Mayor Jarstad ordered the minutes stand approved as read. ELIMINATING PARKING METERS Clerk read letter from Dick Linkletter dated June 29, 1977, which stated the he deplores the loss of several spaces of parking; that if the traffic flow were corrected, the total parking would remain the same and congestion relieved. It requested that Council consider stopping left turns coming out of the parking lot at the House of Values before deleting any parking space. Clerk then read memo from Capt. Stratton, dated June 25, 1977 which stated the Traffic Dept. agrees to remove five parking meters on Washington Ave. ; that the removal of two parking meters on Second St. would not serve any useful purpose because the width of the east bound lane is not wide enough for both a right turn and left turn lane; that it is felt that by changing the ingress and egress of the parking lot at House of Values it would eliminate the bottle neck in the traffic flow; and recommended that this be given a chance to prove itself prior to removal of the meters on Fifth St. Sgt. Gingrey spoke about eliminating the parking meters and stated the Traffic Division felt at this time the only ones that should be removed are the ones on Washington Ave.; that they had met with the manager of the House of Values and a representative of Bremers and the exit and entrance to the parking lot had been changed, leaving the entrance on Fifth St. and the exit in the alley. He stated that if this didn't work they will completely block off the entrance on Fifth St. and put it on Park Ave. He stated the collection booth has been removed so the traffic will not be held up to get a parking ticket. Commissioner Schoneman explained his plan be remove the parking meters and a lengthy discus- sion followed about the width of Second St. Sgt. Gingrey shared only 17'10" wide from the curb to the centerline and Commissioner Schoneman staled the engineer's report shows it to be 26 ft. wide. Motion by Commissioners Schoneman and Stewart to remove meters between Second and Burwell on the west side of Washington carried unanimously- A lengthy discussion followed about the traffic backup on Second St. and the width of Second St. and Mayor Jarstad suggested postponing the decision on bhe parking meters on Second Street. until the width can be checked out. Gave Mr. Amo's background and stated he feels Mr. Amo will be an asset to the Planning Commission. Motion by Mayor Jarstad and Commissioner Stewart to reappoint Bill Murdock to the Parks Board and appoint Bill Amo to the Planning Commission, carried unanimously. PUBLIC RECOGNITION Ralph Erickson presented a letter to the City Clerk, dated June 29, 1977. Clerk read the letter which requested a one-year extension for the Shoreline Management Permit #5-72 issued to Timkath Co. on July 19, 1972; that they have met with numerous setbacks but they feel the project can be completed if the one-year extension is granted. Clerk then read letter signed by George Flescher, dated April 7, 1976, which stated that it is his opinion that the permit remains valid untdl 5 years from the date of issue. Mr. Erickson stated that the project should be finished within one year if the extension is granted. Motion by Commissioners Schoneman and stewart to allow extension for one year, carried unanimously. Joe Stadler, 908 Park Ave., presented a petition signed by 214 property owners which stated: (1) We do not want the Bremerton City Council to declare our area blighted; (2) We do not want our property condemned; and (3) We do not want our federal taxes to support a certain group of businessmen or properties and feel that all businessmen should compete on an even basis. It is our desire that you cease all actions that would cause these things to happen. Mr. Stadler stated that of all the persons he talked to, only 8 felt they should not sign this petition. A lengthy discussion followed and Mayor Jarstad explained that in order to get federal funding, application must be made for these funds and this is one of the purposes of the hearings. He stated it is only a process to request the federal people to look and see what arrangements can be made to improve the residential areas close to downtown. Commissioner Stewart stated he sympathized with the public because federal grants are costing a lot of money; that he felt it is time people who own the property clean it up. Mr. Stadler stated that most of the people in the area want to improve and upgrade their homes, bat they do not want the federal government to come in and tell them what to do with their property. Mayor Jarstad commented that in order to get any tax dollars back to work in the community, application must be made. He stated further that if the people in that area do not want to participate, the Council is looking at that as testimony; that the intent was not to bulldoze and take people out of their homes. He thanked Mr. Stadler for the work he put in getting signatures on this petition. An unidentified lady in the audience spoke about a stripped car on McKenzme between 9th and llth and stated she had called the police about it, but it had not been removed yet. Mayor Jarstad assured her that it would be taken care of. Emmanuel Justesen, 833 Pacific, asked what happened to the comprehensive plan that was adopted in 1966. Mayor Jarstad explained that this is a guide for the City to go on. Mr. Justesen stated that not much has been done in the residential areas in 11 years. -3- CITY COUNCIL MINUTES