Clerk read letter from American Reserve Insurance Brokers, dated
Oct. 20, 1977, which stated they had reviewed the claim for damages
from James McVey for damages sustained because his automobile was
towed away does not fall within the scope and intent of the coverage
afforded the City under their insurance policy. Clerk stated this
was an intentional act and Mr. McVey should have called the police
and told them his car was disabled and it would not have been towed
away. Commissioner Stewart stated he did not think the City was at
fault and Mr. Sexton agreed.
Motion by Commissioner Stewart and Mayor garstad to deny claim for
damages from James McVey in the amount of $29.43, carried unanimously.

stairs at 254 Second St. Clerk presented memo from Mr. Waring,
dated Nov. 4, 1977, and stated that Mr. Waring's office made an
investigation. Clerk stated the claim and Mr. Waring's report will
be sent to the insurance company.
CLAIM FOR REPAIRS, WARREN AVENUE SUBMARINE LINE
Clerk read memo from City Auditor, dated Nov. 7, 1977, which stated
the Warren Avenue Submarine Line repair was approved on Oct. 19,
1977 at an estimated cost of $2,556.00; that the final billing is
$6,689.62. The memo stated further that a discount of 1% is allowed
if paid prior to Nov. loth. Clerk then read memo from Water Superin-
tendent, dated Nov. 4, 1977, which listed the unforeseen problems:
(1) Electrolysis of all the bolts/nuts on all joints; (2) Swift-
ness of tidal currents that only allowed the hard-hat divers 50 min.
of work during an 8-hr. shift; and (3) Installation of concrete
barriers and thrust blocking.
Moti~ by Commissioners Schoneman and Stewart that the repair of
Warren Ave. Submarine Line was an extreme emergency and authorize
payment of $6,689.62 to Ablitus, Inc. Under discussion: Commissioner
Sehoneman stated the emergency .repairs are only expected to work for
m0t m~re than two years. Study is~being made to see if a water line
can De hung on the Warren Avenue Bridge opposite the side of the other
water line. Motion carried unanimously.
SWIMMING POOL COMPLEX CONTRACT
Clerk asked City Attorney to approve bond and insurance for the
Swimming Pool Complex, which he did. However, he stated that he had
not seen the Tisdale contract and therefore, at this time, he would
not approve it. He also suggested the City Clerk be vigilant con-
cerning having construction specifications sent to his office prior
to calling for bids and that he was trying to save the City possibility
of a money loss by being careful regarding the specifications.
REQUEST FOR REFUND - Special Police Commission
Clerk presented claim for refund of $25.00 for a Special Police Commis-
sion for Jon Lagerquist. Clerk stated Mr. Lagerquist requested a

DROUGHT RELIEF LOAN
Clerk read memo from City Auditor, dated Nov. 8, 1977, which stated
that Jim Gay has requested a repayment schedule for the loan of
$204,000.00 which has been offered the City by the EDA. Attached
to the memo were examples of repayment schedules: Table 1 is equal
installments and Table 2 is level debt service.
Motion by Commissioner Stewart and Mayor Jarstad that Table 2 be used
as a repayment schedule, carried unanimously.
CENCOM - New Contract
Clerk read letter from CENCOM, dated Oct. 26, 1977, attached to which
was a new contract for emergency connunications service. The letter
stated the contract is the same with two exceptions; that the formula
for allocable proportion has been changed to units of "use" as the
only criteria to compute cost and the budget deadline has been changed
to 90 days rather than 120 days. Clerk then read memo from Fire
Chief, dated Nov. 9, 1977, which stated the contract represents an
approximate 20% increase in charges to the Fire Dept. Clerk stated
that the method of computing the charges for using the services of
CENCOM is the only major change, and on the basis of the recommended
change, it appears as though the cost will be somewhat higher for
the Fire and Police Departments. After a short discussion, the Mayor
suggested having a conference with his departments to decide whether
to accept this proposal.

