TAPE #100 MCDONALD VACATION OF STREET (DEAD END EAST llth ST.)
(B) 1835 Deputy Clerk presented a petition to vacate the dead end at East llth St.
This petition was denied on Feb. 16; 1977 because the City acknowledged the
vacation of the property by operation of law and makes no claim on this
property. Conmmissioner Schoneman gave a description of the vacation using
a map and stated that the request from Mr. McDonald is for the City to release
this portion up to the lower portion of Lower Shore Dr. This will not include
anything on the upper Shore Drive. Mr. McCluskey stated that a resolution
has been prepared and he recommended that the City Council sign the resolution
providing Mr. McDonald sign an agreement for easement of utilities. Mr.
Glenn Vockrodt, 1409 Marlow, stated that he was very concerned about releasing
this property and about this old law that permits this and he wants to look
into it very carefully. Re suggested offering him a 25-year lease for the
area he needs rather than passing this resolution. Commissioner Schoneman
pointed out to Mr. Vockrodt that Mr. McDonald has a right to claim this
land through past court actions and in his opinion it would be a waste of
time and money to go to court. The only portion that Mr. McDonald is asking
for is a portion that he has a right to.
Motion by Commissioners Schoneman and Stewart that the Resolution be approved.
Under discussion: Commissioner Schoneman stated that the roads that lead to
Shore Dr. have been widened and graded and anyone can use these streets and
the City will resist any vacation of these street ends. Mr. McCluskey
stated that a precedent has been established and he felt that the City should
agree to a resolution because this land does not belong to the City. Consider-
able discussion followed and Mr. McCluskey stated that Mr. McDonald was not
filing for a vacation but what is called a "declaration of vacation by operation
of law". Mr. Vockrodt asked for one week to study this old law and possibly
gather enough evidence to fight the vacation in court. Motion was withdrawn
until next week.
PUBLIC RECOGNITION
Carl Berg, representing an organization known as Puget Bainbridge Properties,
stated that his company owned property adjacent to Perry Avenue Mall. He
stated that they had applied for annexation to the City and the City Council
had approved, but annexation has never been accomplished. He requested that
they be allowed to hook up to the City sewer system, even though this pro-
perty is not annexed. He stated that since the annexation has been approved,
they would like to hook up one rental unit that is having trouble with the
septic tank. Commissioner Stewart told him that there is a resolution which
states that no one can hook up to the City sewer system unless they are in
the City. Mayor Jarstad stated that he should pursue the annexation' that
the question of zoning should be resolved shortly and this would be the easiest way
for him to get connected to the sewer system. Mayor Jarstad referred Mr..
Berg to Ken Attebery, Asst. Planning Director, to pursue the annexation.
Larry Roberts, 2695 E1 Dorado Blvd., requested that the City Council do some-
thing about reckless drivers who are involved in an accident where someone is
killed. He stated that his wife had been killed three weeks ago on llth St.
and the young man who was responsible has gone unpunished so far and he was
under the impression that he would be fined only $65.00 and possible forfeiture
of his driver's license for a short time. He felt this was grossly unfair
and he felt that someone should do something about this. He stated that he
felt that something should be done to protect the rights of the law-abiding
citizens. Considerable discussion followed and Commissioner Stewart stated
that he felt the City Council should pass an ordinance making it mandatory
that anyone who violates a traffic law and kills someone in the process be
sentenced to 90 days in the City jail and a $300.00 fine.
Motion by Commissioners Stewart and Schoneman to draw up an ordinance that
makes it mandatory to sentence anyone who vjolates a traffic law and kills
someone to 90 days in jail and a Fine of $300.00. Under discussion: Mr.
McCluskey stated that it would be very difficult to try cases like this
with the limited facilities the City of Bremerton has. Motion carried
unanimously.

