pumping station; that the bulkhead is not protected by a guard rail. It
stated further that his son was hit by a swing at Sheridan Park while his
wife was inside the Community Center voting for the park bonds. The letter
stated further that installation of a guard rail at the foot of Second St.
to prevent future accidents and at least a study of the feasibility of making
the swings safer in some way, would be the action of a responsible City official.

be limited to an instantaneous diversion rate of 200 gallons per minute with
an estimated total withdrawal of 15 acre feet until Sept. 30, 1977. The
letter from DOE to Mr. Olsen, dated May 3, 1977, stated that if the entire
15 acre feet were withdrawn directly from the lake, it would result in a drop
in lake level of slightly over one-half inch. Commissioner Stewart commented
that the thing to do is to monitor the lake and make sure the level of the
lake does not go down any Further. Commissioner Schoneman commented that the
permit is good only until Sept. 30, 1977 and the amount of water drawn from
the lake has been cut down from 500 gallons to 200 gallons per minute.

and area maps according to Ordinance No. 1792 (American Marine Bank)".

RESOLUTION NO. 1726 - REWARD FOR APPREHENDING VANDALS
Deputy Clerk read Resolution No.' 1726, "A RESOLUTION authorizing the payment
of rewards for persons furnishing information leading to the apprehension and
conviction of persons violating certain municipal ordinances".
Motion by Commissioner Schoneman and Mayor Jarstad to pass Resolution No.
1726. Under discussion: Commissioner Stewart stated something should be
done to protect private property from vandals and asked if this reward could
include private property as well as City property. Mr. McCluskey stated that
public funds cannot be expended for private property. Commissioner Stewart
asked Mr. McCluskey to check into it further because it costs a lot more to
apprehend vandals than it would for the $200.00 reward. Mr. McCluskey stated
he would look into it further. Commissioner Schoneman stated he has pictures
of damage done by vandals last week at Meadowdale Pump Station. He gave details
of the destruction and stated a resolution of this type is needed. Motion
carried unanimously.
VOUCHER 6951 - COMPASS MANAGEMENT
Deputy Clerk read memo from City Clerk, dated May 24, 1977, which requested
approval of voucher 6951 in the amount of $477.45 to Compass Management, which
was released last week through an oversight.
Motion by Commissioner Stewart and Mayor Jarstad to approve payment of voucher
6951 for $477.45, as audited by John Ross. Commissioner Stewart stated he did
not want to pay them any more money until they get the job done; that they
are behind schedule now, Motion carried unanimously.
PUBLIC RECOGNITION
Mayor Jarstad introduced the delegates from East High who will be attending
Girls' State in Ellensberg this year. They are: Christy Knight, Laurie
Martin and Judy Redenbaugh.
Stan Satvet, 4409 Brentridge Place, spoke about the construction of the new
Elks' Lodge to be built in East Bremerton behind Holy Trinity Catholic Church.
Stated an 8,000 gallon septic tank would have to be installed to accommodate
the building; that they would like to hook up to the Bremerton sewer system
as they would like to annex to the City of Bremerton. Mayor Jarstad stated
there is a petition being circulated to bring that whole area in the David
addition i~to the City and Commissioner Schoneman explained that did not include
the portion Mr. Sarver was discussing. Commissioner Schoneman explained why
it was decided not to let anyone in the county connect with the City sewer
and stated if the property were annexed, they could then connect to the City
sewer. A lengthy discussion followed and it was the consensus of the Council
-4-

