Motion by Mayor darstad and Commissioner Stewart to hear City Engineer's presenta- tion at this time, carried unanimously. Mr. Waring, City Engineer, spoke about the proposed intersection changes at Washington and Fifth and Washington and Second. He stated a proposal has been made to remove three parking spaces on the south side of Fifth St.; that this would give 19~ ft. to the centerline so an additional right-turn lane could be put in to Washington. A lengthy discussion followed and Commissioner Schoneman stated the "bottleneck" on Fifth St. would be eliminated with this improvement; that it would be the same situation as the one presently at Sixth and Fourth St. jf the three meters on the south side were removed. Mayor Jarstad commented that he thought it is an excellent recommendation. Mr. Sexton stated he would like to see a traffic signal installed at Fifth and Washington because it is so difficult For pedestrians to cross at that intersection. Motion by Commissioner Schoneman and Mayor Jarstad that three meters from the south side of Fifth St. and probably one from the north side be removed, the dividing line be realigned and the curb on the SW corner of Fifth and Washington be reconstructed, curried unanimously. Mr. Sexton asked again about putting a traffic signal in at Fifth and Commissioner Schoneman stated there was a signal at Sixth and Fourth and these two signals should give anyone time to cross the street. Mr. Sexton replied that these are not coordinated and it is a very dangerous corner for pedestrians. Commissioner Schoneman told him that these lights can be adjusted so they are coordinated. Mr. Waring spoke about the intersection at Second and Washington and gave the dimensions and widths; stated there is 18 ft. to the dividing line; that on the north side there is a loading zone. He stated the proposal is to take out two meters, leaving lane widths of 12 and 11 ft. Stated new yellow dividing line could be moved over two ft.; recommending painting a white line or using buttons. Commissioner Schoneman stated buttons would be used instead of paint since the paint would wear off fast with so much traffic on that street. Mr. Waring stated the Police Dept. had some objections to this proposal and it was decided to wait until the Traffic Division could give their input before making a decision. -2- CITY COUNCIL MINUTES July 1S, 1977 Page three RENOVATION OF LIONS COIYLMUNITY PLAYFIELD DOCK Clerk read letter from Barry Branch, dated July 13, 1977, which stated that their fee to provide professional services in conjunction with the proposed remodel of the Lions Community Playfield Dock is $855.00, plus reproduction costs of working drawings and specifications. Gingrey gave the objections the Traffic Division has to removing these meters and stated that a jog would have to be made to drive onto Washington St. Me stated that the turning movement to the right is very minimal; that most cars turn left from Second St. to Washington. He stated he did not know what would be gained by removing these two parking meters. Commissioner Schoneman stated that as much relief as possible should be given to any Latersection in order for cars to make right and left-hand turns. Motion by Commissioner Schoneman and Mayor Jarstad that two parking meters on the south side of Second St. be removed, carried unanimously. PUBLIC RECOGNITION Charles Walker, 140 South Cambrian, stated he had attempted to obtain a building permit to replace a carport that was damaged by an automobile accident and was unable to do so. He stated that a neighbor had received a building permif to reconstruct a porch. It was explained to him that there was a difficulty with the initiative ordinance recently passed by the voters wherein the language appears not to allow any remodeling, repairing, constructing, etc. over lot lines. After discussion and consultations with Mr. Attebery and Mr. Sexton, Mayor Jarstad asked Mr. Sexton to do his best to obtain an answer as soon as possible and Mr. Sexton asked Mr. Walker to contact him around 3:00 this after- noon. Motion by Commissioner Schoneman that he be allowed to repair that port]on of the structure that has been damaged. Motion failed for lack of second, However, under discussion: Mr. Walker admitted the structure he wishes to build will be twice as large as the area of the former structure. Ed Maohinski, 521Lcbo Blvd., stated he understood that there now was sufficient water for the City's needs and he said he was retired and would like the benefit of the sprinkling rates. Cox~issioner Schoneman discussed the reasons for not having sprinkling rates this year and noted that water consumption is lower than normal. Stated there was sufficient water for this year but he does not favor sprinkling rates and commented that i~ anyone did wish to water the lawn, the extra cost would only be $4.00 or $5.00 a month. Commissioner Stewart discussed the affect water sales is having on receipts and the necessity of having enough income to cover all the costs including bond redemption and interest. After further comments by Mr. Machinski and the commissioners, Mayor Jarstad asked Commissioner Schoncman to have some facts and figures for the next City Council Meeting. Thomas Mickelson, 3315 Halverson, complained about the use of the parkin2 lot by the Eastgate Assembly of God Church and asked why they were allowed to have parking of cars in an R-1 zone. Under discussion: Mr. James Hobart, 3202 Pine Rd., stated he would like his objections to the fezone entered into the record and City Clerk read his letter and conditions. Mr. Hobart stated the conditions from the Planning Commission indicate maintaining as much existing green belt but does not mention any new green belt screening and he