June 29, 1977 Page four Charles Ullock, 1137 Lower Marine Dr., read a letter dated June 28, 1977, which stated that a recently constructed dental clinic located on the NW corner of Pacific and 9th St. does not seem to be located on the site in conformance with the requirements of the City Zoning Ordinance. The letter listed several facts that substantiated his claim and he asked what action the City Council intends to initiate regarding the violations. Commissioner Stewart stated if these are true, then the City Attorney should be directed to prosecute. Motion by Commissioner Stewart and Mayor Jarstad that bhe City Attorney's office check this out and prosecute if warranted, carried unanimously. MANETTE BRIDGE RIGHT OF WAY LEASE TO RICHARD MCDONALD FROM STATE HIGHWAY DEPT. Glenn Vockrodt, 1409 Marlow, representing the Manette Peninsula Association, requested permission and/or assistance in developing a park at the east end of' the Manette Bridge sometime ago; stated that now they find this is State property and the State is leasing it to Richard McDonald. Requested that the City take some remedial action to retain this property for public use. Clerk read memo from Planning Dept., dated dune 29, 1977, which stated a meeting was held between the City, State Highway Dept., Mr. McDonald and members of the Manette Neighbor- hood; that all parties agreed to support an interim lease between the State ilighway Dept. and Mr. McDonald to utilize the gravel portion of the area in question. The memo stated Further that the purpose of the interim lease would be to allow the City time to assess the possibility of leasing a large area including the McDonald lease area in order to develop a coordinated parking and beautifiesLion plan which could equally benefit the City, the Manette Neighborhood and Mr. McDonald. Ken Attebery, Planning Director, spoke about the proposed lease using a blackboard sketch. He recommended the City Council approve leasing the grave] portion and notifying the State Highway Dept. that the City is approving an interim lease. Mayor Jarstad stated he would like to set up a meeting with all parties involved or interested for next week and work it out then. Mr. Attebery stated he would set up such a meeting. HEARINGS - Schuyler/Wowaras, Spitzer/Start/Brown, Haynes, Blight and Six-Year Construction Program Motion by Mayor Jarstad and Commissioner Stewart to hold hearings in the order listed above, carried unanimously. BROOKSIDE PARK REZONE DECISION Commissioner Stewart stated he would like to postpone the decision on the Brook- side Park Rezone for another two weeks because he felt an agreeable decision could be made. Stated he had talked to the neighbors in that area and several of them have changed their minds and they are not opposed to the project and he thinks a plan can be given to them that will be satisfactory. William Barrett spoke from the audience and stated he would like to have a decision as soon as possible because there have been so many delays already. Mayor Jarstad commented that it might be better to take another week or two for the Council to make a decision and try to work out the differences between the developer and the neighbors. Commissioner Schoneman stated that last week it was decided to make a decision this week and he felt a decision should be made now. Motion by Commissioners Schoneman and Stewart that the site plan as has been pre- sented be allowed for construction. Substitute motion by Mayor Jarstad and Commissioner Stewart that this decision on the Brookside Park Rezone be set aside for two weeks. Under discussion: Commis- sioner Schoneman again stated that a decision should be made today because they told everybody last week they were going to make the decision and they should follow through. Commissioner Stewart stated the reason he didn't want to make a decision now is that he spent some time with the neighbors and he really thinks something can be worked out. Commissioner Schoneman stated it is a good project and he thinks the City will benefit by it. Question was not called on the first motion. Question was called on the substitute motion and it carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, Yes; Commissioner Schoneman, No. -4- CITY COUNCIL MINUTES June 29, 1977 Page five Meeting recessed from 11:00 A.M. until 11:08 A.M. SCHUYLER/WOWARAS CHANGE IN LAND USE RESTRICTIONS HEARING Clerk read letter from Victor L. Wowaras, dated June 22, 1977, which requested withdrawal of the 96 unit site plan; that the 96 unit site plan was abandoned in Favor of the 112 unit site plan as recommended by the Shoreline Hearings Board. Motion by Commissioner Stewart and Mayor Jarstad to concur with letter, carried unanimously. Mr. Wowaras thanked the Council for their patience and help. SPITZER/STARK/BROWN CHANGE IN LAND USE RESTRICTIONS Clerk stated he had advertised, posted and mailed letters of notification as required by law. He then read Planning Commission Resolution No. 411 which recommended approval. Ken Attebery, Planning Director, spoke about the proposed change in land use restrictions using a map and sketch. He stated the site plan indicates renovation of two dwellings that are on the site and stated these may be removed and replaced with a new building. He stated he felt that the removal of all conditions from the zoning approval for this site could lead to inappropriate use of the property and he recommended that the use of the site be restricted to office use as proposed