that the easiest process for annexation would probably be to try and annex
with the other portion over to Wheaton Way. The property where the new
Elks' Lodge is to be built is not contiguous with the City limits now. Commis-
sioner Stewart asked Mr. Sarver if they would be willing to help with the
annexation petition and Mr. Sarver said they would help. Mayor Jarstad
suggested that Mr. Sarver talk to the Planning Dept. and get a map showing
the city limits and Mr. Sarver stated he would go talk to them today.
Robert Green, 2022 Taft, stated that two years ago he obtained a Shoreline
Development Permit for a piece of property on Snyder Ave. on which he planned
to build four townhouses under the nine units per acre ordinance. He did
not get a building permit at that time, and now the Building Dept. won't issue
a permit to him. Stated he felt that inasmuch as hearings were held, he should
not have to go through more hearings for a rezone. Commissioner Stewart stated
this was a legal question, not a Council action. Mr. McCluskey stated that
the Building Department's decision not to issue a building permit could be
appealed. He stated further that until the building permit has been approved,
Mr. Green does not have any "vested rights" in the property under the zoning
at that time. Mayor Jarstad stated it would appear that the fastest route
would be to apply for a rezone. Mr. McCluskey stated that Mr. Green's only
avenue other than applying for a fezone is to appeal the building department's
decision not to issue him a building permit. Mr. Green asked who would hear
an appeal and Mr. McCluskey told him the City Council would hear
Shirley Perry of the View Ridge Neighborhood and representative of the Council
of Neighborhoods spoke about a fence that has been erected across a path the
children of her neighborhood use to go to and from school. Stated that when
the Conifer Apartments were constructed, the View Ridge Neighborhood negotiated
with them for a walkway through their property and now a fence has been placed
to keep the children and everyone else from using it. Commissioner Stewart
stated he had talked to the City Attorney's office and he feels certain that
the fence will have to be removed or a gate installed so people can use this
path. Mrs. Perry stated she felt the neighborhood needed a definite plan to
guarantee a path through the property. Commissioner Schoneman stated the City
cannot make plans unless requested by the residents of that street through an
LID and an LID has to be initiated by the people. Asked her to get a petition
for an LID and the City will then prepare a plan. A lengthy discussion followed
in regard to an LID and Mayor Jarstad commented that many of the residents in
that area did not want anything to do with an LID because many of them feel the
entire area will be zoned commercial and they will sell out. Mrs. Perry agreed
that many people will not sign an LID, but stated the children still need protection
and something must be done to protect them. Commissioner Stewart stated again
that the City Attorney's office is working on this problem and she should give
them a few days to settle it.
HEARINGS - Arrow Cab Co., American Marine Bank Annexation, a Cronkhite Annexation
Motion by Mayor Jarstad and Commissioner Stewart to hold hearings at this time,
in the order listed on the agenda, carried unanimously.
ARROW CAB CO:
Mayor Jarstad stated since Arrow Cab Co. has requested a temporary taxicab
license and no one was present for the hearing, that the hearing should be
considered closed.
Motion by Mayor Jarstad and Commissioner Stewart to consider hearing closed,
carried unanimously.

AMERICAN MARINE BANK ANNEXATION - MEETING/PETITIONER
Ken Attebery, Planning Director, explained legal procedures to be followed
by the Council. Mr. Carl Berg of the American Marine Bank was present at
the hearing. Commissioners discussed the procedures and the following motions
were made:
Motion by Mayor Jarstad and Commissioner Schoneman that the Council will
accept the annexation if the petitioners are successful in gaining the signa-
tures of the owners of 75% of the assessed valuation, carried unanimously.
Motion by Mayor Jarstad and Commissioner Stewart that this be brought in
under business zoning as shown on the comprehensive plan, carried unanimously.
Motion by Mayor Jarstad and Commissioner Schoneman that the petitioner be
required to assume all or any portion of existing City debts, carried
unanimously.
CRONKHITE ANNEXATION - MEETING/PETITIONER
Ken Attebery, Planning Director, gave a brief description of the property
using a map and stated there may be some problems with the Boundary Review
Board in leaving a small group of lots to the east of the proposed area in
the County. Leonard Kruse, attorney representing the petitioners, spoke
about the area and stated it was his feeling that the only way this area
will be annexed is piece-by-piece because too many residents in the area
do not want to be annexed at this time. Deputy Clerk read a memo from the
Planning Dept., dated May 25, 1977, which recommended that at a minimum the
right-of-way at the intersection of Corbet and 15th should be added to the
annexation area; that in regard to the Boundary Review Board criteria for
annexation, it further recommended that the entire block and the full 17th
Street right-of-way be included in the annexation. It stated further that
a simple extension of the city limit line north along Corbet to 19th would be
better yet. A discussion was held in regard to the city limit lines and the
following motions were made:
Motion by Commissioners Schoneman and Stewart that the Council will accept
the annexation if the petitioners are successful in gaining the signatures
of the owners of 75% of the assessed valuation, carried unanimously.
Motion by Commissioners Schoncman and Stewart that in regard to the zoning
and land use plan property be annexed under R-1 under the existing comprehen-
sive plan, carried unanimously.
Motion by Commissioner Schoneman and Mayor Jarstad that the petitioner be
required to assume all or any portion of existing City debts, carried
unanimously.
BILLS
Motion by Commissioners Stewart and Schoneman to give blanket approval to
vouchers 7032 to 7035 and 7037 to 7135 inclusive in the amount of $59,698.37,
audited by John R. Ross, carried unanimously.
Meeting recessed from 11:25 A.M. until 11:50 A.M.
COMMISSIONERS' REPORTS
Commissioner Stewart:
i. Very happy about the award on the parking garage. Diamond is charging
less money to manage it, which he thinks is great.