feels a privacy fence should be erected on the south side of the entrance drive from Pine Rd. to the western light post at 3202 Pine Rd. Commissioner Schoneman commented that any screening must be done with visibility in mind. Motion by Mayor Jarstad and Commissioner Stewart that screening without hazard to traffic be included in the original motion. Question was called on both motions and both carried unanimously. DEAN DEWELL REZONE DECISION Commissioner Stewart stated that no cards were sent to the neighbors in this area. Ft. office, shop and warehouse facility on the west side of McKenzie at the intersection of McKenzie Ave. and Sheldon $1vd.; that the existing zoning is Business (Commercial) and the 1966 Comprehensive Plan shows high density residential. The Department Reviews gave no objections. Clerk then read letter from the Smith Neighborhood, signed by George L. Coombs, dated July 11, 1977, which stated that the Smith Neighborhood had no real objec- tions, only that they would like to have some kind of fence covering used. Clerk stated he had posted the area and advertised as required by law. Ken Attebery, Planning Director, spoke about the permit using a sketch and site plan. Stated there is a small area in front which is undeveloped; that the building would front on McKenzie; that the property does not have direct access to the waterfront. lie stated the only reservation he has about granting the permit is that if the area is ever going to return to a use such as proposed in the Plan, a decision should be made in that direction. Mayor Jarstad -4- CITY COUNCIL MINUTES July 13, 1977 Page five commented that he would much rather see a clean modern concept than have deterioration happen. Boyd Beck, President of Feek Service, spoke briefly about the facility to be constructed and stated they planned to develop and improve the grounds and stated the fuel is brought in by water. No one spoke in opposition to the permit. Motion by Mayor Jarstad and Commissioner Stewart to approve Shoreline Sub- stantial Devc].opment Perm:it, carried unanimously. JAMES SKIRVING CHANGE IN LARD USE RESTRICTIONS HEARING Clerk stated he had posted and advertised and mailed letters of notification as required by law. Mr. Sexton stated it was still R-2. Mr. Attebery stated that other conditions arc being asked to be removed from this site. Other conditions will still be in effect on the ether area previously rezoned to R-2. tie stated he would concur with the Planning Commission in their recommendation there would be another 18-month review period. Commissioner Stewart stated he was concerned regarding the Fire and Water Dept. recommendations. PROPONENT: James Skitying stated this property is really adjoining a UPS Building and it is a beautiful site. The people will come in buses, 100 to 150 per day, and they will do all kinds of vocational things and then be taken back. He thought there is a tremendous need for school for' these people and this is an ideal situation for it. Commissioner Schoneman stated when UPS went in, it was with the understanding that they would place a small line until Mr. Skirving put in his improvement and the City has his word he will put in an 8" line to serve him and the con- cern of the Fire Dept. is that fire hydrants be located in this entire area. He stated that if further site development is going to take place, the 8" main must be placed and hydrants will be placed or there will be no building. Mr. Skitying said that was right and sewers would be taken care of also. Motion by Commissioners Schoneman and Stewart to allow this Change in Land Use Restrictions with stipulation that the water main be placed and the entire system will be purchased by the abutting property owners, plus a hydrant will be installed, and they will have to take care of the sewers also, carried unanimously. BREMERTON SHORELINE MANAGEMENT MASTER PROGRAM Clerk read memo from Planning Dept., dated July 13, 1977, attached to which was the final discussion draft of the Shoreline Management Master' Program for Bremerton's Shorelines. The memo recommended that public testimony be taken on the discussion draft and the Planning Dept. incorporate the findings into the Master' Program and returned to Council Fox' Final review and acceptance. It further recommended that concurrently with the City's approval of the Master Pr~>gnam, a Shoreline Management Advisory CommiLtee be appointed by the Council and should include representatives of major shoreline owners and water related businesses, the shoreline neighborhoods, conservation groups, Planning Commission, Ptlr't of Brcmcrton, Parks Commission and appropriate City Departments. Commis- sioner Stewart asked how hard it would be to change this Master Program if it were adopted and Mr. Attebcry stated the process would be the same as for adopting it, through public hearings. Mr. Attebery stated this change will give the best use of the shoreline, but changes could be made in the Future if necessary. CiTY COUNCIL MINUTP;b July 13, 1977 Page six Ken Attebery, Planning Director, spoke about the Master Program using a map and a Shoreline Compatability Chart. Hc stated he would like the opportunity to go over the plan in more detail with the commissioners, but he would give a brief outline of the plan now. Stated people have taken an active part in the development, but they would like to have more time to work with this plan. Me would like to update this and bring it back to the Council. Me stated this plan is establishing new zoning regulations for the ordinances; that if this is more restrictive than current zoning regulations, it would take precedence over the zoning ordinance. He spoke about the permit procedures, designation of natural systems, designation