by the applicants and that no use be established whose primary function is retail or wholesale sales. Clerk stated that 25 advisory ballots had been sent with 15 returned, 11 agreeing and 1 dis- agreeing. PROPONENTS: Andy Andersen, Tracyton, stated he is standing in for Dean Dewell; spoke about the project and stated the owners will go along with almost everything that has been discussed. Stated they would like to have an unrestricted B-5 zone. He stated an office building will be constructed there and he felt a medical/dental office would be perfect. Mr. Attebery stated he originally recommended it not be used for medical/dental but he has since changed his mind and removed that restriction. Motion by Mayor Jarstad and Commissioner Stewart to approve application for change in land use restrictions but restrict it to office space only and that no use be established whose primary function is retail or wholesale sales. Under discussion: LeRoy Spitzer, 3414 01ympus Dr. NE, spoke about the proposed change and said they would like to begin immediately. Stated they would like to use the buildings that are already there during the construction phase and build a new office building behind; that there is plenty of room for that. Motion carried unanimously. LANCE HAYNES REZONE HEARING Clerk stated he has posted, advertised and mailed letters of notification as required by law. He then read Planning Commission Resolution No. 412 which recommended denial of the application for zone change from R-1 to R-2. Clerk stated 25 advisory ballots were sent, 15 returned with 1S disagreeing, 1 agreeing, and 1 neutral. Ken Attebery, Planning Director, spoke about the proposed rezone using site plan and sketch. He explained that Mr.Haynes proposed to place heavy screening to insure the privacy of the surrounding neighbors; that there would be approximately 1.5 children in each unit; parking for 46 vehicles will be provided on site. PROPONENTS: Lance Haynes, petitioner for the rezone, commented on what has happened between the time of the 9 dwelling unit per acre concept and the present time. He asked questions about the ballots; stated his project has not changed since the 9 dwelling units per acre. Gave review of his attempts to obtain a building permit. Stated he had reinvested heavily in the proposed project which he has called "Tennis Hills". Stated he had complied with the Building Dept. requests for changes they would like in his previous approach. He showed a booklet and explained his proposal giving square footage of the apartments and stated he -5- CITY COUNCIL MINUTES June 29, 1977 Page six would retain ownership. Some discussions were held regarding density. lie stated if duplexes were built there, it would cut down on the open space and they cost more to build and it would be a waste of money. As to the question of slums, he said he had a better size of buildings and better quality buildings, etc. and these would be considered expensive places. Stated he wasn't really after an zone but wanted the building permits. He stated that the mayor has stated this is more like he had thought when the Council passed the 9 dwelling units per acre ordinance. Also stated he had redesigned the building near 0lson's house and put in a blank wall so no one oculd be looking at his residence and also would put in a fence barrier. He gave further information about the size of the units - two bedrooms, two bathrooms, two floors, total 1200 sq. ft., renting for $400.00 per month with a one-year lease on a credit application and stated they would spend $1,000,000.00 on the project. Stated there was a demand for this type of housing. Floyd Ballantine, owner of lots 32 and 33 stated he was in favor of the plan. OPPONENTS: Pat Amo, 238 Willow St., questioned the density and read from the 1966 Comprehen- sive Plan. She stated there wasn't room enough on Willow St. to pass with cars parked on both sides; that too many trips would be generated f'or the 24 foot street. She stated this is exploitation by very few and she was opposed. Mrs. Haven, 314 Hill Ct., discussed density, amount of dwellings now located in the arc and claimed this would double the present density. Gave a rundown of the number of units now in the community. Joyce Sisk, temporary resident from Long Beach, thought there were plenty of rentals in the area and thought the price was too high and Trident is over- emphasized. Ed Mill, 219 Willow, stated he was going on record as being opposed. Stated it would be a spot rezone and if this was approved, there would be no reason not to approve other like developments in the area. Bill Amo, 258 Willow, thanked the Mayor for his appointment to the Planning Com- mision. He discussed Mr. Haynes' costs of regrading and stated that he had turned the area into a gravel pit; talked about Haynes' past efforts to get his rezone on Lebo For a 20-unit building. He stated that at the time of the proposed improve- ment on Lebo for 20 units, it was stated that because of traffic it should be denied. He further stated that Mr. Schoneman had said during the Council meeting on the 20-unit project that he had a good plan but after reviewing the testimony, he could not go along with Mr. Haynes and the area should remain R-1 and do whatever is necessary to see that it remained R-1. He also commented that Mr. Stewart had stated he had had considerable contact with the neighbors and the people do not want a rezone and that should be enough. 