Mr. McCluskey advised the Council the proper order of business would be to now reaffirm the issuance of the Shorelines Management Permit subject to the condi- tions set out in the Final Findings of Fact and Conclusions of Law and Order, dated May 2?, 1977, and stated the permit will set out these conditions. Mr. Wowaras showed a site plan and stated that he had removed two 16-unit buildings and brought it down to the Shorelines Management Board's conditions; that he then will enhance the additional land which is made available and this will make a better project in some respects. Ken Attebery, Planning Director, stated he felt this would be initially the same site plan and a hearing would not have to be held. Motion by Mayor .Jarstad and Commissioner Schoneman to approve the new Shorelines Permit with the conditions imposed upon it by the fact-Finding commission of the Shorelines Management Board plus any conditions the City Council put upon it, carried unanimously. Mr. Wowaras stated he had another site plan which had just been before the Planning Commission and would be coming before the City Council shortly. Mr. Pat Carey stated it has been the feeling of the people of the area that adequate protection should be given for the madrona trees and for open space and it has been suggested that the City negotiate and purchase one of the R-I lots in the "conservancy" area of the shorelines area. He noted the great view from the area of the madrona trees. PUBLIC RECOGNITION Carl Anderson, 1513 Eastlake Dr., complained about work done next to his property near Kitsap Lake, work that had been commenced before James Skirving had obtained a permit. He went into detail about alleged violations by Mr. Skirving and the resulting damage to his property; that so far he had received no redress from Mr. Skitying and was appealing to the City Council because of the purported violations. After discussion of the City Council and hearing Mr. Anderson out in detail, it was believed that Commissioner Schoneman should look into the situation. It appeared from the discusston that Commissioner Schoneman had not heard of the complaints before. it was the mayor's opinion that when a person was dealing with any staff people and not getting satisfaction, that person should be encour- aged to come before the City Council. Commissioner Stewart stated that Commissioner Schoneman will report back to the City Council as well as to Mr. Anderson. Mrs. Anne Maloof, Rt. 1, Box 1740, stated she came before the City Council to ask if the rains had any effect on the pond and the permit to pump water out of Kitsap Lake (Mr. James Skirving matter). She stated the ditch was three ft. wide, three ft. deep and 150 ft. in length. Mr. Costello looked into the matter when it was reported to him. In discussions, it became apparent that Commissioner Schoneman was not aware of the problem; however, he stated that at this time it was only an assumption. Mayor Jarstad stated he had talked to Mr. Costello and he had stated that Mr. Skirving did commence work before a permit was issued. Commissioner Schoneman stated if that were true, he was in favor of imposing a fine of $500.00. Mr. McCluskey explained the legal procedures required in order to get the case before the court. Motion by Commissioners Schoneman and Stewart to prosecute Mr. Skirving for commencing work before obtaining a permit.