of environments and the Master Program element goals. Mr. Attebery asked for any public comment and stated he would take the information he has already received and the commissioners comments and would like to incorporate some of these thoughts that have been presented. Joe P. Stadler, 908 Park Ave., stated he is interested in tourism and felt that if a history of some building could be found in Bremerton, it could be sent out to other cities and this would bring tourists into Bremerton. Commissioner Stewart commented that there is no money in the budget for tourism. Motion by Mayor Jarstad and Commissioner Stewart to close hearing on Shoreline Management Master Program and instruct Mr. Attebery to bring his comments back ta the commissioners at a later date, carried unanimously. ACCESS ROAD NEAR TAHUYA LAKE - PERMISSION TO PAVE Clerk read letter from Beverly Austin and Dick Snider, Sales Associates for Century 21, Tepee Realty, dated July 7, 1977, which asked if the City intends to pave an access dirt road near Lake Tahuya. It stated further if the City does not intend to pave the road, they need legal permission to have the builder pave this road if he purchases the land. Commissioner Schoneman felt that if they want a road in there, it should be shared by both parties; that the City would give 30 Ft. and they would give 30 Ft. rather than have the road entirely on City property. He stated he would be in contact with them. ROAD CONSTRUCTION ON CITY PROPERTY NEAR KITSAP LAKE Clerk presented a request for permission to constuct a road over City property near Kitsap Lake & Commissioner Schoneman stated it is not necessary to give an easement; all Council has to do is approve construction of a road. Gilman, Architect, no date, which requested a legal opinion from the City Attorney as to the meaning of the following paragraph: "The business use of the property shall be limited to that of professional offices, and to retail stores which are directly related to the professional offices, or which are a convenience to the employees." It stated further they are unable to properly ascertain what is meant by: (a) retail stores that are directly related to professional offices; and (b) retail stores which are a convenience to the employees. Mr. Sexton commented that there is nothing legal. about this. It is simply interpretation of the ordinance and it is for the Council to make this interpretation, not an attorney. A short dis- cussion followed and it was the concensus of the Council that it is quite clear that it is to be for a professional office building and its related uses only. OEFER OF GRANT AWARD Clerk read memo from Grants Administrator, dated July 12, 1977, attached to which was the Offer of Funds in the amount of $813,917.00 for construction of t~e water system expansion project. He gave percentages both for the traffic cases and for criminal cases. Of 100 cases, he stated that 57% of the bail stipulated in uniform was suspended; of those 75 cases were traffic cases and of those, 44% of the fines were suspended. In connection with criminal cases, 95% pled guilty. There was no trail and 82% of the Uniform Bail Code was suspended. -7- CITY COUNCIL MINUTES July 13, 1977 Page eight Stated he thought the City Council has a right to ask the judge for an opinion. Stated he realized this was only a hundred-case sample. Thought City Council should look into this because the City spends approximately $2,000,000.00 a year on public safety. Stated he thought this was one of the reasons for having a review of the departments. Mayor Jarstad stated he was interested to see how this court would compare with other courts and Commissioner Stewart stated in the first place, the City should take care of its own and he would like to have an answer from the ,judge and would like to have the judge talk to the Council. Commissioner Schoneman: 1. Has been requested to make 12th St. from Naval to Olympic one-way; that an apartment house is going in there and it is only a 20-ft. street. Motion by Commissioner Schoneman and Mayor Jarstad to allow the Traffic Dept. to review this and report to City Council with regard to one-way street and which direction, carried unanimously. 2. Accidents had occurred at Wheaten and Sylvan because of the lack of signals and the lack of having been able to order the signals in coordination with the improvement because of the regulations of the federal law in connection with the funding. Stated he would like to have the City consider acquiring with its own money the next signals that could be used and installed temporarily until the new ones arrived. That way would have everything working properly. The City could then have the signals in case of emergency. This should be planned in the coming new budget. 3. On changing over some of the mercury and sodmum vapor lights in the downtown area, the work was temporarily slowed because some of the people were going on vacation so that only 30 lights have been placed, but he had questioned the slow-up int~tallation and Puget Power has informed him they anticipate they will start ,July 20 and they will have a full crew working. It will only take 4 or 5 days to complete. Mayor Jarstad: Tomorrow he will be in Seattle meeting with the principals of architectural firms and will be looking at pools. itopefully, can have someone under contract next week. There is a citizens' committee that has been r~presenting the people who are active in swimming pool use, such as members of swim teams who will continue to serve and will talk to the architect about points needed in the pool. Stated he believed the City would come up with an experienced person. Meeting adjourned at 1:00 P.M. G. C. Yeadon, Sr., City Clerk Approved: Glenn K. Jarstad, Mayor -8-
