buildings will have to be torn down because they are ready to fall down
now and they are nothing but an attractive nuisance. He stated he is not sure
that the City should be in the real estate speculation business and be thinks the
City should dispose of the rest of this property and put it back on the tax rolls
or it should be leased on a long-term lease. Commissioner Stewart stated he liked
the idea of leasing this property and he thinks it should be utilized to bring in
some income or it should be disposed of. Mayor Jarstad suggested tearing down
the existing houses and implementing a study in the coming months about leasing
the peoperty.
Motion by Commissioners Swanson and Stewart to'proceed with an appraisal. Under
discussion: Mayor Jarstad stated he would vote for the appraisal but he doesn't
think he can ever vote for outright sale of this property. Commissioner Stewart
stated he thinks the ]ease is the best idea and Commissioner Swanson stated he
felt the taxpayer's money should go to something that has an ongoing, value rather
than a speculative value. Motion carried unanimously.
Mr. M~Cluskey stated that Mr. & Mrs. Robert Zimmerman own about 40 acres in the
Lake Tahuyeh area and they wish to enter into some kind of agreement to allow
them access to their property. He stated he does not feel the City should
commit itself to the extent of granting an easement~ but some type of agreement
could be entered into; that Mr. Zimmerman has agreed to maintain the road and
hold the City harmless for damages that might occur by someone using the road.
Commissioner Swanson asked if they are land-locked or is there any other road
into the property. Chuck Moore, Water Superintendent, stated a four-wheel
drive vehicle is needed to come in from the west. Commissioner Stewart asked
if it would harm anything to issue an easement or a use permit and Mr. McCluskey
stated he did not see any real problems; that it will be a benefit because Mr.
Zimmerman has agreed to repair and maintain the road. Commissioner Swanson
suggested that Council take no action until next week so he can do more research
on this question.

Social and Health Services; that an expenditure of $6,OOO.OO would be necessary
to install complete recirculation equipment and constant supervision of each
pool would be necessary during operating hours to insure sanitar3 control measures.
The memo requested that City Council authorize discontinued use of the City's
three wading pools (Warren Ave. Playfield, Manette Playfield and Evergreen Park),
and recommended that the Parks Dept. install attractive, log-timber children's
play a~paratus in these pool locations~ which will better serve the community

sketch. He stated the parcel o? property is located to the west o? Bernice's
Steak House and read ?rom the Staff Review. He stated there is evidence that
the property is involved in some fill activity behind Bernice's and the Engineering
and Building Departments are ±nvestigating the nature of tha~ fill. He pointed

placed and Commissioner Stewart stated that is a civil suit between him and

the property, it could be developed at a later date; that without the vacation,
the property cannot be developed.
Commissioner Stewart stated there are adverse comments from City departments
regarding the vacation and he would like to know why the Traffic Dept. denied
the request. Commissioner Swanson gave the history of Kitsap Way and stated
the State Highway Dept. has turned back a large number of these areas along
Kitsap Way; that this is a piece of property that is not now on the tax rolls.
Commissioner Stewart suggested having Commissioner Swanson review this request
and find out why the Traffic Division recommended denial and report back next