PUBLIC RECOGNITION
Anne Maloof, 178 Kitsap Lake Drive NW, read a letter signed by Robert
Merhaut, Acting President of the Kitsap Lake Environmental Association;
dated Nov. 9, 1977, which requested that the Goit rezone'hearing
scheduled for Nov. 16, 1977 be held at the same time as the Backman
application for rezone, which is being heard before the Planning
Commission on Nov. 15, 1977. The letter stated this would allow
those people interested in these hearings to attend only one meeting;
that the properties for which these rezone applications are being
made are adjacent and are similar both in context and effect on the
neighborhood. A lengthy discussion followed with Mr. Sexton stating
that these are separate hearings and they will be held separately
anyway. Mayor Jarstad stated he felt it is a proper request to cancel
the Goit rezone hearing and postpone it for a couple of weeks; that
a new hearing date could be set next week after the Planning Commission
Meeting. Mr. Sexton stated the hearing should be held as advertised
and Commissioner Schoneman stated he felt it was grossly unfair to
hear just one side for a request to cancel or postpone a hearing.
After more discussion, it was decided to hold the Goit hearing as
advertised, take testimony 'but.not make a decision and continue the
hearing to a future date.
COMMISSIONERS' REPORTS
Commissioner Stewart:
1. Has been working with one of the Asst. City Attorneys trying to
get a minimum maintenance ordinance prepared for presentation to the
City Council. Discussed the importance of such an ordinance and Mr.
Sexton asked Commissioner Stewart to work with him on preparation.
2. May use the computer for dog and cat license renewals and may
require the services of an outside programmer. Investigation indicates
that the increased income from a more efficient method would bring
in sufficient money to assist in defraying the expenses of the system.
In fact, he suggested he could pick up $15,000.00. Also, he would like

something done so that animal sales from pet shops could not be made
without reporting to the City.
3. Commissioner-Elect Swanson and City Clerk-Elect Mandio should be
brought into the budget process.
Motion by Commissioner Stewart and Mayor Jarstad to send a note to
them that the preliminary budget is ready and would like their input,
carried unanimously.
4. Health Dept. is going to increase their fees for the City's share.
He brought this up at the last Health Board Meeting and he would like
to have someone look at the tax situation from the County and the City.
The proposed payment is in the area of $100,000.00. He noted that the
City pays County taxes but the County does not pay C~ty taxes, which
may have some effect on the City's rightful share. Suggested engaging
Jim Hudspeth, CPA, to look into the matter and he didn't believe this
would cost the City very much money. He asked for concurrence of the
Council and there were no objections.
Motion by Commissioner Stewart and Mayor Jarstad to engage Jim Hudspeth
for checking on the formula and pay his charges from the Cumulative
Reserve for General Municipal Purposes Fund, carried unanimously.
5. Stated the Council was aware that he had sent a letter to U.S.
Navy, Western Division in San Bruno, relative to increasing the water/
sewer rates. That office has called and questioned the reason the
City didn't set a rate. Commissioner Stewart stated in the past he
had set the rate but he has been criticized for this in the past and
perhaps the City Council would rather have a consultant for this. He
stated for about $5,000.00 he could get a consultant to set a rate
and he would not be as prejudiced as the rate Commissioner Stewart
would probably set. He stated he would gladly do it or hire someone.
Mayor Jarstad stated he thought it was the right thing to do; that is,
have a consultant set the rate. Commissioner Stewart stated he would
contact someone and get a proposal and Mayor Jarstad agreed to obtaining
a proposal.
Commissioner Schoneman:
1. Kitsap Human Services Building is about completed and City crews
have started to construct the sewer line. They would have a connection
and it would be available to the property across the street for future
connection. The construction will be complete in about five days.
2. Better water conditions this year than last year at the ds~. The
lake is normal compared to other years. 68 mg over this particular
date of last year. If continue with heavy showers, the City's
storage will be back to normal and will suggest to the next Council
that they consider sprinkling rates next summer. BUt this will depend
on the rain this winter.
3. Timber harvest total revenue will be around $105,000.00 this year.
This amount can be anticipated each year with the type of management
being carried on in the water shed.
4. Will be a preconstruction meeting with Moss Construction Co. on
the Wheaton Way construction, Broad to Riddell. This will be in the
Public Works Conference Room, Nov. 15th at 1:30 P.M. City has received
tentative approval from the Dept. of Transportation and the contract
is in the attorney's o£fice being checked.
5. Stated he had given City Clerk a letter he had received from PUD
No. 1 asking the City to pay for the cost of the exploratory well at
BridSe Ridge. (Letter read later by City Clerk.)
6. Congratulations to Mayor Jarstad and Commissioner Stewart for
successful election and to Mrs. Mandio for election as City Clerk and
Tom Swanson for successful election to position of Commissioner of
Public Works and Utilities. Stated he felt sorry for the County on
the close loss on the park bonds. Failure of that election will set
the County back as far as additional funding is concerned.
Asst. City Attorney Sexton:
1. Congratulated thosepresent for their successful elections and the
two new members of the City Council. He was also pleased to see that

