Commissioner S{ewart asked how the amendment changes anything for any future developments and Mr. Vockrodt stated that only people who have a vested right are those who have a valid building permit. Commissioner Stewart stated that a developer is not going to have detailed plans and specifications before the Shorelines Hearing; that after approval is granted, he hires an architect for the detailed plans and specifications, tie stated it is not fair to change the rules at that point and make a developer start over from the beginning; that he should have these two years to get his financing and whatever else he needs to start construction and anything less than two years is not fair. If he has not progressed far enough during these two years, then he must start:all over again. Commissioner Swanson stated the.only foremen who get overtime are the ones who are line foremen and they can only work overtime at the instructions of the general foreman, tie said that in some cases, the pay scale is not so good that comp time is attractive to them. Mayor Jarstad stated each commissioner should handle the situation in his own way, and Commissioner Stewart stated the ordinance would have to changed to do it. Commissioner Swanson suggested looking at the ordinance and changing it if necessary. A lengthy discussion followed and it was the consensus of the commissioners to discuss it further at a later date. 5. Motion b~ Mayor Jarstad and CommissioneP Stewart to hold hearings in order listed above, carried unanimously. ~APE #126 SWININGSTON REZONE (B)155 Mayor Jarstad stated that in studying the location of the Swiningston Rezone~, ii w~uld appear that this is another one in the total context of the Kitsap Lake a~ea which has been discussed in the past months and he felt this should be in the same category of an overall evaluation of that total business district. He stated he would like to reach the point where this is all done at one time. ~ Ken Attebery, Planning Director, stated the Kitsap-Lake Association had a meetin~ ~i, last Thursday to reactivate themselves and this was done successfully. The first thing they did was to form a committee to study the Kitsap Way zoning situation. He stated that Mrs. Maloof is the newly elected president of that group and she indicated that following their meeting on Feb. 2nd, they will be able to come in and work with the Planning Dept. on some sort.of guidelines. He stated that four or five members of the business community out there are a part of that committee. He stated he thinks they can work together and come up with something in about six weeks or so on the Kitsap Way zoning question. Mayor Jarstad stated this should be resolved because the people out there have a vested interest and it was a business zoning. He stated it was business under the County and he thinks the degree of zoning can be worked out. tie stated if the overall comprehensive evaluation can be brought to City Council on all 'the business zoned area out there in six weeks, he would like to postpone a decision on this rezone until that time. ~r. Attebery stated this would give the neighbor- hood group an opportunity to meet at committee level five or six more times, if neoessary, and maybe have two neighborhood-wid~ sessions on the issue before it came back to Council. -6- CITY COMMISSIONERS' MEETING January 24, 1978 Page seven Leonard Costello, Attorney-at-Law representing Mr. Swiningston, requested that a decision be made today. He stated that last week no one expressed any objection to Mr. Swiningston's application. He stated all he is asking for is to keep the zoning the property had in the County. He stated time and effort has been expended to protect what interests Mr. Swiningston has in his property. He stated Swiningston has a non-conforming use and if the building burns down, he has lost some rights because he will not be allowed to build the same building. He will have to build under R-I rules and regulations. There are certain things that he cannot do with this non-conforming use. He stated that area was recognized as business general when it was annexed into the City, and that is all he is asking for right now with this particular piece of property. He stated he does not think Council will be able to come up with a decision in six weeks by studying this problem; that they are just postponing the problem. Again he requested that a decision be made today. Anne Maloof, 278 Kitsap Lake Road N~, stated that she understands Mr. Swiningston's concern but she still would have to^convinced that any postponement would be to his disadvantage. She stated she can see the difference between his being able to build his property up to what it is should it burn down if it were R-1 and she does recognize the fact that he has business property. She stated it is the degree of zoning that they are all concerned about. She stated Mr. Swiningston is a man of some regard and she is certain that he would not want to do anything that might adversely affect the neighbors. She stated Mr. Swiningston should not be treated any differently at this particular time than the other rezones that have been before thc Council. She stated the people of the area feel very strongly that this survey should be made. She spoke of thc committee that has been formed to study this zoning problem, and she feels that something can certainly come that will be in agreement with both the business people and the residents of the area. She requested that this decision be held up until such time as some guidelines are presented from the community in general. Mayor Ja~stad stated that his recommendation was to delay this decision for six o weeks. He stated there are other rezones which are under study at this time and he would like to see the recommendations from the Planning Dept. before a decision is made. He stated some restrictions will have to be put on the ~oning and he thinks the request from the Planning Dept. to evaluate all these properties should be honored. MOtion byMayor Jarstad and COmmissioner Stewart to delay decision for six weeks in order to obtain report from Planning Dept. for an overall evaluation of zoning, carried unanimously. . TAPE #126 BREN[ERTON MEDICAL LEASING CO. REZONE (B) 681 Clerk stated the hearing had been advertised, posted and letters mailed to residents as required by law. She then read Planning Commission Resolution No. 440 which recommended denial of application for rezone from R-1 to B-2. Commissioner Stewart stated he owns 50% of the Dairy Queen property and he felt someone might question the appearance of fairness if he sat on this hearing. McCluskey stated the decision is Mr. Stewart's to make. Commissioner Stewar~ withdrew from his position as Commissioner of Finance on the Council for this