0nly Mr. Haynes was for it. Mr. Amo commented that at the 20-unit project, the mayor had said the area should be retained For low density and be park protected and Mr. Amo stated this has been made low density and that is 3 units per acre. He said he had checked with the City Attorney's office on spot zoning and read 4 conditions. One of these was that in a court case concerning an apartment house in an R-1 area, it was declared illegal. He stated he hoped the Council would find that a rezone in this area was not in order. Some discussion was held between Mr. Stewart and Mr. Amo concerning the statements about a slum area. Commissioner Stewart pressed Mr. Amo as to whether the area would be made a slum and Mr. Amo did not answer directly but said it would change the neighborhood. Joe Stadler questioned the $30.00 a sq. ft. statements. Al Colvin, 541 Hill Ct., stated he was not objecting to the building but to the rezone because it does set a precedent for building in R-1 area an R-2. Stated he was opposed to the rezone and didn't appreciate Mr. Haynes making money at their expense. Mr. Haynes then was given an opportunity to rebut the statements that had been made after which time some discussions were held and the following motion was made Motion by Commissioners Schoneman and Stewart to allow the rezone. After further discussions, question was called and motion did not carry: Mayor Jarstad, No; Commissioner Stewart, No; Commissioner Schoneman; Yes. Meeting recessed from 12:50 P.M. until 2:00 P.M. CiTY COUNCIL MINUTES June 29, 1977 Page seven Recessed City Council meeting was called to order at 2:00 P.M. in the City Council Chambers, City Hall, Bremerton, with Mayor Jarstad presiding. Also present were: Commissioner Stewart, Commissioner Schoneman, City Clerk Yeadon, and Gary Sexton, Assistant City Attorney. BLIGHT HEARING Clerk stated that a petition had been filed earlier in this meeting by a represen- tative of the Smith Neighborhood in opposition to that area being included in the determination of "blight". Mayor Jarstad stated that people in the area north of Sixth Street have spoken of blight in their neighborhood; however, he noted that the people have shown they do not wish to be involved in any plans and development aspects. Their concern was that they were being used by the downtown business to improve their property. Mayor also noted that the federal people had requested the area surrounding the CBD should be looked at because of its proximity to any development that might take place in downtown. He said the City Council should therefore only concern itself with the original downtown CBD area. Motion by Mayor Jarstad and Commissioner Schoneman that the City Council only concern itself with Area A and not make any determination in Area B. Under discussion: Commissioner Stewart discussed one of the points made by the petition which was that the people did not want any tax money to help one business group over another with tax dollars. He stated he thought the city should tell the business people to fix up their property and the City Council should pass a minimum maintenance ordinance and get things cleaned up. Mr. Stewart stated he thought the program should be stopped, that enough money has been wasted, and should listen to the people. Mayor Jarstad reviewed the purpose of applications for grants; also, mentioned that the comprehensive plan had to be up-dated whether for redevelopment in any area of the city. He mentioned federal dollars that have been received by the city and that funds are allocated by the federal government and other cities will be getting tax dollars from this area unless the city applies. Mayor Jarstad pointed out that a development agency is needed; if one or two property owners of individual lots in the downtown wanted to hold up improvements they could With- out the agency. Mayor stated the city is a large-scale owner of property and others will be looking to the city to see what can be done. Commissioner Schoneman agreed that Area B should never have been included in the first place but he did not agree with the statements by Commissioner Stewart that the city should fall away from everything. He stated he would like to see this followed through. He did not know whether the city was going to be declaring blight area or not but he did not believe the area north of Sixth Street should be included. Commissioner Stewart favored excluding the Area B but again stated it was time to quit studying those things and discussed the money that has been spent in the past and that he hadn't seen anything productive coming out. Mayor Jarstad discussed further the needs to look to where funds could be obtained to look into concerns of people; also, discussed the investments that have been in transportation, etc. to make the area available. Mr. Stewart recommended making a poll of downtown businessmen to see if they want to do anything; because he was not sure they did. Motion carried unanimously. Findings of Fact and Conclusions regarding the Determination of Blighted Area and Necessity for Rehabilitation and/or Redevelopment, introduced by Gary Sexton into the record. This referred to Area A only. Motion by Mayor Jarstad and Commissioner Schoneman that the determination be made as related in the Findings of Fact and that the resolution be adopted, carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, No; Commissioner Schoneman, Yes. TAPE 951 RESOLUTION (Blight) Clerk read the resolution which would adopt the Findings