REPORT ON INITIATIVE DISCUSSION HELD ON SEPTEMBER 13, 1977 - R-1 Clerk read memo. dated Sept. 14, 1977, from Planning Director giving a report on the meeting held Sept. 13th for the purpose of further discussion of the issues surrounding the new R-1 Initiative language. The full memorandum is available in the Planning Department files. It set out three priorities after discussing the three sentences that had been approved to be stricken from the original initiative ordinance providing it was finally approved by the voters. Mayor Jarstad stated the city had until Sept. 23d to get the amending language to the county auditor for placing on the November 8th ballot. Connnissioner Stewart discussed at some length the priorities and cautioned against becoming too restrictive in the language. Mr. Sexton stated this may involve some legal opinion and he gave some preliminary thoughts on the priorities. Priority #t would be unconstitutional approach. #3 would run into the same problem currently have - discrimination, arbitrary and capricious. #2 is a legal alternative, ~f the City Council desires to go that route. The City has, and the people have, a readily accessible method for making changes in the zoning ordinance and that is done by ordinance. The city should be very careful about getting into the initiative position where they in essence restrict their alternatives in the future to work in the zoning area. That deals with the question that came up a long time ago - the right to control zoning through the initiative route. Commissioner Stewart discussed and recommended putting through a minimum maintenance ordinance so areas would not be allowed to deteriorate. Suggested this should be studied by the neighborhood groups. Mr. Louis De Tienne, 233 Elm Street, agreed with Mr. Stewart and stated he intended to get into this minimum standard, as he would like to see something done. No action taken at this time as there is a week left yet before county auditor needs a filing.