TAPE #100 HEARING - PINKIS REZONE
(B) 2969 Motion by Mayor Jarstad and Commissioner Schoneman to hold Pinkis Rezone
Hearing at this time, carried unanimously.
Deputy Clerk stated that the property had been posted, notices had been pub-
lished and letters sent to residents within a 250-foot radius of the proposed
pczone, as required by law. He then read Planning Commission Resolution No.
389 requesting denial of this fezone and Planning Commission Minutes of Jan.
18, 1977. Deputy Clerk read a memo from the Planning Dept., dated Mar. 2,
1977, which stated that Mr. a Mrs. Jones, 1107 Dibb, called the Planning Dept.
on March 1st and the Clerk's office on March 2nd to state strongly they are
against this rezone to a car wash. He then read a letter from Mr. & Mrs.
Loman Lewis, 1112 East 31st St., opposing the rezone; and a letter from
Mr. & Mrs. Orville E. Walker, 314 Cline Ave., Port Orchard, favoring the
rezone. Commissioner Stewart stated that he felt he should step down because
he owns a piece of property on Wheaten Way which is leased to a car wash.
Mr. McCluskey stated that since he felt he should step down, then he should
do so. Commissioner Stewart stepped down.
Ken Attebery, Asst. Planning Director, spoke about the rezone using area
maps and sketches and a site plan.
PETITIONER:
Ron Ross, owner of this piece of property, asked what else could be done with
this property except to build a house on it. He stated that if the school
wanted it or if it were set aside for public use, someone should step forward
to buy this property. He stated that there would not be any additional traffic
generated from a car wash in this area and it is a shame to cause the property
to stand vacant and not be able to put anything on this.
OPPONENTS:
Mrs. Brownhill, 1109 Dibb, stated that she was opposed to a car wash being
put in that location; that there was already too much traffic and too much
noise in that area.
Motion by Mayor Jarstad and Commissioner Schoneman to concur with Planning
Commission and deny rezone, carried unanimously.

to pursue the annexation of the property adjacent to the Perry Avenue Mall.
He stated that the property was established commercial by the County but
according to the Comprehensive Plan it is impossible to bring into the City
under this zone. It was suggested that they come in under R-1 and then
apply for commercial zoning afterwards. He wanted to confirm Chat they are
not willing to forfeit their commercial zoning and therefore they will have
to approach the Council and Planning to bring this property in under its
present zoning.
Motion by Commissioners Stewart and Schoneman that City Council ask Planning
Dept. to commence the process of changing the Comprehensive Plan on the

1. Discussed the problem of City employees "feeding the meters" and stated
that he would like to change the fees for parking on City streets to 20¢ per
hr. Stated he checked to see how much it would cost and it will cost $1.68
on one meter and $2.56 on the other meter. It will take 45 days to get the
parts and it should take about ten minutes per meter to make the change.
Motion by Commissioners Stewart and Schoneman to change parking rates in the

2. Would like to submit back to the Zoning Commission the zoning changes
based on the original plan from the Planners to change having instead of just

stated that all of these zones should be included rather than the four cate-
gories the City has right now. Motion carried unanimously.

COMMISSIONERS' REPORTS
Commissioner Stewart (continued):
3. Would like to have someone look into the Civil Service Testing and Registers
that are outdated. He stated that he felt the system was very loose and many
supervisors are complaining about it. Would like to hire someone like Donworth
or a local employment service in town to look into this and make sure the tests
are up-to-date and are relevant to the jobs that they are being hired for.
Stated that he thinks it needs a complete overhaul. Would like to hire someone
to look into this and refer the recommendations to the Civil Service Commission
to bring the Civil Service up-to-date to where it should be. Not much money
is being spent on the Civil Service for the City; may have to spend a little
more money in that area. No one is left on the registers now and he is losing
two more employees.
Motion by Commissioners Stewart and Schoneman to contact Donworth and local
agencies as well to look and see what can be done to update this operation.
Under discussion: Mayor Jarstad stated that he felt the Civil Service Commis-
sion should be brought in on the discussions to get their recommendations.
He suggested setting up a meeting with the Civil Service Commission to discuss
this matter. Commissioners Stewart and Schoneman withdrew their motion and
Mayor Jarstad directed Deputy Clerk to set up an appointment for Friday or
Monday with the Civil Service Commission.
Commissioner Schoneman:
1. Have an improved condition on the watershed with the amount of rain we
have had. The rain has given the City an opportunity to discontinue pumping
at Gorst Creek Pump Station; getting an ample supply from Gorst Creek and

will continue.

ID to Traffic and then to the court, with no success. Needed the names and
addresses of witnesses to an accident and on the accident report, it said "See
supplement". None of these departments seemed to know whexe the supplement
was and he wanted to know where to get this information. Mayor Jarstad stated
that he would work with him on it and get the needed information.
Mayor Jarstad:

the passage of the school levy and urging everyone to get out and vote.