APE #132 O'DAY VARIANCE TO SECTION 718 OF ZONING ORDINANCE

Resolution No. 4§g recommending denial of the variance.
Commissioner Stewart stepped dow~ due to a possible conflict of interest.
Clerk read Planning Commission Minutes dated March 21, 1978 and reported that
48 advisory ball. ors had been sent out, 15 returned with 14 agreeing and one
disagreeing.
Ken Attebery, Planning Director, explained the request for variance is to allow
parking in the 15 ft. front setback and it was den&ed by the Planning. Comm±ssion
because the angle parking Ss proposed would require that the autos parked in the
front yard setback back out into the right-of-way across the sidewalk area in
order to exit the parking lot. He stated it would cause too many safety hazards
to pedestrians. He stated the special use permit was approved by the Planning
Commission. Mayor Jarstad suggested making the front parking stalls for compact
cars onl.y and Mr. Attebery stated he felt it would be difficult to police. He
stated there will be 16 parking stalls without the variance.
PROPONENTS:
Bob Stewart, 303 Lebo Blvd., stated he is one of the directors of [_and Title
and he agreed that cars should not back out on the sidewalk. He asked if it
Could be turned around so that cars are backing into the alley. He stated this
will be mainly an employee parking lot so there won't be many cars going in and
out.
Discussion followed reganding ingress and egress and Mr. McCluskey stated that
a restrictien could be placed to allow cars to enter on the alley and exit,:on
Fourth. Landscaping and beautification were discussed.
Motion by Mayor Jarstad and Commissioner Swanson to approve variance with the
condition that entrance be from the alley and exit on Fourth Street, carried.
Commissioner Stewart re-entered the meeting at this time.
FERGUSON RIGHT-OF-WAY VACATION (continued)
Ron Karlberg, 3300 Rocky Point Dr., stated he is the owner of RaH Market and he
and Bernice's Steak House object to the vacation because it would force delivery
trucks to use right-of-way in front of their businesses, cause congestion on
Kitsap Way and reduce parking. Commissioner Stewart stated Mr. Karlberg is
using Mrs. Ferguson's private property for ingress and egress now and Mr. Ka~lberg
stated he was aware of this. Commissioner Stewart suggested getting together with
Mr. Blair and trying to work it out among themselves. Mayor darstad stated that
easements should be granted to allow accessibility to delivery trucks if the
vacatio:n is approved. It was expla.ined to Mm. Karlberg that a decision will be

TAPE #132 DUPLEX LOT SIZE CONSIDERATION HEARING
(B) Clerk stated the hearing had been advertised and posted as required by law,
She read Planning Commission Resolution No. 456 which recommended that no
action be taken to change the zoning ordinance requirements for duplex lot
area in R-1 zones.
Ken Attebery, Planning Director, summarized the actions of the study groups
and Plmnning Commission up to this point and stated the Planning Commission
recommended not making any changes pending completion of the Comprehensive Plan.
The following possibilities were considered by the Planning Commission: (1.)
Not increasing the lot size; (2) Double the lot size to 9600 sq. ft.; (3) Increasing
lot sizes to 9600 sq. ft. with a grandfather clause; (4) Increasing lot sizes to
7200 sq. ft.; and (5) Increasing lot sizes to 7200 sq. ft. with A grandfather
clause. .He stated the ~rAndfather clause would Allow duplexes to built on 5800
sq. ft. lots of record.
Bill Amo, 238 Willow, spoke of the R-1 Initiative and stated it was aimed at
causing the City Council to have hearings before they allowed apartments in
R-1 districts and also prevent developers from using the duplex threat.. He
stated he feets that 5800 sq. ft. is not big enough for a duplex lot.'
Douglas Lince, 327 No. Lafayette, stated he felt many people signed the initiative
pet:ition just to get people off their backs And only 1567 voted for, the initiative.
He stated the whole business regarding the R-1 Initiative and duplex lot sizes
is a negative emotional appeal.
Anne Maloof, 278 Kibsap Lake N~, stated she felt this was A very practical thing,
not just emotional. She stated that 5800 sq. ft. for a duplex allows approximately
15 units per acre and that is high density. She stated they are contesting high
density development, not duplexes that Are built to rehabilitate A neighborhood.
She stated home owners want to protect their investment And there is a very
definite threat to the Kitsap Lake area. She stated that developers are not
interested in bu±ldin9 in areas that need rehabilitation; that they want to go
to the outlying areas.
Dave [~orquist stated he ]ives on Madrona Point across from a duplex. He stated
the Average home costs $50,000.00 and the price is ~ncreasin9 on an average of'
$1,OOOOOO a month and thecounte~ is facing a housing crisis. He sta~ed he feels
the 5800 sq. ft. lot size for a duplex is good because this encourages individuals
to build duplexes And he feels dup]exes are a better alternative than high rise
apartments.
Olin TrJpp asked what peopie are going to look for in the way of housing when
they get out of a duplex and want a home of their own. He stated there is no
rhyme nor reason for using 5800 sq, ft. for a duplex and he feels g600 sq. ft.
should be the m±nimum.

