CITY CO~MISSIONERS' MINUTES April 18, 1978 Page five Ken Attebery, Planning Director, described the proposed rezone using a colored sketch. He read from the Staff Review and stated the Planning Commission recommended denial because they felt commercial traffic and the potential that the B-2 zoning would create in terms of commercial development should be discouraged. Mr. Attebery explained that Mr. Harris has requested the rezone to make the current use legal as it is now being used for access to a commercial business (Lee's Auto Parts); that no site plan has been submitted and Mr. Harris just wants to use the driveway for access to his business located on Wheaton Way. Commissioner Swanson asked how long this driveway has been in use and Mr. Wallace, attorney for Mr. Harris~ replied about 11 years. - PROPONENT: Merrill Wallace, Attorney-at-Law representing Mr. Harris, stated that Mr. Harris has operated Lee's Auto Parts since 1967 and he has been using this driveway for access to his business. He stated Mr. Harris will deed 30 ft. of the road to the City so it will be part of Eagle St., and this will give the City a full 60 ft. right-of-way. He stated a variance would probably be all Mr. Harris needs and a rezone is not necessary at this time. Commissioner Stewart asked if the Council can take action on anything else except what the hearing was advertised for and Mr. Attebery s~ated the Council has to take action on the request before them but it does not preclude the initiation of other action. He stated the suggestion of a variance was made Ay the Sheridan Park Neighborhood. Mr. McCluskey stated City Council can rezone to B-2 with certain restrictions and Mr. Wallace stated they are willing to have a restriction that no buildings be placed on the property and it be limited to the one building that is a~ready there. Mr. Attebery reiterated the recommendation of the Planning Commission and stated they want to discourage the continued or increasing traffic in what is a residentiaI neighborhood. He pointed out that the center curb along Wheaton Way was recently removed and this allows both left and right turns from Wheaton Way. He stated that most traffic can come on and off from Wheaton Way and keep off the residential streets. He stated the Planning Commission wished to discourage unnecessary traffic heading through that neighborhood and disturbing the otherwise peaceful residential character. Commissioner Stewart stated the people voted over two to one in favor of this rezone and this driveway would be used only for delivery trucksl that it would not be opened up to traffic. Mr. Wallace stated this is a practical use of Mr. Harris's property And it will not harm the neighborhood or open up Eagle Ave. to any more commercial traffic.