particular hearing. Clerk read Planning Commission Minutes of Dec. 20, 1977 and stated 13 advisory ballots had been sent and six returned, four agreeing and two disagreeing. Ken Atteb~ry, Planning Director, spoke about the rezone using a colored sketch and site plan. He stated the property is a parcel which is located at the end of Cherry Ave., commonly called Cherry Place. He stated the applicants wish to remodel an existing residential structure for an anesthesiology clinic and there will be parking for 14 cars with access from Cherry Place. -7- ' CITY COM}qlSSIONERS' ~EETING January 24, 1978 Page eight PROPONENTS: Leonard Costello, Attorney-at-Law, stated he is here on behalf of the owners of the property, Bremerton Medical Leasing. He stated this property is located in an area right near Harrison Hospital and Bremerton Medical Leasing Co. is a group of doctors that plan to lease this property and building to Olympic Anesthesia Services. He stated they plan to leave the building the same without expanding or remodeling the outside of the building. Arrangements have been made for off- street parking. Itc stated these doctors do not contemplate practicing medicine from this building; that their practice is essentially at the hospital. He stated this building is contemplated to be a bookceping and file storage building; that there will be a staff of approximately five. He stated there will be one office that all of the doctors will use from time to time and only a few patients are contemplated being seen per week. This will be limited to outpatient respiratory care and will be limited to three or four a week. He said the only other traffic that will be generated will be people coming by to pay their bills. A variance has been requested for the driveway on the south side and arrangements have been made to put in a screen-type fence to eliminate any objections that an eye-sore may be created in thc neighborhood, lie spoke about spot zoning and stated this rezone would not be spot zoning because it is consistent with the use in the surrounding neighborhood; that this property abuts a B-3 zone to the south and west; Harrison Hospital is in the vicinity; and this is not an unreasonable use. Donald Talcott, stated he appeared last year to discuss the need for a Respiratory Care Clinic and a Pain Clinic. At that time, they were interested in some property north of the hospital'and it was denied because of public feeling from residents. He stated at this hearing last year, it was pointed out that the property they are discussing now would be a logical area because it is surrounded by business establishments. He described in some detail what the function of the proposed office is. He stated only a few patients would be seen daily; that it is a low- volume opera%ion~.and it would not pay for them %o go, into one of the more expensive medical offices.. He stated this is the logical area for the type of work they do because they should be close to the hospital. ' OPPONENTS: Walter Trimble, 2504 Cherry Place, stated his house would be isolated between two businesses if this rezone were approved. He stated this does not abut business property and he described the points where it does abut. Mayor Jarstad stated the map shows a B-3 zoning and this property does abut that. Mr. Trimble read a letter addressed to the Planning Commission,. dated Dec. 15, 1977. This letter is on file in the Planning Dept. - · Mary SwansOn, 2503 Cherry Place~ stated the prO~o~ed!rezone, would be spot zoning because it would place one house between two businesses with parking lots on both property lines. She read a letter addressedlto the Planning Dept., dated Dec. 14, 1977. This letter is on file in the Planning:Dept, Motion by Mayor Jarstad and Commissioner Swanson to recess hearing until Feb. 7, 1978 at 10:30 A.M. Under discussion: Mayor Jarstad stated it is important to get input from all interested citizens. Commissioner Swanson requested that Planning Dept. forward the review from Engineering Dept. to his office because he has some reservations about that particular cul-de-sac regarding both sewer and traffic capacity. Motion carried. 'APE #126 BRIDGEVIEW REZONE B) 1366 Clerk stated this hearing had been properly advertised, posted and letters of notification had been mailed as required by law. She read Planning Commission Resolution No. 441 which recommended approval of rezone from R-1 to B-3 with one condition. She then read Planning Commission ~inutes of Dec. 20, 1977 and stated no correspondence has been received. Ken Attebery, Planning Director, stated a different arrangement in the Parking area has been proposed which provides ingress only from Cherry Ave. He stated there is on-street panking which may cause a problem. Mr.. Attebery used a site -8- CITY CO,%I~IISSIONERS' MEETING January 24, 1978 Page nine plan and a colored sketch as he discussed the proposed rezone. He stated there are businesses on three sides and the pressures on the residents in the cul-de- sac are becoming great, tie stated his staff felt that one of the alternatives might be to give some stability to the entire remaining portion of the cul-de- sao or to zone the entire area to business classification. He stated this area is very fragile and easily disturbed. He spoke about a variance to allow parking in the front yard setback and stated the Council can wait to make a decision on a variance. PROPONENTS: Mr. Sanchez was not present, but he will be present on Feb. 7, 1978 to give testimony. OPPONENTS: Mary Swanson, 2503 Cherry Place, stated she would like to protest this rezone. She read a letter dated Jan. 23, 1978 giving reasons for protesting. This letter is on file in the Planning Dept. Walter Trimble, 2504 Cherry Place, spoke about the parking lot that Bridgeview, Inc. put in on Lot 2 and stated the ingress and egress was supposed to be on Cherry Ave. He stated five access lanes are proposed for ingress and egress and this is half as many as Sea-Tac Airport. He stated Cherry Ave. in front of the hospital has been pulverized and the street is broken up. He stated a B-3 zone is excessive. Mayor Jarstad stated the testimony that has been presented is very good and City Council is concerned about the people who live in this area and have been there for a long time. He stated a concern has been voiced that these people may feel that they are being forced to move if this area is to become a large medical center and he feels these homeowners should get the highest possible return on their property because they are the ones who have to make the adyustments. Motion by Mayor Jarstad and Commissioner Swanson to continue hearing until Feb. - 7, 1978 at 10:30 A.M., carried. Meeting adyourned at 12:05 P.M. Kathleen L. Mandio, City Clerk ,~ Approved: Glenn K.
