In the meantime, it will be maintained as it is unless the City goes ahead. It will only cost $320.00 to place buttons, which can be removed prior to paving. There is a correction to make when the lanes go through the main span. He a]so suggested it should be noted on the sides of the span that the bridge narrows so the traffic can be guided. Would use ref]ectorized buttons to identify the change in width of the lanes. Mayor Jarstad: 1. Gave Fire Dept. Report and mentioned the one big fire at an unoccupied apartment building. Stated the 319 total runs. This large number is r because the department is running numerous first aid cal]s, 157 in August. The big fine loss is estimated at $205,500.00. 2. Fence has gone up around Coontz Field. Thinks it was handled properly. City Forces went up last Friday and put notices on all the cars that the area was going to be fenced during the weekend. The City is moving in accordance with City Council motion to provide decking for a fishing dock. Commissioner Schoneman asked what was the amount of fire damage at the swimming pool and Mayor Jarstad stated it was around $3,000.00 and there will have to be a decision next year to see if new filters should be put in the swimming pool. It is possible that the new swimming pool will not be com- pleted in time. 5. Has been a lot of interest in skateboarding. Has had two meetings with a group of businessmen who are contemplating coming in spending over $100,000.00 to develop a skateboard arena. He has looked at their layout and they need acreage in or around Bremerton to put this facility. He has evaluated the Park lands and there is no area that can be used because this is a commercial venture. He has furnished them some possible locations where they might be able to get a long-term lease with the State. Commissioner Stewart commented he would like to see a skateboard arena located on City land and get the income into thc Parks fund. Meeting recessed from 9:57 A.M. until 10:05 A.M. REPORT ON PUBLIC EMPLOYEES RETIREMENT SYSTEM Lloyd Baker, Deputy Director of the Retirement Systems, spoke regarding changes in retirement systems effected by the last session of the legisla- ture. He stated that the funds were being kept separate at this time, but he wasn't sure how this would be handled in the Future. He stated the PERS System was in excellent financial condition and the other systems were not as bad as has been depicted. He cautioned that employees who have not yet had all their records turned into the retirement system office in Olympia must have this accomplished not later than Sept. 30, 1977 in order to be under the present systems. He mentioned that the Attorney General's opinion has tied employment to membership and not the date of hiring. He mentioned that it was possible there might be an attempt through the Supreme Court to reduce benefits on the present plans. Stated he felt that there would be legislation introduced to restore some of the benefits to LEOFF System particularly. He spoke about the disability section and stated the coverage was very poor. Suggested that everyone write to their legislators and let them know their feelings about this new retirement system. Motion by Mayor Jarstad and Conmissioner Schoneman to Follow the agenda and hear the report from the Planning Dept. on R-1 Initiative, the McConkey R/W Vacation Decision, the Collier Rezone and Hunters Hideaway Preliminary Plat Mearings, in that order, carried unanimously. PUBLIC RECOGNITION Elizabeth Buell, 1722 High St., stated she had heard a rumor that the City planned to put iTth St. clear through again. Commissioner Schoneman explained that some work had been done on this but it is up to the whether they want to purchase the property and put the road through; that it isn't up to the City. INITIATIVE 1976 ORDINANCE Ken Attebery, Planning Director, reviewed the language of section 328 of the Initiative 1976 Ordinance and stated he saw about four different issues in the text off the zoning ordinance as ]t now reads regarding the site area. First issue concerned the part of the sentence which contains the term "jot line" and he stated that it was clear at the meeting held August 25 that this language was to be taken to the voters and recommended it be eliminated. -4- CITY COUNCIl, MINUTES September 7, 1977 Page five Three other terms in which there are no problems at this time but could cause problems in the future: deplatting, replatting and angular lot lines. Commissioner Stewart asked what an angular lot line represents and Mr. Attcbery stated he did not know but he recommended that language should go out of the ordinance. Mr. Attebery stated further that his primary concern is that he has worked a long time with community groups regarding planning efforts; tbat on the 25th they did adequately cover the term "lot lines" but did net discuss the other terms. So before the elec- tion, he felt those additional terms should be given a public hearing before the language is changed. Mayor Jarstad suggested he set up another hearing right after work so they can discuss these additions to the lot line questien. Mr. Sexton commented that these questions were discussed briefly, regarding replatting and dcplatting and angular lot lines. It was apparent that those persons who were involved and their attorney had some concern about multiple family residences in R-1 and they had some concern it would interfere to some degree with their intent. Using the neighborhood contact approach he did not think there was much time; however, the initiative could be prepared and those three sentences taken out. The language to be removed by a new initiative would be the following: "Notwithstanding any other portion of the Zoning 0rdinamce, no building or structure may be built, nor may any existing structure be altered, that touches or crosses a lot line now existing