CITY COMMISSIONERS' MZNUTES
April 25, 1978
Page eight
Dean Dewell, 5842 Oceanview Blvd. NE, spoke at length concerning the lot size
for duplexes. He stated he sat in three Planning Commission meetings and at
every single meeting, the Planning Commission asked to have the issue set aside
untiI the Comprehensive Plan could be analyzed and some guidelines could be put
together. He stated this is a serious issue, but he feels the Comprehensive
Plan is more important. He spoke of the population growth and stated there
have been fewer than 50 duplexes built and he does nut think there is a threat
to the residents regarding duplexes. He stated that must of the, duplexes in
the City are on pieces of property in excess of 5800 sq. it. He stated he
prefers total protection of privatb property rights.
Doug Booth, 1332 East Hope, stated this is perhaps the final step that began
when the nine units per acre ordinance was passed. He spoke of the Initiative
and stated it was the wish of the majority of those who voted that it become
law. He spoke of the task forces that are involved with BAPAC and stated they
will be looking at this issue very closely. He stated ~he whole issue on lot
sizes for duplexes has become very polarized and he is afraid that no matter
which decision is made today, something will be left undone. He presented
a compromise which provided that all future duplexes not be allowed to exceed
an elevation of 26 it. from grade or to be constructed on a land area smaller
than 9600 sq. it., provided that a variance may be granted, but it must be
heard by the Planning Commission and City Council. Th~s compromise is on file
in the Planning Dept.
Commissioner Stewart stated he does not want to pass a blanket ordinance and
then depend on variances later on. He stated there are areas in the City where
dupZexes should not be built and others where they should be, and he is in favor
of passing an ordJnance limiting duplexes in certain areas.
Theodore F. Drake, 2~15 E. Phinney Bay Dr., chairman of the Bay Neighborhood
Association, stated he was in favor of raising the number of square feet
required per duplex, espec±ally in his neighborhood where the roads are narrow
&nd cannot handle the traffic duplexes would Create. He stated he agrees with
Commissioner Stewart about restricting duplexes in certain areas.
Charles U11ock, 1137 Lower' Marine Dr., showed a map that represents the locations
of the duplexes that were actually constructed from 1974 - 1977. He stated that
in 1975 there 9 duplexes built; 197~ there were 13 duplexes built; 1977 there
were 4~ duplexes built; and so far' in 1978 there have been four duplexes built.
He presented a suggested change to Sect&on 1308.5, Requirements for Variance,
and this proposal is on file in the Planning Dept.
Pat Carey, hOg-B Oak Street~ stated he agrees with Mr. Booth that a temporary
solution is necessary until the Comprehensive Plan is adopted. He stated he
does not think 5800 sq. ft. ±s enough space for a duplex.
Commissioner Stewart stated the only way some people can buy houses is to buy
a duplex and rent one side out to help make the payments and he does not want
to deprive these people of becoming homeowners by passing a blanket ordinance
that would prohibit building duplexes on 5800 sq. ft. lots.
Ed Mill, 213 Willow St., stated he was in favor of increasing lot sizes.
A1Colvin, 341 Hill Court, stated he is &1so in favor Of increasing the size
off lots for duplexes.
Jim Strait~ 6530 Harlow Dr., stated that instead of changing the lot size f~r
duplexes, to require anyone who wishes to build duplexes to go through the
heaping process; that way the Council could determine if the location was
satisfactory.
Mrs. Haven, 343 Hill Court, stated she is in favor of larger lots for duplexes
because'children do not have a place to play on smaller lots.