2. People are calling up about caterpillars. Would like to find a private
contractor who could contact people with a caterpillar problem and tell them to
take care of it ar he will do it for them and the City will put a lien on their property for
payment. Mr. McCluskey read the ordinance which applies to caterpillars and
gave the guidelines to follow to eradicate caterpillars. Commissioner Stewart
suggested contacting a caterpillar eradicator, designate him as the City's
agent and get these caterpillars taken care of. Commissioner Schoneman stated
his office has been sending letters out and no one has refused yet to take care
of the problem. Commissioner Stewart stated there were caterpillars on City
trees also, but Colmmissioner Schoneman explained that the City trees have all
been sprayed.
3. Stated sidewalks that are owned by private property as well as public are
being taken over by ragweed so people can't walk down the sidewalks. There is
a place on Reid and another on Lebo where the ragweed grows all over the side-
walk. Wondered if property owners should pay for removal of the ragweed if it
is his property. Commissioner Schoneman stated sidewalks are the responsibility
of the abutting owners for repairs, broken concrete, etc. If it abuts on City
property, the City is responsible.
4. Received a copy of the PSNS special bus runs. Stated there is one bus run
that only gets 11 bus passengers a week. Talked to the bus company to do some
consolidating on their special bus runs because only seven of these runs are
making a profit.
Commissioner Schoneman:
1. Was at the Wheaton/Sylvan project early this morning and reviewed the progress
being made. Congratulated Moss Construction for the work being done. Traffic
is slowed down at times, but it is passing through. Do not have to use a lot of
by-pass roads to get through. Also, on Sheridan Rd., the water dept. is out of
there now and the street dept. is just completing an extension of the sanitary
sewer that will be paid for by the developers of the land east of McClain. Should
be out of there the latter part of August.
2. Periodic rains have helped quite a bit in not having to use a lot of water.
People have taken advantage of the rain and have discontinued their sprinkling,
even at the higher rate.
S. Tomorrow the State of Washington will be conducting a public hearing to
consider wastewater construction projects to be funded 75% federal/25% state
during this next fiscal year. This meeting will be held tomorrow at the Olympia
City Hall at l:30 P.M. Commissioner Stewart commented that he is taking Norm
Dicks' administrative assistant with him so she can speak on it too. Commissioner
Schoneman stated they expect to get some information on it. Stated Red Beck
had invited him to lunch at the Senate.
Asst. City Attorney McCluskey:
Stated his office had been requested to come forward with an opinion concerning
the Mercer Enterprises suit. Stated some extensive research had been done, but
he wanted to request an additional week to continue the research.
Commissioner Schoneman:
4. Stated he received a letter from Art Anderson & Associates which stated
that the general warranty on the Community Theatre Building was close to
expiration and any items requiring contractor's correction should be brought
to the contractor's attention as soon as possible. Stated the only significant
problems the Community Theatre advisors are aware of is with the spray-on
insulation. The insulation bears a five-year warranty by the applicator.
Stated the Building Dept. will review the exterior prior to the expiration date.
Commissioner Stewart stated he feltit is one of the finest Community Theatres
in the northwest.
Mayor Jarstad:
1. Thanked Mrs. R. J. Smith, who donated to the memory of her deceased husband a totem
pole which has been placed at the entrance of Eastpark on Wheaton. Had
the help of the Cub Scouts who painted the totem pole and helped to refurbish
it. Certainly appreciated their help. Commissioner Schoneman stated it
will be dedicated to R. J. Smith and a placque will be placed at the totem pole
commemorating him as a builder.

2. Stated the final design on the Coontz School property has been delivered
to Mr. Pendergast. Stated the design will be taken to the school board meeting
tomorrow night and the school board has on their agenda to take action on the
applications that have been submitted for the option to buy the property and
also the lease arrangement. If the school board approves the option to purchase,
the City will then have under construction immediately the development of this
site. Will show the development plans to the school board members to show them
what is contemplated being done with the land. Also will take site plan
and schedule meetings with some of the neighborhood people who have been before
the Council. Gave a description of what will be built on this property. Stated
he would get the drawing and show the Council the complete plans as they are
proposed. Stated again if the school board approves the agreement, then the
City will immediately move for the implementation of this schedule of updating
that field.
3. Stated an appraisal has been received on the White blueberry property and
that will be made available to the commissioners.
Mr. McCluskey commented that Superior Court approval is needed to purchase
the Coontz School property and Mayor Jarstad agreed but stated this approval
was not needed on a lease arrangement.
MENTOR ANNEXATION - Corbet Dr./Kitsap Way
Deputy Clerk read memo from Planning Dept., dated May 25, 1977, which stated
the Boundary Review Board made their decision to approve the Mentor Annexation
and chose not to invoke jurisdiction. It requested that City Council set a
date for public hearing on the annexation.
