fair to charge for a vehicle that just sits; that it isn't fair to compare

PUBLIC RECOGNITION
Everett Costello, 936 Lower Oyster Bay Road, complained that the landfill
on Kitsap Way, located on the former Danskin property, slides every time it
rains. Discussion followed and Mr. Attbery obtained the original of the
land use declaration and it was evident that landfill was to be controlled,
storm water drainage and bulkheading was to be installed. Commissioner
Schoneman commented that the Street Dept. had been in the area several times
to keep the street open From the erosion. Mr. Sexton advised Mr. Costello
to talk to Mr. Robinson, one of the owners of the property, and see if he
could obtain his cooperation. In addition, Mr. Sexton advised that the City
would follow up the land use declaration provisions and see that the problem
is taken care of properly.
Larry Lewis of the State Dept. of Ecology stated he came over to talk to the
City and bring to the commissioners' attention some developments with respect
to the Sinclair Sewer System; that the project is ongoing and presently the
State is in the process of working on projects which would come in the FY78.
A public hearing has been set For May 26 at 1:30 in the City Council Chambers,
Olympia, located at 8th and Plum Streets. He stated it was important that
the City be represented but if not possible, a letter could be sent in. He
discussed the amount of dollars which will be available and stated there are
more projects desired than there are dollars. He mentioned that the City's
sewer system and disposal system is imperative of being modernized. He stated
it was imperative for the City to continue with the program and Funds be made
available for this project to continue. Commissioner Stewart stated he was
glad Mr. Lewis came over and delays are very costly. Mr. Lewis stated he had
already contacted Mr. Dehn and he would be at the meeting. Commissioner Schoneman
stated he would be there and Commissioner Stewart stated he may also go to the
meeting.
TAXICAB HEARING
Commissioner Stewart stated that before the hearing was officially opened by
motion, he wanted to discuss a proposed ordinance which he had before the City
Council two weeks ago and had discussed on several occasions. The proposed
ordinance would make it possible for temporary taxicab licenses to be issued
based on volume of business; that one of the problems in the past in the taxi-
cab operations was that licenses were granted and if business fell off, the
licenses were sold at a windfall profit. He stated he had called other places
and found there is no correlation between the population and the number of
cabs. Stated he felt it was a hardship for a cab company to apply for
additional licenses under the present ordinance and he thought a temporary
license based on volume and issued for each quarter that the volume was sufficient
would answer the problem. The cost would be $25.00 for each quarter and he
suggested $2,500.00 of gross business per month. If business increased another
license could be issued. If it decreased, the license would not be renewed.
Mr. Sexton suggested the ordinance could be considered and the City Council
could act on it, but it won't have any effect on the application that has been
filed. Commissioner Stewart stated the company has the right to apply under the
present ordinance; however, the present ordinance has not worked out in the past
and he believed there is a need for additional licenses but he believed it should
be met through the volume of the business being done at the time. If there is
any restriction, it must be on the volume of business.

ORDINANCE - TEMPORARY TAXICAB LICENSES
Clerk read the proposed ordinance. Commissioner Stewart stated there were
various ways of determining the accuracy of the gross volume. Mr. Sexton
stated the Council has the authority to do what they want; however, he wondered
if this isn't something that should be set for hearing to allow everyone to
speak on the proposal. It was noted that the parties interested in the ordinance
were present, Mr. Costello and his clients and Mr. James Leyde, owner of Leyde
Enterprises. Mayor Jarstad stated that the proposal has a lot of merit. He
noted that the City has granted new licenses to new companies in the past and
they have lasted about six months and have gone bankrupt. Many have been
transferred several times, either transferring or going bankrupt. Commissioner
Stewart stated the proposed ordinance did not affect the permanent ordinance
concerning permanent licenses and Mr. Leyde stated he had been listening to the
proposal and had no objection. He stated if the company had this much business,
they should get a license provided it is justified. tie stated if the business
is there, the company should not be restrained and he felt that the City should
not issue a bunch of permanent licenses. He recommended temporary licenses but
felt they should be monitored. He suggested that maybe $2,500.00 volume is
too low and suggested going in steps. Mr. Leyde stated again he had no objec-
tion as long as the issuance of temporary licenses is monitored.
ORDINANCE N0. 3361 - Temporary Taxicab Licenses (Emergency)

gave the options open to Leonard Costclio, attorney for Arrow Cab Co. Mr.
Costclio, after conferring with his clients, stated that he would withdraw
the application for permanent licenses. Discussion followed concerning
postponing the hearing. Mr. Costello stated he would like the opportunity
to look at the amendment if the Council was willing to table the hearing for
two weeks.
Motion by Mayor Jarstad and Commissioner Schoneman to table hearing for two
weeks, carried unanimously.

ST. PAUL'S CHURCH CEMETERY
Ken Attebery, City Planner, stated that a Special Use Permit was issued for a
cemetery for interment of ashes and now a plat is being proposed by the church
and this involves 21 blocks, each 2x2, and 24 lots, 8x12. He stated there is
no requirement for cemetery plats to go through the full subdivision hearings;
however, it is 'traditional in this county to go through the Council. He
recommended that the City Council authorize the mayor and city clerk to sign
this plat. Commissioner Schoneman stated he originally questioned the location
of cemeteries within church ownership because it could boomerang throughout the
City; however, they do have their permit after hearing.
Motion by Commissioners Schoneman and Stewart to authorize the mayor' and city
clerk to sign the plat. Under discussion: Commissioner Stewart commented that
this was passed without Council approval at the planning level only and he would
like to have had this come before the Council. He stated he was not too much
in favor of cemeteries adjacent to every church. Commissioner Schoneman suggested
it should be restricted and basis could be on certain number of acres. Commis-
sioner Stewart said he would agree with Mr. Schoneman if he wanted to go for
restrictions for cemeteries. lie questioned having a cemetery on tax-free
property and stated he was opposed to this without any hearings. Mr. Attebery
stated he would like to provide the Council with information that was available
prior to the Special Use Permit being approved. Commissioner Stewart again
stated he would like to have some control over this type of application in the
future. Mr. Attebery stated he could put it on the planning agenda. Motion
carried.