the City of Bremerton as the hAgh density section of the County.
Horton Hackler~ 2121 East 19th~ stated he felt Mr. Booth's proposal would add
to the already overworked Planning Staff and City Council. He stated he does

retaAning the duplex ordinance as it now reads,
Richard Weld~ 126 Lebo Blvd.~ stated he feels that the compromAse proposed by

he hopes the new Comprehensive Plan will be defined better for density but in

a threat.

are aiI inteliigent people who make up their own m~nds and iAsten to every
propos~i before them with an open mind. He spoke of rezonin§ and fait they
have to get away from the dupiex threat. He stated he is very pIeased with the
apartment developments tha~ have been constructed. He stated that each proposal
must be .decided on its own merits. He felt that most of the dupIexes that have
been buiit that are on singie famiiy Iots are buAit where nobody eisa has w~nted
to put a single famAiy residence. He stated that ~r. Attebery made some good
suggestAons regarding grandfathering.
Commissioner Swanson stated there are many v~ewpoints regarding thAs issue and
he felt they need tO take a new look at the zoning in the CAty. He stated he
thanks that is what As goAng to come out of the Comprehensive Plan.
Commissioner Stewart stated that no one has told ham how they are going to find
housAng fop the people who can't afford a $50,000.00 home and thAs is one of the
areas that must be looked into. Another thing that must be looked at is those
areas where duplexes would be a mistake.. He stated he does not like the zoning
situation l±ke it is today; that there is too much of a spllt between R-1 and
R-2 and there should be a mAddle ground. He spoke of placing a protective
covenant on property and stated he is afraid of passing a blanket ordinance
to cover the entire City. He stated he is in favor of making certain areas of
the City "duplex-proof".
Ken Attebery expla±ned the grandfather clause and stated thAs would allow lots
of record to have duplexes built on them. He stated that he thought ~t would
be appropriate if Council does consider some change to this, that it be established
on an interim basis with a definite date when it would die or have to be recon-
sidered.
Commissioner Stewart stated he would like the Planning Dept. to look and see if
there are some areas that can be protected and made "duplex-proof". He stated

they shQuld be doing something about that now. He stated these are the areas

where duplexes should be built. He stated further the objections he has heard
so far are ones that he cannot support; but he will support an option to make
a neighborhood dup]ex proof, He stated he does not think the grandfather clause
will solve the problem,
Commissioner Swanson asked if the Planning D~pt, has any other options they
might consider, Mr. Attebery stated_there are a number of alternatives but
the Planning Commission rejected all of them; Commissioner Swanson suggested
using the number of bedrooms to determine lot sizes.
Motion by Commissioners Swanson and Stewart to refer back to Planning Commission.
Under discussion: Mr. Attebery stated this will place the Planning Commission in
the position of going back to study sessions to develop text to hold hearings and
he would appreciate the most precise kind of direction he can get. Mayer Jarstad
stated that one of the problems is that much of their time is being devoted to the
Comprehensive Plan and these two issues wiI1 be finished within'three months of
each other. He stated he felt it should be left the way it is or make a recom-
mendation to go to a grandfather clause with g6oo or 7200 sq. ft. Commissioner
Stewart stated the City needs a Comprehensive Plan that.sets aside certain areas
for different densities. Question was called with all three voting no.
Motion by Commissioners Stewart and Swanson to reject proposal which h~s been
submitted tonight. Under discussion: Mayor Jarstad asked Mr. Attebery if.he
saw any problems with increasing the lot size to 8500 sq. ft. and dropping the
height limitation to 26 ft, and including a grandfather clause, Mr, Attebery
replied that this would increase the administrative work load in terms of
determining dates of record and it.would also increase the amount of time spent
in the building permit process, Ms, Conely stated that interim zoning does
jeopardize people who get caught in the squeeze and the Commissioners have to
be very careful,
Amended motion by Commissioners Stewart and Swanson to take no action on the
proposal to increase lot sizes for duplexes~ carried unanimously,