initiative passed amending the initiative that had been previously
passed by the voters last May. Noted there is a hearing before the
Superior Court at this time on the initiative ordinance.
2. Had given commissioners copies of the proposal on the shopping
center lease agreement and Archuleta. Said he was not really con-
cerned about approving those forms today, but he was ooncerned about
passing of the resolution employing Archuleta. Commissioner Stewart
stated he was concerned about Mr. Archuleta being able only to deal
with Coldwell Banker under the present language of the proposed
resolution and this would tie the City down to deal with someone
who has not given the City a proposal. After discussion the words
"or other developer" were inserted in the proposed resolution. Mr.
Sexton stated the City Council will see the agreement but Archuleta
can't do anything without having a developer come in. The flexibility
of choice was discussed and the following motion was made:
RESOLUTION NO. 1740 - Hiring Burke Nicolais Archuleta
Clerk read, "A RESOLUTION directing the hiring of the firm of Burke
Nicolais Archuleta to prepare materials for a Preliminary Determina-
tion of Intent for a downtown urban redevelopment plan pursuant to
RCW 35.81".
Motion by Commissioner Stewart and Mayor Jarstad to pass Resolution
No. 1740 as amended, carried as follows: Mayor Jarstad, Yes; Commis-
sioner Stewart, Yes; Commissioner Schoneman, Yes.
Mr. Sexton stated he had presented to the commissioners an agreement
with Archuleta and would like to have the commissioners have an
opportunity to review it in the next week. Stated he was going to
California next Wednesday and while there, he will meet with Archuleta
and probably.Coldwell Banker as well. Probably then can have him
sign the agreement which he would then present to the City Council.
Mr. Sexton discussed his rewriting of the agreement concerning Coldwell
Banker and his change of dollar figures. Mayor Jarstad stated before
he can make any judgment, he is going to need considerable information.
He suggested that Commissioner Stewart look into some of the malls
around the area and their lease-type arrangements. Mayor Jarstad
stated he appreciated the effort being put into this by the City
Attorney's office. Commissioner Stewart stated he would follow up
checking some of the malls right away. Mr. Sexton reported further
on what Mr. Archuleta is doing regarding working on some plans and
proposals. He will be making another trip to California to check
with Mr. Archuleta. He stated he has the escrow agreement which he
will have filed and noted the new name of the downtown group is the
Town Center Redevelopment. They have $12,500.00 on deposit now.
Mayor Jarstad:
Congratulated Commissioner Stewart and Commissioner Schoneman for
election to their offices. Noted Randy Castro was present and stated
he appreciated his support and endorsement. Also stated he thought
he has seen his last campaign.

Asst. City Attorney McCluskey has recommended that a settlement be
made with Ira and Luba Alexander, owners of the property located
on the corner of Wheaten and Sylvan Way (old Safeway Store Bldg.).
The settlement is some three or four thousand dollars less than
the court probably would decree and is recommended as the best
course to take. Clerk stated he had discussed this at length with
Mr. MeCtuskey and has agreed with him that this should be recommended
to the City Council for approval in the amount of $27,321.00. Some
money has already been paid on the ease and this would be the settle-

ment in the amount of $27,321.00, carried unanimously.
