The memo stated the associations themselves may wish to appeal the rulings, but this is a decision they must make with their own attorneys and then the City could certainly support such a move. Mr. McCluskey stated this was a big oversight on the part of the legislators and he does not th~nk it was aimed at this type of operation. Meeting recessed from 9:58 A.M. until 10:O7 A.M. PUBLIC RECOGNITION Clerk read letter signed by Emanuel and Dorothy Justesen, 833 Pacific Avenue, dated August 10, 1977, asking how Joe Mentor continues to get building permits when others can't. The letter quoted part of an article from the Bremerton Sun and asked if the City of Bremerton would follow through in regard to the Dental Clinic at 9th and Pacific. Mr. McCluskey stated the hearing would be held in Superior Court Aug. 15, 1977. Commissioner Schoneman stated it would be illegal for the Building Dept. to deny a building permit to Mr. Mentor if he has met all the codes and specifications. Stated he has submitted plans for his hotel for the last five months and he has finally come up with a plan that is acceptable to all the departments. Commissioner Schoneman explained the permits that had been issued to Mr. Mentor and stated again it would be illegal to withhold a building permit if he has met all the necessary require- ments. COMMISSIONERS' REPORTS Commissioner Stewart: 1. Recommended the commissioners approve his having the attorney's office prepare an amendment to the water ordinance which would eliminate the $5.00 charge to the owners of the property when changing tenants so the owner can have water service in the interim. He stated he had checked with Puget Power which is the other major utility and it does not charge in these circumstances. No objection was heard from the commissioners and Mayor Jarstad said he did not see any prob- lems with this suggestion. 2. Under the system of returning water deposits to good credit persons, his department has had an opportunity to study the first six months under this plan which involved three payments. He stated that those persons who have been delinquent one time should not be charged a delinquency fee because he did not want to penalize those who had slipped up, but the second time this happens they will have to pay. Stated the large water users who formerly paid 50¢ delinquency charge and now pay 12% are just about eliminated from being delinquent; however, he has not yet eliminated those in the area of small bills and he is contemplating changing the system as it relates to those small water users. On the habitual delinquents, he is not in favor of sending out a door-knocker to warn them due to the considerable number of people involved and the cost of handling this method. S. Recommended llth St. be renamed to honor Commissioner Schoneman. His reason For recommending this particular street was due to the great amount of improvement that Commissioner Schoneman had been responsible to have done several years ago in which a large fill was placed between Callow and Kitsap Way and poles had been removed and other beautification and improvement has been done. Mayor Jarstad stated this is something that has been talked about and the City Council will have time a little later to have a designation. Motion by Commissioner Stewart and Mayor Jarstad to have ordinance prepared to have the name of the street changed as suggested. Under discussion: Mayor Jarstad stated he would come back to the Council with the boundaries. Motion carried as follows: Mayor Jarstad, Yes; Commissioner Stewart. Yes; Commissioner Schoneman, Abstained. Commissioner Schoneman; 1. Recognized two public works employees: Erv Heath for his conservation methods in bringing the water supply into the City and the fact he held back on using Casad Lake in anticipation of the drought and used principally Anderson Creek and its sources and wells and Gorst Creek. He mentioned Mr. Heath's experience as -4- CITY COUNCIL MINUTES August 10, 1977 Page Five for~ster and supervisor since 1964. His methods have been working satisfactorily. The use of water has gone up tremendously in August. Present water use is taking about two million gallons a day out of Union River. This is a Feeling of security that the City will not have a problem in having water For its users. Recognized City Engineer Bob Waring who has now completed over six months in the City EngineeP's position. He has increased production in the Engineering Dept. to the point where the City is not calling upon consultants as much as it did in the past. Stated the Engineering Dept. has two registered engineers on the staff, Gary Case and Bob Waring. He stated he is very thankful Mr. Waring came to work For the City. He then read Mr. Waring's education and work background. Stated he was glad Mr. Waring had completed his six months#probationary period as City Engineer and has attained his permanent status. 2. A little concerned about the construction firm who has a contract For the improvement of Aimira and Sheridan. Probably because the firm has many coramit- ments, they have not been working continuously on the construction of curbs and sidewalks. Their completion date is Aug. 19th, after which time they will be subject to $75.00 a day penalty. Have had good weather and the City:s part of the work has been completed. Me would like to see them get their part done. Will get blacktop From the low bidder and his equipment will be available after Aug. 15th. As soon as the curb work is done on Sheridan and Almira, they will be blacktopping these areas immediately plus doing overlay on maintenance of certain streets which are beyond repair. Re will have the list of these streets available shortly. 