or hcreinafter platted. Lots may riot be deplatted in a Residential One District, nor may any lot be replatted to include more than 12,500 square feet. Such replatting may be done onJy to adjust angular lot lines." Suggested further that at the same time or in the near future, the Planning Commission can certainly hold study meetings to consider what the concerns of the people were and what they wanted to do. They had some concerns referring to duplexes, lot lines, etc. Maybe everyone can get a better understanding and go tbrough the normal zoning process. This could be achieved through this process and go through the initiative process to get rid of the three sentences. Could then call a general meeting but separate it at this stage from the initiative. Commissioner Stewart stated that the C:ity Attorney should set the language in proper form and have jt sent to the audibor's office to put on the ballot For the people to approve or reject. McCONKEY RiGHT-0F-WAY VACATION DECISION Paul McConkey, 1810 Lower Marine Dr., showed an aerial photograph and explained there would be two entrances For ingress and egress - one on Park and one on Elizabeth. Stated they would llke to put a building on part of the alley arid this is why they have asked for a vacation of this portion of alley stated about 20% or 25% of the 56 units would be using the alley for ingress and egress. Commissioner Stewart stated one of the neighbors last week d]scussed the fact that her wall had been knocked down several times by traffic and she was quite concerned about more traffic. Mr. McConkey stated they are anxious to be good neighbors to the community and they do not want to take anything away from the neighbors; that this would be used as an additional entrance. Commissioner Schoneman stated he felt it was safer to have an additional entrance in case of fire. Phyllis McCarthy, 1703 Park, asked if the alley would have to widened and Mr. McConkey stated no, they did not anticipate a lot of use of the alley, that most people would use the other two entrances. Mrs. McCarthy asked if the alley would be a thoroughfare and Commissioner Schoneman stated the people would not want to use it because it is a traffic hazard onto 17th. Mr. Justesen, 833 Pacific, stated he is opposed to the vacation because the people who have garages in that alley will not be able to back their cars out of their garages because off the traffic. He stated he could not back his car out of his garage unless someone guided him and this would be the same situation these people would have. Mr. McConkey stated the traffic situation would not be the same in this area as on Pacific where Mr. Justesen lives. tic stated Further that he believed this project will be a benefit and if the alley becomes a problem the City can close the alley off. Me stated the added entrance and exit is a safety factor. Commissioner Stewart stated he had no objection to vacating the alley; that if there is a traffic problem, the City will take appropriate action to close off the alley so they can't go in and out. Commissioner Schoneman stated the alley could be changed to -5- CITY COUNCIL MINUTES September 7, 1977 Page six one-way and if it is necessary to do this, it will be considered in the future. Mayor Jarstad commented that there are some alternatives that should be worked out with the people in the neighborhood. Motion by Commissioners Schoneman and Stewart to approve vacation of this portion ofalley and it should be forever open (traffic can go out on Park Ave.) to public use and there will be no signs in the future that this is a private roadway. Under discussion: Mr. McConkcy stated he agreed to this. Motion carried unanimously. COLLIER REZONE HEARING Clerk stated he had posted, advertised and mailed letters of notification as required by law. He read Plamning Commission Resolution No. 425 which recommended approval of fezone from R-1 to R-2, with conditions. Clerk stated 29 advisory ballots had been sent, 14 returned with 7 agreeing and 7 disagreeing. Ken ~ttebery, Planning Director', spoke about the fezone using a colored sketch and site plan. Re stated the original request was to build a duplex and remodel the existing structure, but the passage of the R-1 Initiative Ordinance prohibits this. Mr'. Collier then requested approval to build a fourplex, but the Planning Commission came to the con- clusion that three units would be better and Mr. Collier submitted a plan for a triplex. lie stated the surrounding land use is single family and the Manette School is located directly to the west. Stated all utilities are available and there were no adverse comments from any City department. PROPONENT: Mal Collier, Star Rt. 1, Box 356A, Bremerton, stated he had contacted all the residents within the 250 ft. radius and the first time he talked to them, only one person said no way on the fezone and one other' objected to the rezoning but not the develepment he planned to build. He stated that after the advisory ballots came in, he went back and talked to them with varying responses; that many of them thought all of Manette would be rezoned to R-2. Stated hc wanted to build units and live in one himself; that his first plan was to remodel the existing older home and build a duplex but this was taken away from him by the R-1 Initiative Ordinance so he decided to build a fourplex. Upon recommendation of the Planning Commission, he changed that plan and decided to build a triplex, but with rising costs, he feels it is net feasible to build a triplex and he wants to go back to the fourp]ex. He stated the only difference in the plan wou]d be that the garage weuld be a one-bedroom unit and there will be four covered parking places. tie asked for approval of his request to build a fourplex and fezone te R-2. Commissioner Stewart asked him if he would remodel the existing home and build a