of Fact and Conclusions. Commissioner Schoneman stated that blight had not been proven in his mind and he would like Mr. Bremen present to explain. Mr. Sexton stated he had all the information and would have the backing for the findings of fact and not Mr. Bremen. Mayor Jarstad stated it was proper to read the resolution and set it aside until the Council can find out where it is in the hearing and determination. Mr. Sexton gave the procedures that would be followed in getting developers involved. Spoke of contact with one developer and Congressman Dicks and Senator Magnusson's Office to see what would be the best way to go to get the best -7- CTTY COUNCIL, MINUTES June 29, 1977 Page eight developer and possibly funding assistance and establish legal relationship that might be necessary in making the development. They have stated that when the hearing is concluded and determination of blight, then meet with the committee and agencies involved and consider the next step. Also, Mr. Bremen has been in touch with other potential developers. After choosing one developer, a specific plan would be developed. Some sort of funding will be necessary for the leg-work which the developer would not do; also, work in connection with any possible condemnation. Commissioner Schoneman stressed the Council has heard principally from the people to the north of Sixth Street and now the City Council is making a blight area without any major property owners being heard. Mr. Bjork was present but stated he could not speak for all the owners. Mr. Sexton commented that if they didn't come they were in total agreement. Mayor Jarstad stated he did not know what more could be done because of the accounts in the news media and the advertised meeting held last week. As far as an evening meeting is concerned, the petition was acted upon and the evening meeting requested by the neighborhood is not necessary since the action taken today. Stated also that no one in Area A has petitioned the City Council for an evening meeting. Also, stated that Mr. Isaac Soriano spoke at the first meeting who spoke that he was opposed to the procedure. Commissioner Schoneman stated he would like to have the people who own the buildings be present to speak. Discussion was held on obtaining in-put from downtown owners. Motion by Mayor Jarstad and Commissioner Schoneman that this matter be con- tinued until next Council meeting at which time everybody will be given the opportunity to come forward, carried unanimously. TAPE 1303 SIX-YEAR CONSTRUCTION PROGRAM HEARING Commissioner Schonoman stated it does not differ greatly from previous year. City Engineer Waring was called upon to explain the program and the UAB priori- ties. He said the main difference are the nine UAB projects which he bad to put in the program; there is a chance that there will be some money under UAB and the city is invited by the Highway Department to make a list of projects that might come under UAB and he had gone through and picked out some of the worst intersections in the city. Mr. Waring then gave the list of UAB projects in the following order: 1. Kitsap Way/Sixth St., Wycoff Ave. to Montgomery (6th & Callow); 2. 6th & Naval; 3. llth & Naval; 4. Wheaton/Warren (Sheridan Rd. - Hal's Corner) 5. llth & High; 6. llth & Callow; 7. Warren Ave. - 16th (signalization); 8. 15th - Naval to High (whole street); 9. First/Washington, Pacific to 2nd; 10. Possibly could do 17th, Ohio & Chester. Motion by Commissioner Stewart and Commissioner Scboneman to accept the Six- Year Plan, carried unanimously. Mr. Charles Ullock was present and commented it would be helpful to the public to put out a preliminary plan. Mrs. Dorothy Martin asked the city to keep In mind 18th & Winfield; that this need had been brought up last night at the neighborhood meeting. Commissioner Schoneman stated this was on the plan. She also noted that the rest of Perry Avenue down to llth is one of the worst in the city and Commissioner Schoneman stated that one of the big projects is on Winfield and the whole street has to be remodeled. RESOLUTION NO. 1729 Clerk read Resolution No. 1729 adopting the Six Year Comprehensive Street Construction Program. Motion to pass Resolution No. 1729, carried as follows: Mayor Jarstad, Yes; Commissioner Stewart, Yes; Commissioner Schoneman, Yes. BLIGHT HEARING Mayor Jarstad stated in answer to a question by Mr. Sexton that the blight hearing would be continued to 9:15 A. M. next Wednesday. Commissioner Stewart -8- CITY COUNCIL MINUTES June 29, 1977 Page nine stated he would like to have a petition as an indication from the CBD owners that he didn't need people to talk about it. BPOE REZONED PROPERTY Mr. Ralph Erickson was present and needed to have an answer concerning the following: The property once proposed as a site of an Elks Lodge was rezoned for that purpose to R-2 with Land Use Restrictions by Ordinance 2907 in September 1970. When it was determined that the Elks Club was unable to develop the property as originally intended, it was zoned back to R-1 from R-2 by Ordinance 3069 upon the request of the Elks and as stated in Item 14 of the Land Use Restrictions, in May 1973. Mr. Erickson has stated that the title company wants to be certain that the Land Use Restrictions did or did not continue to be in force when the property was reclassified back to R-1. In November 1973, by Ordinance No. 3095, a portion of the property was zoned from R-1 to R-2 and B-3. The remainder of the property is R-1.