5. Mr. Moore, Water Superintendent, has been attempting to get grants fop drought relief and it appears that the City will be able to receive funds on the well the City has dug plus two other wells in the Central Valley area. The City is eligible for part of the cost of about 20% to a total of approximately $16,000.00. Stated Mr. Moore wall have earned his own way this year. Asst. City Attorney McCluskey: Had prepared a document called "Disclaimer of Temporary Line Agreement". This has been drafted on request of Ike Parker and Seattle First National Bank. This covers a temporary line that was put in in connection with the NOrth Perry Water District; however, that area has been turned over to the City. Recommended that the mayor sign and city clerk attest it. Motion by Commissioner Stewart and Mayor Jarstad to authorize mayor and city clerk to sign disclaimer, carried unanimously. Mayor ,laPstad: Recommended the City Council approve offering an option to purchase the property known as the "White Blueberry Farm" on Sylvan Way located between Wheaten Way and Pine Road; that this proposed purchase has been spoken of before and that it would be an ideal location in the high density area in East Bremerton for open space. It is an especially heavily traveled area on Wheaten Way and children used to cross to the play area on the east side of Wheaton, but parents are now concerned about the traffic. This property would Fit into the City's plan for that area and the City can buy it For the appraised price. Motion by Mayor Jarstad and Commissioner Stewart that the City enter into an option for two years and as a good-faith offer, which will be reflected in the purchase price, authorize an option payment of $5,000.00 to Mr. White. Under discussion: Mayor Jarstad stated the two-year period for the City is to avail itself of Federal and State grants which it has a good chance of receiving. Commissioner Schoneman stated this was a very good move and realized the mayor has been planning this For sometime. Commissioner Stewart stated he would like to see some of the property available for "pea patches". Motion carried unanimously. HEARINGS - Bremerton Ferry Terminal Shoreline Management Substantial Development Permit and Barry Branch Preliminary Plat Motion by Mayor Jarstad and Commissioner Stewart to hold hearings in order listed above, carried unanimously. -5- CITY COUNCIL MINUTES August 10, 1977 Page six BREMERTON FERRY TERMINAL SHORELINE SUBSTANTIAL DEVELOPMENT PErmIT liEfliNG Clerk stated he had advertised and posted as required by law. Stated there was no new correspondence either for or against. Ken Attebery, Planning Director, explained the improvement that was to take place at the Ferry Terminal which would be for reconstructing the pedestrian wing walls and dolphins. He stated he felt the application is a close decision whether it was needed or not because the job is close to maintenance but he thought it would be best to go through the application and not inconvenience the Highway Dept. The work goes beyond extreme low tide. In connection with the department reviews, the Pire Dept. stated that the new structure for pedestrian tower and access is required to be equipped with an automatic sprinkler system as exists on the old pedestrian tower. Other comments of departments are included in the staff review dated Aug. 10, 1977. Stated a final negative declaration was filed on Aug. 3, 1977. Mr. Attebery recommended the permit be approved as per plan submitted and in accordance with the recommendation of the Fire Dept. Commissioner Schoneman asked if this work is for super-ferries or if there has been talk of taking care of hydrofoils. A representative of the State commented that the Highway Dept. is responsible and this is for super-ferries. The esti- mate of cost is $230,000.00. Commissioner Schoneman stated the reason he had asked the question was because the super-ferries' traffic plugs downtown Bremerton and that 90% of the traffic wants out of Bremerton; that in attempting to board the ferries, Washington Ave. becomes a parking lot for the ferry system. He stated some consideration should be given and he has been discussing with Senator Walgren for the City having pedestrians only at this location and relocate the super-ferries' traffic where Sign Route 3 meets Sinclair Inlet. He stated further that with the Highway Dept. spending this type of money, it looks like there would be no change for many years as the structure would be good for 20 years. He asked if any of this has been discussed. The Highway representative stated that this repair is necessary for safety of the pedestrians; that the existing tower has been damaged and that they want to prevent further damage by installing fenders and dolphins. He stated during the year 1978 the State will be studying alternate locations for a ferry terminal in Bremerton. This site and the other at Sign Route 3 and Sinclair Inlet will be studied. Also they are developing a plan for use of hydrofoils on Puget Sound in the future and that plan will be presented to the Toll Bridge Authority Aug. 16th. There being no one present to speak in opposition to the approval of the permit, the following motion was made: Motion by Mayor Jarstad and Conmissioner Schoneman to concur with recommendation of Planner and approve the issuance of a Shoreline Management Development Permit ~ carried unanimously. Mr. McCluskey left and Mr. Olsen entered the meeting at this time. TAPE #112 BARRY BRANCH PRELIMINARY