duplex on this property if the R-1 Initiative were changed and Mr. Collier stated this was his origina] intention and he did not think it was feasible monetarily to tear this old house down. OPPONENTS: Ken Davis, 1348 Ironsides, stated he objected to the fezone because of the traffic due to the Senior Citizens Center and the Manette Playfield. tie stated there is a fair amount of pedestrian traffic and a considerable amount of vehicle traffic which flows in and out of the area. He stated that sometimes just four or six cars makes a big difference and this is a low-density neighborhood and they want it kept that way, with single-family dwellings. Stated change has been very slow in the neighborhood and the population has remained constant. Evan Davies, 1327 Ironsides, stated he is opposed to this fezone; that he doesn't feel spot zoning is suitable for this residential arcs. He stated the fezone would change their life- style and that is the biggest opposition the neighbors have. Stated he wanted to go on record as being opposed to this change. Mrs. Anderson, 1146 Ironsides, stated the place right now is an eyesore and she would be happy to see something nice go in there, but not a triplex. Stated she would not be opposed to a duplex and she hoped Mr. Collier can come up with something nice. Ed Machinski, 321 Lebo, spoke for his son who lives on Nipsic and is away in the service. tie stated that Mr. Collier bought this property as an investment and iP it is rezoned to R-2, he can turn around and sell it and a larger unit can go in there. Stated he is opposed to the -6- CITY COUNCIL MINUTES September 7, 1977 Page seven Mayor Jarstad stated the Planning Commission approved fezone from R-I to R-2 For development of a triplex and now Mr. Collier has requested that this be changed to approve construction of a fourplex. He stated that City Council always evaluates whether it is an acceptable utilization of property and if the Facility being placed there is in keeping with the character of the community; that the people have a very valid concern of restricting the property's zoning to R-i. He stated the neighbors want the R-1 density to remain in this portion of Bremerton and they do not want to have R-2 zones established. Coxmmissioner Stewart stated that he thinks s change has to be made in the R-1 Initiative Ordinance so Mr. Collier can do something with his property. Me stated City Council cannot act on his request to construct a fourplex because the Planning Commission approved the site plan flora triplex. Commissioner Schoneman commented that the original plan shows a duplex with a remodel on the existing building; that he bought this property For that purpose and when the R-1 Initiative passed, it threw his plans out altogether. tie stated the court case to determine whether or not the Initiative is legal will be held Sept. 16, 1977. Hc stated further that any action on the rezone should be delayed until a count decision is made. Motion by Commissioner Schoneman to delay any action on this application For fezone until some decision has been made through court as to the legality of the initiative. Mr. Sexton stated that the hearing date will not occur on Sept. 16th, but hopefully will be sometime in October. Motion died for lack of second. Motion by Mayor Jarstad and Commissioner Stewart to deny fezone from R-i to R-2, carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, Yes; Commissioner Schoneman, Abstain. HUNTERS HIDEAWAY pRELiMINARY PLAT HEARING Clerk stated he had posted and advertised as required by law. He then read Planning Commission Resolution No. 424 recommending approval. Clerk stated no correspondence had been received. Ken Attebery, Planning Director, spoke about preliminary plat using a colored sketch and site plan. He stated the proposal was to divide the 2.5 acre parcel into seven building lots and one open space lot; that the seven lots are to be developed with duplexcs. He stated the surrounding land use is low-density residential with a number of substantial vacant tracts in the area; that the parcel lies between the freeway and Brentwood Dr. at Brcntwood Drive's intersection with Shorewood Dr. PROPONENT: Ted Johnson, Post Office Box 97, Silverdale, Consulting Engineer for the petitioners, stated he would like to have flexibility in working out the recommendations of the Engineering Dept. concerning the pipe, the pipe material, location of water and sewer lines, the access road and width of the road which is to be dedicated. Regarding open space he stated it could be dedicated or retained; that the open space is basically a ravine and is a play area for children. Commissioner Schoneman stated everything can be worked out as far' as the various departments are concerned and the request of the Engineering Dept. could be reviewed along with the suggestions of the develooer before the permit is issued. Mr. Johnson stated that would be satisfactor7 as long as he could have a little flexibj]ity. Motion by Commissioners Schoneman and Stewart to accept pre]imina~ plat, carried unanimously. INITIATIVE ORDINANCE (Letter from Board of Realtors) Clerk read letter from Bremerton Kitsap Board of Realtors, dated Sept. 7, i977, which stated the Board of Realtors has taken a position that zoning by initiative as done with Initiative i976 is in direct violation of the constitutional rights and they will support a court suit to determine the validity of that Initiative; that any change should be a change by deleting the entire section 328.1 of the Initiative. PROCLANATION Clerk read proclamation proclaiming the month of September, 1977 as "Breath of Life Month". -7- CiTY COUNCIL MINUTES September 7, 1977 Page eight CHANGE TO STATE RETIREMENT SYSTEMS Clerk read memo from City Auditor, dated Sept. 6, 1977, which gave report of the State Retiremen~: Systems Seminar he artended on Aug. 29, i977.