PLAT HEARING (A) 1073 A court reporter was present to take a verbatim transcript of the hearing. Mr. Olsen explained the background of the application for a preliminary plat and stated this hearing was a reconsideration by the City Council as the City was unable to get a verbatim transcript of the original hearing. City Clerk stated he had advertised, posted and mailed notices as required by law. Clerk then read letter from Philip Rest, dated Aug. 10, 1977, which stated he was unable to attend the hearing but he would furnish written comments within two days of receipt of a verbatim transcript of the hearing. He read letter signed by Phyllis Cernetig Conn, 203 E. 31st, dated Aug. 8, 1977, which stated her fence was torn down and she has replaced it with a temporary fence; that she intends to use this fence as her property line. A letter from Planning Director, dated Aug. 10, 1977, was read into the record which stated a "Proposed Declaration of Non-Significance" was filed in Bremerton's SEPA public information center on Aug. 1, 1977 and no action can take place on today's hearing until after Aug. 16th and the filing of a final declaration. Clerk read letter from E. L. Sturdivant, 3231 Halverson, in favor of the preliminary plat. The old correspondence was read into the file: CITY COUNCIL MINUTES August 10, 1977 Page seven letter from Clarence and Alice Shockre, no date; letter from Alice B. Shockre to the Planning Commission dated Jan. 14, 1977; letter from Alice B. Shookre to Mr. Plescher and Mr. Attebery, dated Jan. 14, 1977; letter from Mrs. Warren Wagner to the Planning Dept., no date; and letter from Margaret L. Carey to Planning Commission, dated Jan. 18, 1977 all in opposition to the preliminary plat. Clerk then read letter from Andrew Olsen of the City Attorney's Office, dated July 28, 1977, which stated the provisions of WAC 197-10-540 of the State Environmental Protection Guidelines may not have been complied with in George Plescher's making of a negative declaration Jan. 13, 1977; that the Planning Dept. should prepare a proposed Declaration of Non-Significance or Significance. This has been prepared but no action can be taken on it until 15 days have elapsed after the proposed declaration is listed in the "Proposed Declaration of Non- Significance Register". Mr. Olsen's memo suggested that notice of such listing be given to the parties interested in the Branch Preliminary Plat. Ken Attebery, Planning Director, spoke about the preliminary plat using a sketch and site plan. He read from RCW 58.17 and then read Planning Commission Resolu- tion No. 391. Stated the only changes in the Resolution are that it will be a 4.8-acre parcel instead of a 5-acre parcel; there will be 16 lots instead of 17; and the lot area sizes are slightly different. Stated this is located in the Sheridan }{eights Area at the west end of E. 30th St. and there is a portion to be dedicated by Program 30 East and donated to the City for Park purposes. He stated the preliminary plat that is before City Council is nearly the same as the one heard by the Planning Commission and he does not feel it would be changed by the diminishing acreage. Discussed department reviews. Stated proposed plat was also submitted to the County Engineer, Kitsap County Planning Dept., Kitsap County Health Dept. and Assessor's Office and the County Engineering Dept. had reviewed it and stated they estimated a minimum of 55 trips a day. Planning Director stated schools are available in the area with Armin Jahr Elementary School within one-half mile. PROPONENT William Kamps, attorney for Mr. Branch, used a vicinity map and showed an area For future streets which the City Engineer thought may be a reasonable measure of developing in the Future. Stated he was showing this plan to make the Council aware of the planning Mr. Branch has put into this development. Stated the biggest problem is drainage and there is a storm drainage line available at the east end of 29th St. Stated the loss of 28 ft. takes away one lot and the homes range from 7,700 sq. ft. to 13,900 sq. ft. in size. They will be in the $70,000.00 price range and will be all First quality homes. Spoke about the open space to be donated to the City for park purposes. Stated the homes will be situated on the lots to give the maximum amount of open space and they will be convenient to shopping centers and downtown and will allow the people to enjoy the City's services. Stated Mr. Branch is willing to come into the City to get these services and the population growth is estimated to be about 50% in the next few years. There will be a demand for homes in this price range. No one spoke in opposition to the preliminary plat. Motion by Mayor Jarstad and Connnissioner Stewart that hearing be closed and testimonyconsidered and decision will be made at next Council Meeting, carried unanimously. FERRY TRAFFIC Mayor Jarstad stated that with the establishment of the Kingdome in Seattle and with the thousands of people from this area leaving their ears on the Bremerton side he has received a number of complaints from persons whose cars have been impounded from private land. There are many problems in downtown due to ferry terminal not having parking. Also, there is a problem of Navy and Shipyard workers parking on City residential streets. Stated the City is pursuing the feasibility of utilizing federal grants to deck over Craven Center. As informa- tion is available, he will make public announcements and finally stated HUD grants may be made available. Meeting adjourned at 11:55 A.M. Approved: G. C. Yeadon, St., City Clerk Glenn K.
